Agreed. One of the things gov loves to do it's create jobs, especially for their minonions. The jobs are not only government jobs but also jobs in the private sector. The creation of DEF is one of those worthless jobs. To contrast FMCSA is one of those gov agencies with pretent jobs "cloaked in safety". TSA is another. In the case of both, we would need neither one. The only reason they were brought into being was to allow the Invasion of our Nation to provide Mass numbers of cheaper labor and Massive numbers of Consumers. ALL OF HAS BEEN EXTREMELY BAD FOR AMERICAN CITIZENS but great for business, Corporations, Gov, representatives, foreign countries and their people, while destroying the very people that made this Nation, Europe and all of Western Civilization.

I am not one to stick up for any Emissions garbage, but I know one simple fact, what they have done has made a difference, as a total package, not necessarily the veracity of each individual systems. Don't know how long you have been out here, but I got my CDL's in 93 and I remember my first time rolling into an Arizona truck stop in the summer and all them trucks idling, the fumes were so strong, a haze, walking back to my truck I almost got sick, the heat holding it low to the tarmac. I was no softie to it either, spending lots of time at drag tracks and races. Emissions may be BS. but it has made a difference, that is the FACT, experienced from 1993 to 2024. Now that just means they did what they set out to do, doesn't mean the tradeoffs were viable, but that will always be opinion based.

@@sword-and-shield we are all suffering from the effects of the foods we consume and the air we breathe maybe if we stopped fireworks over water illegal dumping and spraying chemicals into the air maybe if restaurants aren’t feeding people plastic disguised as food I would listen to that argument it’s an awful amount of pollution that’s not from trucks

Dot Should have restrooms available for the trucks they pull in. With out restrooms they are harassing truck drivers. The states should be sued for not having them.

@jerimiah3118; send complaint to OSHA and Your Health Department and get the ball started. They will have to open an investigation and can be shut down and/or fined if they do not comply timely.

I’m just waiting to hear that I can delete my DEF. I know drivers that almost lost their business over $8000 def repairs and that’s cheap because he didn’t go through the dealer and didn’t need to get towed. What a scam they have.

I deleted it ages ago. Just don't go the CA and any states passes NY. You will be fine. 😂 If you lives at those states you better run for keep business in trucking.

@@heydennisha if you breakdown near your dealer, they won’t fix your truck once they see that it’s been deleted. That’s the main reason I didn’t do it yet. So far I have broken down once and the closest mechanic was a peterbilt dealer so I had to go there. Good thing I didn’t delete. However, everyone tells me that once I delete, I will have less breakdowns . It’s always a NOX sensor or something related to that DEF system.

@@MrLoudog7 who goes to a dealer these days. They charge you 2x-3x of the price and the quality even worse than local mom and pop mechanics shop. I went twice for dealer service and never again. Most of the time they have all the premium tool and don't even know what they are doing , and another break down right after out of the dealer with the same problem. ! Plus as being a small business owner , max profit margin is my priority for current survival, and that potential mechanical issues that belongs to the future or it may be is not a problem at all .and if you keep your def after 700k miles your truck would keep breaking down cause of it , and keep spending 8k to13k a year to let the dealer just temporarily fix it only last couple months unless you replace the whole after treatment system and that s total of 20k to 40k USD . So enjoy that. That why all the mega company buy a new truck once the old ones hit 400k miles. But for small dogs like us not allow to do that.if the gov don't give the small dog any incentive to keep the def system , then there is no point for me just kept burning tons of money to just keep it.

@@MrLoudog7 ok. If you break down just go to the mom and pop shop. Why I need dealership anyway. If they charge you 2or 3 times of the price but can't even fix the issue (def problem after your truck hit 700+k mile). That's why all the big company replace their trucks every 400k miles. You basically have two options after your truck hit 400k miles. Kept spending 8k -13 k every year just for a temporarily fix, spend 20-40k USD to replace the whole def system , option 2 delete it or buy a new truck.

@@magigooter2096 DEF was the main issue with Insomnia, Lung cancer and Sleep apnea.. Let's face it. 1984 and older ..those were the best vehicles ever .2-3-4 million miles and Rebuild them again and again.. Now a days..we are lucky to get 750,000 miles out of a TRUCK that breaks down 10,000 times

You can probably put a pre emissions engine in a new truck without fear of the communist epa and broker transparency will go through courts not arbitration.

DeF is a scam increase the compression and increase minimum rpm reduced emissions only problem is city stop 🛑 and go traffic down time idling ? diesel power generators have a fixed rpm that they operate at that in the end reduces emissions they are on and running at fixed speed or off not running no idieling

My dad was a trucker from the gas burner days, he made it a point to keep me out of trucking. He knew the business would be regulated to death. With this new ruling, I think it would be safe to reconsider my options.

