This guy Anderson is all over the place, he jumps from one thing to another, is unaware of terminology and doesn't appear to understand his own questions at times? I'm on the fence with all of this but this guy is chaotic and the whole concept of an entire hospital being "out to get" this family is ridiculous.

Im believing Maya, shes the one who was traumatised. What child goes to hospital, taken off her parents because the mum is defensive and knows what her daughter needs but they think shes medically abusive, gets daughter taken off, stops mum seeing her, Maya gets neglected while in hospital, the workers are brutal with her.... I hope Maya wins, the defence can say whatever they want, but it doesnt change Mayas experience

Ok....but is JH responsible for that trauma? But for Dr Kirkpatrick's negligent decisions, Maya wouldn't have ended up in an ER between a rock & a hard place. It's sus that not a single Dr who Rxed her ketamine came to her rescue or reached out to the hospital to explain her treatment plan.

Physician here…..mother -daughter codependency does not necessarily mean medical abuse. Maya as a very intelligent child readily picked up medical language and learned to use it medical settings.

@@ldolan4051I don’t believe there is any evidence yet that mom was taking any drugs. Plaintiffs presented evidence to the contrary where police found old dated pill bottles still full in their investigation of the suicide.

@leah8445 Thank you, I agree 💯 finally someone else isn't blinded to what really was going on with Maya & her Mother. Had the Mother been able to take her to yet another hospital demanding a pain pump inserted into her spine she'd be dead but I doubt any hospital would do it. Even the Dr in Mexico refused to insert one prior bc of the danger. Her Mother definitely was sick & I don't know why her father didn't stand up to his wife when he'd seen Maya's progress without massive doses of ketamine. Her father admitted @ home he & Maya we're great all day no pain problems or wanting any meds until her Mom came home then Maya would start yelling again! Was she playing games with her Mom to make her look bad? All I know as a Mother & chronic pain sufferer is that hospital did everything right! I can't believe the father is suing when they saved Maya & he agreed with the hospitals findings. Take Care! Ontario, 🇨🇦 🐾

I don’t think she wanted a pain pump in her spine, it was a port on the anterior of her body (chest?) Mom was interested in fecal therapy insert in spine, from literature she read and heard about. I believe she was overwhelmed from months of having her daughter’s diagnosis of CRPS being dismissed. Indescribable pain is no picnic. And it appears the Ketamine therapy worked for Maya.

Maya was put through unnecessary trauma by not allowing Beata to be near her ailing child. Beata and Maya were put through so much pain and suffering because Dr. Smith was accusing Beata of false diagnosis based on the doctors own assumptions, and then pushed her narrative to the other staff.

@@ayamysticit’s VERY common that children and adults who deal with chronic pain will hide it until they are in a place or with a person that they feel safe enough to let their guards down. Maya felt SAFE with Beata and therefor would express and show pain when she was around. She had learned to hide her pain in order to try and live a semi normal life.

I had to go through a similar situation myself!!! After that Susan Smith Drowned her two little boys. My son's father tried told DHS that I wanted to kill my kids and kill myself!!! AND that was definitely not the truth... I SIMPLY TOLD HIM, " IT'S MEN LIKE YOU THAT MAKES WOMEN WANT TO DO SOMETHING LIKE THIS BUT I COULD ONLY THANK GOD I WAS STRONGER!!! They took my son that was going to be 5 years old the next day away from me for 49 days it took me to get back into my custody but I did... If you have ever had to lose a child to DHS, YOU REALLY WOULD UNDERSTAND!!! I FEEL FOR THIS FAMILY, I HOPE THEY GET EVERYTHING THEY'RE ASKING FOR!!! The dependency court made the decision regarding contact and visitation between Maya and her mother, not the hospital.

I think this proves the hospital staff (miss smith in particular )pushed her over the edge. Anyone with a special needs /ill child is extremely stressed as it is.

