The Supreme Court said Monday former President Donald Trump has immunity from federal prosecution for official actions he took while in office. There is no immunity for unofficial acts. The court split 6-3 in the decision.

Great response...It's really not as bad as it seems. According to the Supreme Court, an “official act” is “a decision or action on a ‘question, matter, cause, suit, proceeding or controversy’” that “must involve a formal exercise of governmental power that is similar in nature to a lawsuit before a court, a determination before an agency, or a hearing before a committee.” Jan. 6th was no official act. And, Nixon tried that same defense in his trial.

Since the Supreme Court votes along party lines it should be changed to where the american people vote for the justices instead of having them appointed.

It wasn't along Party Lines. Rather a group of Justices who know the Constitution and a group who does not. The fact is the Lower Court and Prosecutor did not present any evidence that the former President was resposible for the Jan. 6th Insurrection and that is why it has been delegated back to the lower court. There is no where else to go with this bogus case and charge. Fact is the former President asked Nancy Pelosi and the Mayor of D.C. to send National Guard and they refused. The fact is the Former President is not responsible for a small group of people taking the law into their own hands. And recently the court ruled that some of these people were not gulity.

Immunity for official acts that are within presidental job description. Anything outside of presidental limitations would be prosecuted. No coupe etc falls under this ruling.

Jan 6 not an official act, but Trump's conversations/order with Justice Dept and Pence are considered "official acts." Much of the prosecution's case is based on those conversations. Yes, it is quite bad. They basically said now every teacher, doctor, pilot out there can behave however they want as long as they say it's an "official act."

WRONG: (1) The check on the President's conduct is called Impeachment by the House and Trial by the Senate. (2) Seeking to overturn fraudulent elections or encouraging of protest against fraud are OFFICIAL DUTIES IN THE INTEREST OF THE NATION. However, he can, he should and it is his duty as president to, challenge fraudulent elections, encourage the People to protest electoral fraud and/or try to convince officials not to certify results of elections he deem compromised. Those are all acts in the interest of the COUNTRY. In fact, all POLITICAL ACTS can be said to be official as they are a matter of fighting for policy and cannot constitutionally be made illegal. Regardless, even in such cases, while the president cannot be prosecuted, he can be stopped from carrying out such acts by CONGRESS through impeachment and conviction. -- Democracy and representative government REQUIRES that that candidates and the People can NEVER, EVER, be punished for political dissent or for seeking recourse for elections they (not the government) deem fraudulent, rigged or otherwise compromised. Only Saddam jails people for questioning and protesting election results.

U.S. democracy has been under attack for quite some time. People will realize too late what they have created and done to their children and their children’s children. It’s really sad to see it coming to an end. Although fighting is and has prolonged it. This is another reason why crime is rampant at street level. The only difference in the way it’s seen by a lot of people is because of privilege of those committing. This blinds them and crime doesn’t look like crime because of it. Or they feel it’s ok. Those that helped get us here, will also find that they will not be elevated to wherever they thought they would be will be among everyone else. Context, context, context, the ruling was exactly how I thought it would be and I am not a lawyer. The media and the legal community failed to crystalize the issue for the American public. The Justices allowed two separate issues of absolute immunity to be argued on one set of facts. The only question that should have been asked and discussed was, whether a President has absolute immunity from crimes that he, or she, committed while in office. According to the ruling, a President does not have absolute immunity from crimes, he commits, while in office.

The President was never "charged" with Insurrection in the 1st place. And when in power he wanted to empower the National Guard and Nancy Pelosi refused and the Mayor of D.C. refused help. Trump is not responsible for the actions of a few people. Moreover, he said go and Protest in Peace. The Lower Court was on a Witich Hunt and failed to produce any substance or evidence against the Former President. The President has 1st Amen. Rights to express his opinions. Let’s not conflate “official” with “while being in office.” “Official” is about a determination of if an action is required of the President in the fulfillment of his Presidential duties…it’s a judicial judgment call.

Immunity would be for official acts. Acts not within official acts "basically outside of his job description and outline of presidential powers as stated in our constitution" would be prosecuted (ie coupe etc). This far from makes the office of president all powerful.

you are wrong. They explicitly said that if an act is presidential the President has complete immunity to do whatever he wants. You forgot that Trump incited a insurrection on Jan 6th, 2020 in which he tried to overthrow the government of the United States and prevent them from verifying the democratic vote of the American people. In that event people got killed and seriously injured inside the US congressional building. Therefore, Biden can more than make a very good argument that if he orders Seal Team 6 to assassinate Trump right now that can be considered a presidential act to try to bring to justice the people who attacked the congress of the United States and an thst this is an attempt to protect the government of the United States. That would be a presidential act.

They discuss here at length three dissenting judges which are not the court's biding decision. The court stated that Presidents have absolute immunity for official acts stemming directly from the Constitution and immunity from criminal prosecution for all their official acts done while in the office of President.

Before everyone loses their minds about this ruling, take a look at case law from lower courts across the country on the topic of immunity for other public officials (such as prosecutors, for example). The Supreme Court’s ruling here is consistent with the law in this area. There is nothing surprising about this ruling when you put it in the context of how many other courts have ruled on similar issues. The reason this ruling is getting so much attention is simply because of the controversy surrounding Trump. But from a legal perspective, the ruling is nothing unusual or shocking.

Considering what could be at stake with presidential immunities (risk factor), i have a hard time understanding the ruling or opinions of judges that are known to have been put in place with Trump's help. I doubt this is normal. Even within caselaw. This is a slippery slope. Nice day tho.
