If Governor has ground to believe that the CM has lost majority he may ask CM to seek vote of confidence.Such ground may be written or unwritten and no one can possibly insist Governor to explain in the matter that how did he feel that majority was lost.Of course Governor can't ask any party to head count before him and ask only assembly to prove vote of confidence.This is what Maharashtra Governor did .Court could pass strictures against Governor but may not possibly reverse the actions did by the Governor.

It is clear you haven't followed the arguments put forth by Mr. Sibal. Schedule 10 was brought into the constitution only to prevent the kind of horse trading that has taken place in this case. Mr. Uddhav Thackeray could have lost majority only if the BJP had merged with another party and not by a faction of the SS claiming that is the true party even if it has more numbers than the faction that didn't have the numbers.

MLA can not dictate and decide independently they are bound by party rules. Party is under the framework of representation of people act. There is difference between legislative party and political party. Plotical party decide what legislative party does on legislative assembly . If majority of MLA does not like leadership then they have to call for new elction of party leadership appoint your own head of party and and they can now go the governor. They can't randomly say he/ she is our new leader of party insted they have to go the election commision for that matter. They have to follow the party rules and appoint new leader.

Kapil Sibbal is saying even if 99% of the MLAs go to Governer and complain against 1%, the Governer should not take congnizance of that. Oh Come on. If you give such powers to the people in charge of the party you are killing the democracy for sure. Unfortunately, the Supreme Courts verdicts depend upon the thinking of S C Justices. When speaker of Karnataka disqualified some BJP members, who were invisibly chained and dragged to Hotels in Chennai and then to Hotel at Goa by Mr Kumaraswami, as seen in digital T V in those days by me, and also may be by the Speaker also, considering them as traitor of BJP, the Supreme Court set aside disqualification. As such, how could the elected MLAs of Shivsena can be disqualified as they did not like the functioning of by then Shivsena President ?

1) if a faction of 40 persons out of 55 can not call itself a party then how can a faction of 15 persons can claim itself to be a party ?? 2) the faction of 40 out of 55 was a party from very day it took shape and NOT from day on which ECI acknowledged that faction as real SS . 3) Both dy speaker and speaker are partyless and ALL members of legislature ( not political parties ) elected them or removed them . I e no party can remove them . 4) only party pradot ( person authorised by party to issue whip that is applicable to all elected representatives of that party ) can be appointed by party 5) no confidence motion against dy speaker and speaker were moved by members of legislature and not only by SS . And new dy speaker and speaker were elected by members of legislature . 6) no boss of any political party can remove an elected representative from house . He can only remove him from party . This shows political party and legislature membership are two independent matters . 7) mere fact that ECI recognised a faction as party from a latter date than date it actually happened can not obliterate namaste mean that it's withdrawal of support to govt was not from a partner of MVA . 8) if CM enjoyed support , why did he resign ???