How about these: 1. High blood pressure monitoring which just got ruled on 2. Sleep apnea which isn't even a Rule. 3. The specific guidance for anti depression medication 4. Diabetes guidelines This is just a start for specific rules on a ",General Physical". Here's the problem, you still have to file site which is prohibitive. Truckers don't have the time nor the financial resources to fight the huge coffers to defend itself.

Just need the hours of service re-looked at, and the allowance of removal or ban of egr/def systems and look for greater alternatives like the speed of air dimple pistons. They make your truck run cleaner and more efficient. Maybe even have the DOT officers relax on their bs.

Not sure of your sources, but it started with chevron challenging the gov. on rules to follow and ENDED with the fisherman saying they shouldn’t have to pay for observers. Great video overall!!

I have 2 old trucks no DEF or emissions. I can’t compute all the downtime with newer equipment. I have never considered anybody in government service, that knows anything about trucking.

We need to just shut this industry down. I for one am just sick and tired of being told how to run my business. There are too many people making laws that don't have a friggen clue about trucks or this industry. I know this is never going to happen guess all trucks will be off the road when they finially it into the ground when nobody can afford to truck anymore!

Some people believe in no regulation....... Repeal it all......... The idea is that employers are ultimately responsible financially for hiring unqualified drivers and they will bankrupt themselves........ No need to harass the rest of us with 6 different DOT inspection stations every day. Leave the obvious regulation's in place like no speeding, no running stop signs. But gut 99 percent of it.

I agree about the disconnect of the FMCSA office people and the way the driver have to conduct business... Hundreds of new warehouses in Phoenix, Las Vegas, etc. and not one space to park in or around those areas... That its crazy. There should be laws that force the shipping and receiving have parking, staging as well to cities to accommodate truck withe adecuate parking... 😅

It won't be a moment or two of uncertainty, the Supreme Court did more than make it easier to challenge regulations, they basically gutted the vast majority of agencies to regulate in the first place. They've effectively made it so that if the regulation isn't expressly laid out in legislation by Congress then the odds of it being effected by the agency are virtually nil. Every regulation can be challenged at any time by anyone claiming injury, even if the actual claim is spurious and will tie up court resources which are already taxed. And this can/will be done in virtually every situation where regulations exist outside of the direct legislation set forth by Congress. Instead of one sometimes heavy handed system, we'll now have 50 independent ones, because that always works out so well.

@@DanstevGraker Well said. Now instead of agencies having expertise in a certain areas and topics promulgating rules, courts with only a superficial understanding will be the authority. With this ruling, now the courts are going to have to grapple with applying congressional intent, when even Congress left that to agencies.

Chevron *only* applied to places where the law was vague. Most laws are not vague, but are painfully pendent in defining everything. The idea that the regulators are the experts, and should be listened to is sound in theory, but in reality regulators get over zealous. Chevron Doctrine turned out to violate a federal law passed in the early 20th century that was specifically intended to prevent regulators from being too zealous. SCOTUS did not even need to address the separation of powers issues the Chevron created, but it certainly is a violation of that. Now, instead of Chevron being the standard (courts *had* to bow to unelected regulators), Lenity will take its place requiring that laws be interpreted in the light that is most beneficial to the defendant. If the people do not like the outcome, then the people can change the law through Congress.

ELDs, speed limiters, sleep testing, basically any RULEMAKING, that wasnt actually a LAW, passed by congress, can be up for scrutiny. I emplore EVERY owner op to send OOIDA, $25 to $50 to help them challenge the crap out of these Arbitrary rules. LFG!!!!

Hopefully they do something about the 10hr mandatory rest period. All drivers don't need 10 hours to sleep, let alone 6. Drivers can be more productive and efficient with more drive time. There are 3.5 million truck drivers and only 312,000 parking spots. DEF tears the truck engine apart and the taxes are becoming confiscatory

I don't like the idea of lobbyists for corporations being able to buy a favorable ruling as an excuse to cut corners wherever possible. None of this will trickle down to individual truckers, it'll just make it easier for carriers to cut every possible corner in the name of corporate profits for shareholders and at the expense of the individual trucker. I see positives in this ruling, but there are a lot of net negatives that should be explored, that no one is talking about.

​@@joshua43214 Large corporations have abundant resources available to them to be able to influence the courts to make or amend a ruling in a way that makes it more favorable to their interests. Political Lobbying and Campaign Contributions to influence lawmakers to appoint judges sympathetic to corporate interests. Corporations strategically select cases to bring before the courts, aiming to establish precedents or challenge existing ones that could impact their profitability. They fund cases through advocacy groups or directly through their legal departments. Hence, the overturning of the Chevron doctrine ruling. Lastly, they fund extravagant trips and networking engagements for Supreme justices, where heads of these large corporations have personal access to them, often buying lavish gifts for them and their families. (Look at justice Thomas.) These are common tactics that large corporations use in order to further their own interests, often at the expense of their employees. and these are just the legal avenues that they use, and now on top of all that, there's no government intermediary in place to check the power of a particular corporation working with the judges to pass laws in their favor, and to get rid of the ones that they don't like.

