Scenario My Wife left me and stayed back in her parents home and it's been 8 years she never resumed back for cohabitation. Reason The only reason she is staying back is she want me to setup a separate home and stay apart from my parents. I have tried my level to best possible to convince her in all possible ways getting gathering both side relatives. nothing worked out. Case I have filed a RCR case. It went to mediation and in mediation, she said, she will never come back to my home until unless separate home is setup. Mediators also tried to convince her and it didn't get settled. she is neither accepting to give mutual divorce. mediators have forwarded the case to court giving report as "Not settled in court" and let it for courts action My Questions 1) My assumption, If a decree is passed giving her an order to resume back to my home. a). what will be the time line for her to come back and cohabit? (I'm damn sure she will not resume for cohabit) b). what if she is non-compliant for courts order? 2) As its already 8 years, I no more have trust and patience on her as she has deserted me in well amount of time. a). Can I withdraw the case and file a divorce? if I withdraw the RCR case, does it going to become a problem for future divorce case filing?

Naveen kumar S there was a simple solution.you could have started living in a separate house, which was in close proximity to your parents house. but you didn't do. this negligence cost you 8 years and marriage.

Now after 1 year of 498a , she filled Section 9. So can I say that she filled 498a against me. So it is reasonable excuse from my side or not?

if she has filed a criminal case against you and your family without any legal cause it is a cruelty and you can produce those documents before the court of sec 9 and defend yourself further take advice from any advocate by shoving all the proceeding paper and tell him/her your facts and it is advisable that you should appear in sec 9 matter also
