After 2003 EPFO is not accepting to excercise the option. In Sept 2014 they brought some amendment which is contradictory to the scheme. Govt subsidy of 1.16 % charged on the head of employee, average changed to 60 months, 2 years additional weightage is added in the wages of 6500/- only . No body is allowed to get full pension etc. Hon CJ Surendra Mohan's KHC verdict is impartial and genuine for low level pensioners EPFO of India to get the genuine pension to survive. Higher pension cannot be denied to those Employees who was contributing 12% in EPF account and 3.36 % Employers cont + 8.33% in EPS account on Actual salary even if in Exempted or Unexempted org. Those who are contributing on minimum salary, is objected by EPFO. Now EPFO is mixing all the cases together inorder to complicate the case in front of hon. SC. Prolonging the case by handing over to 3, 5, 7, 11 .... Benches seems injustice to pensioners.

Yes, main confusion is with enforcement department. They never share the facts on what basis pension is calculated. Even judiciary clarifies all the options, but enforcement department is not getting any confidence and hence no any support. As a result such pension issues. They never shares even formula also on what factors, considered for calculation.

Hello, government has initiated and is trying to change the labour laws, hence wage code is issued, but unless all states forms their related rules, government can not change it one sided. Please the status of wage code, unfortunately government has to hold it. In our country being democratic, we maintain geographical and regional balance and hence one sided government is not in position to force the change. Its unfortunate situation in our nation. Sir, I am a member in EPS for 5 Y and 4 months. Aged 57Y. The EPF is deposited at Rs. 1250 pm and the corpus is now approximately 80K. Can I withdraw the the amount declining the pension?

No, you have no any problem as your pension service is less that 10 years and hence you can withdraw both accounts (EPF and Pension) full.

I had explained all similar queries in this chapter and suggested not to go for higher pension as there is no clarity in enforcement department of epfo and likely to stuck in the process without getting any benefits including current benefits.

In absence of financial experts/Advisors in the EPO and the EPO Trust , a proper analysis of the pension fund managed by clerks of EPO.Thr Govt.India should also how the social security of retired employees, managed.It is not out of place that whether Govt .employees or Pvt.sector and unorganized employees,both should get same pension.It may note that pvt.sector are hardworking and their contribution is more than Government employees.

I have found All respective governments is not interested in Private company employees welfare as there is no strong forum to support their grievances. All parties get votes from this poor non governments who contribute to exchequer largely are ignored and used as pawns for their benefits and do a lot of benefits for all government enploees of State and Central, Public sector and any type of Quasi government. Unless the Central government interevene and put pressure on EPO these poor employees pension will not be enhanced. .

Yes up to certain extend what you say it is true, but Govt has done its job and proper/effective implementation is in the hands of Govt employees like EPFO. Kindly inform us, after this why three member judges for our case. What is the real position and when judges appointment made. Eventhough supreme court gave judgement in favour of EPS 95 pensioners two or three times, EPFO not care about that. EPFO is higher than supreme court, so EPFO not care supreme court judgement.

Basically cases depends up on the merits of the case. If similar case is in process then latest Supreme Curt decision will be followed as guide line for all such or similar cases. For your information last judgement is not in favour of anybody. Please study the judgment text carefully. Its very difficult to understand for any member. After 58 years, members pension contributions are deposited in EPF account. It means, 58 years is cut off date for pension. Hence after 58 years you are not considered for pension service.

Whether the Hon. Supreme court of India Judge's , ( judiciary) ministry and administration had , have and shall have been knowing about the RS. Many lakhs crores money in EPFO in which have been coming into crores of India labourers from 1995 to till date date of 2021 > 17/11/2021 and at the same time no one of three wings judiciary ministry and administration did not say Yearly once DA OR two yearly once DA shall be issued to ret Employees pension scheme and three wings judiciary ministry and administration persons are not being in man kind stages and thus render justice UNITED ENERGY TRUSTEE'S VICTORY .

Basically Supreme Court is bound by certain constitutional provisions and what ever matter is brought to the board, same will be argued and depends up on the prayer of the parties final decision is given. What ever you say, unless original EPF scheme is revised-amended till then no any hopes.

In a nut shell just verdict but no doctor available to treat the patient. During Covid everyone made start up. Why not the IT employees do some work for the EPF department for the benefit of the country. All just a same boat which has hole.

I think Supreme Court has specified the treatment, but doctors (epf department) not competent enough to understand and implement or guide the patients. Basically Hon Supreme Court is the highest and final judiciary in India. As of now its final and binding. However in future on similar grounds if anyone again approaches same authority and argues differently, then you are likely to get different interpretation. Till thein this is final and binding. Basically, pension depends up on lots of factors and in brief-your pension contributions, length of service, any break in service, etc. You can also ask epf department on which factors-your pension amount is calculated, but they never gives any details. Hence in absence of such details, it is very difficult to under as to what factors, epf has considered. But for getting higher pension amount, never try as there is no transparency. No while calculating your pension your final and fix figures are taken and your pension is decided. Like central govt employees, private firms employees are not eligible for any variable factor. Hence you will get same pension till last day of your life.

Its simple logic, you must have observed in current scenario, lots of affluent families suffer as there is no support from their children. It means you are very senior and covered under 1995 epf pension scheme. Members who are covered under 1995 epf pension scheme are getting very less pension as very small amount was initially contributed by members. So it looks like correct pension amount.

In my opinion, I don't think EPFO will try to elongate this matter further. They have to only concentrate on implementation of various options transparently, this may probably help every one. I agree one should not dream for higher pension for various reasons, as I had already given my recommendations in video. Please keep watching and sharing our videos.
