Clearly, the Supreme Court is the most powerful body in this country. They even made that statement during the 2013 election petition when some politicians became very silent at the Supreme Court when these politicians were cited/committed for contempt. In view of the very powerful nature of the SC, we must amend their appointment process. Allowing the President to appoint the members of the court/bench is a very dangerous path which requires serious review.

A poorly informed perspective might lead one to believe that the Supreme Court is the proper venue for this matter. According to the 1992 Constitution, this makes the Supreme Court an inappropriate venue for the case. The correct avenue for addressing this matter is the high court, since the Supreme Court has identified it as related to human rights. Furthermore, the initial filing is anticipatory, meaning the alleged incident has not yet occurred; therefore, no actual harm has been inflicted. Additionally, the Majority Leader does not represent the constituencies involved. Moreover, the Supreme Court's assertion that the affected Members of Parliament (MPs) were not heard is both egregious and misguided. Those MPs were not denied the opportunity to be seated, making this assertion nonsensical and an example of judicial malpractice.

Gyakye Quayson denounce his Canadian citizenship but the court held that his futuristic intent didn’t matter because at the point of his nomination and application at the electoral commission the said certificate wasn’t ready. The four MP’s tenure of office in parliament has not expired, why do they have to change their political identity with the electoral commission now but not wait until 2028 and file a fresh application to come to parliament under a new ticket? The Supreme Court Justices should understand that the parliament of Ghana is not a high school or university entrance process where someone can stay in his current institution with the hope that another institution would accepts his application at a later date so that he can jump ship immediately. If Quayson’s seat was declared vacant because his reasons and intentions were futuristic at the time he applied to become a member of parliament, why shouldn’t these four seats be declared vacant because their intentions are equally futuristic? We must be serious in this country.

Ayariga is clueless on the powers of the three branches of government, the legislature, the executive, and the judiciary. They’re all equal in power but play different roles. The judiciary, with the Supreme Court at the apex, is the only branch with powers to interpret the Constitution and Laws. The legislature body parliament, can apply the law but have no power to interpret the law or Constitution. The speaker has no powers to interpret the Constitution. It doesn’t matter whether there was precedent action by a former speaker, once the Supreme Court interprets a law or Constitution, it is final. Parliament can go back and modify the Constitution to address a dispute but they’ve no powers to interpret the current Constitution.

In the case of Sam versus AG, the supreme court stated that the high court jurisdiction for human right enforcement can be invoked only by the person involved Any citizen of Ghana can invoke the supreme court jurisdiction for interpretation and enforcement of human rights Also, Afenyo Markins as a citizen of Ghana can go to the supreme as per the case of Adjei Ampofo Vs AMA. With the issue of political question, the court have ruled severally that Ghana do not practice political question system. Any order, actions or omissions subject to the constitution is justifiable and can be reviewed by the supreme court. Stop deceiving the public.

This is very funny. Invariably, what the Supreme Court is now saying is that none of us must apply the constitution until they interpret it. It means that anytime you want to act in accordance with the constitution, you must first go to the Supreme Court and request for their interpretation before you act. Again, Ayariga, the rules of natural justice on the rules of the Audi alteram partem requires you to serve a notice of the charge on every individual who is deemed to have committed an act for which he is deemed to be punished for a defence of the charges. The person's cannot be deemed to be in the known even though he knows what he has done. He must officially be notified. Without that the rights of the MPs have been breached. The Speakers conduct is an affront to common sense and the dictates of the constitution. The right person to declare the vacancy of the MPs seats is not the Speaker but the High Court.

Article 131 refers to human right matters affecting imdividuals and where the human rights of a group of people like communities are being violated, the law is that any Ghanaian has locus to sue on that as in this case.