@@erickpacheco1623 it might be possible. If someone challenged the 2003 log book rules and had it overturned then it should affect the eld mandate. The 2003 rule for log books was a detriment to drivers and their health. It was hard enough under the rules prior to the rule change but after 2003 they made drivers work longer in an already stressful day. They also made sleeper teams work harder and made driving a truck less safe.

FMCSA's Coersion rule says that brokers, shippers and receivers can't order truckers to roll dirty on equipment or hours without consequences. This was already the rule for trucking companies under federal law (it's in the Surface Transportation Assistance Act). That's one FMCSA regulation I hope they can keep.

@@joshua43214 The FMCSA coercion rule as applied to trucking companies is fine. As applied to shippers, receivers and brokers? Yeah, that's not in the federal law in question (Surface Transportation Assistance Act). I hope FMCSA gets away with that one but...yeah. (Plus they've done a shitty job of enforcement...)

I love my 20 minute power naps. Longer than 20 minutes and I wake up groggy. I’m up at midnight to 1am and I try to be asleep my 5:30 pm. Life happens, someone calls, there’s some household chaos that needs addressed like a broken water line….. 💩 happens. 23+ years as a commercial driver has conditioned me to function on limited sleep and a Power Nap or two if it gets to hard. And yes, I know where my limit is, and I’ve never gone too far. I become miserable when I get that tired. I honestly don’t know how anyone can fall asleep at the wheel. And any company giving me 💩 about stopping for 20 minutes came blow me. Clean driving record with lots of experience…. I have options. If the dot wants me out, I’m sure Pablo would love my job. It is what it is. But I see more accidents now than ever… maybe we need more rules?

Yep. Just like the cannabis industry and house squatters issues . Nothing has changed😂. Even fed and suppreme court set the bar but no states follow and none of them get in trouble . Amendment ? What is that thing ? 😂

I don't know why people are celebrating, this will be horrible on trucking. If the states start to regulate trucking it will cost a whole lot more. Also from several lawyers I watched and read articles from stated that it is not retro active. So the courts will only look at future cases after SCOTUS decision.

Just gives more power to the FMCSA which is a bad thing for drivers. This career used to feel like it has alot of freedom. Over the last 15 years it's been aggravating to deal with.

None of these cases would have seen the light of day if Joe & crew didn't attempt to overreach on an extreme level, Everything, I mean everything would have remained the same, but the current admin wanted to completely change the face of the USA in so many area's lawsuits were brought & and this is the result, let me say it once again, Nothing would have changed if there wasn't extreme overreach by the B iden camp! stew on that for a minute! i guess on one hand we can thank joe for something!! power to the people!!

Def . Enforce by EPA into trucks because it's EXCELLENT for the environment and Drivers will pay for it. it's GOOD SMELLS GREAT AND YOU CAN SLEEP WITH THAT EXCELLENT CHEMICAL NEXT to your SLEEPERS. Def of FOR THE GREATER GOOD... FMCSA ENFORCEMENT OF POLICYS from the EPA into the businesses of Diesel trucking industries Volvo Freightliner and so on. Enforcement. POLICY rules and for the GREATER GOOD OF what. Not DRIVERS Everyone else just makes feelings enforcement while drivers are Getting cancer, dieing in their sleep, Sleep apnea insomnia from WHAT THE EPA FDA DEP FMCSA OSHA and the rest of the ANTI CONSTITUTIONAL RIGHTS FED AGENCIES MAKE UP AS RULES . The executive branch should not be allowed to write regulations that are not approved by Congress prior to implementation. It’s unconstitutional.

Point taken. But letting the judicial branch effectively write the regulations is no better. Power moves into a vacuum, and in this case the inability of Congress to write clear and coherent laws opened the door to the executive and judicial branches adding their two cents.

The Supreme Court’s ruling is a positive but these agencies will do what the politicians and activist groups do in that they will shop around for the courts sympathetic towards their issues. They will get lower court rulings their way and there will be different outcomes in different jurisdictions conflicting and so there will be confusion until an appeals court or even the Supreme Court rules on a particular issue.

@@Tanker_Wanker They want to sell you a cpap machine. I was told not to worry I could make payments. How nice!! I showed up with a good medical card, was told it was gonna expire soon so I must see there chiropractor. Made me do a sleep study while I was staying in there prison style lodgings( plastic covered thin mattress). I got the strong impression they were disappointed I didn’t have sleep apnea.