Yeah that's why she committed suicide two days after this judge said she couldn't hug her...ok it's the hospitals fault for following DCS rules and court orders

@@melissacoulter708 .. no, she could have left against medical advice. She just didn't want to with the diagnosis of Munchausen syndrome on their chart and contrary to the plaintiff's lawyer, you are not escorted out by security when you sign out AMA at any hospital unless you are a THREAT to staff

Totally agree! These doctors literally hated the mother for having any medical knowledge of her daughter's illness! For a mother, the worst thing in the world is to watch your child suffering!

My Mother went through a lot in her life, and she often said' "I am ready to be taken or want to dsy", I always interpret it as a times of desperation. Beata was raised in a different Culture, and so was My Mother, it is common to make those remarks, more so concerning when your Child is in a condition of in and out of Hospitals, that claim you are mental and not being understood as knowledgeable. Rather than accepting the fact that they were not allowed or had enough knowledge in Mayas condition.

The staff clearly overstepped their boundaries . Imagine creating false allegations for parents who take personal care in their child’s health. The mother was trying to detox her child from the drugs and find less addictive modalities. Imagine a hospital protocol that stops one and starts another. Parents should be able to make decisions for their own children. The mother was a nurse- she was licensed to care for others but punished for caring for her own child. A lot of narcissistic behavior involved in the care of this child. The mother was an expert in her child’s care not a bystander who gets a paycheck for following protocol. It is a dangerous mentality that no mom or dad should deal with much less the child that I’m itself is abuse of power and maltreatment.

I’m the mother that would have acted the same as Beata. And they would have had to handcuff me the day they were told to leave. Actually no… I would have taken my daughter out. I live in the same area that they do. We have many hospitals in the area that are terrible.

I'm sorry but committing suicide was not the answer ..the mother didn't think about what this would do to Maya or her family....She was smart she knew that this could not have gone forever and it didn't....she told Maya she would see her soon and unalived herself without saying anything. It was selfish and cruel ..Maya's major trauma and depression is more because of her mom's suicide than the hospital ....I know people will not like my comment but im sorry ,im a mother and i would never ever ever commit suicide because knowing it would be horrific thing for my family...care had her son too which just disgusts me even more...Maya would be happy now if her mother was here...her doing that' shows me a lot about her character...just my opinion

Anderson is RUDE AF & Disrespecful. He was diminishing towards the Critical Care Dr, by trying to Belittal the staff by his comment about “ So Who Was in charge of the LITTLE TEAM you put together”. She was calmer because she was also being sedated in addition to the weaning of Ketamine, and replaced with Narcotics, as has been mentioned. There are times when Narcotics can give side effects to say inappropriate things., I guess Maya was the one with the Pain.

The critical care dr seems credible and is the first good witness I’ve seen come from the defense. However the issue is that she confirms that beata was acting appropriately and that the family was on board with their plan. So what was the reason for all of this? Comes back to dr smith. And as much as the hospital wants to pretend she wasn’t employed by them, it is only a matter of time until the jury finds out that she was and still is.

⁠@@joannelson9571are we talking about Bonnie rice in terms of the nurse practitioner? I don’t recall her saying that, I recall her saying that something was wrong with maya and that others felt maya was making it up. I recall her saying that she didn’t think anything beata did was that much out of line with how a parent watching their child in pain would act. In fact her testimony differed from the doctor she worked for, in that way. She even said beata was compliant when asked to stay away for a few days. Even so, having the defense gproduce witnesses with differing testimonies that seem to contradict one another is not a positive thing for their case imo. The plaintiffs have produced witnesses that pretty much all corroborate their events and the character of beata and maya. Can’t really say the same for the defense at all. They produce the pink shirt short hair lady who says maya was never in pain, but we have dr Sanchez saying “she was clearly suffering” multiple times. I think most people can understand how or why they were questioning abuse here, but then the actions of sally smith and bedy is when the liability begins. As well as figuring out if they had any right to keep them there when they did.

@@LightningMcqu33f to be fair you can’t compare the pink shirt lady with the critical care ICU doctor. They observed her at completely different points in her medical journey. One of them saw her when she had just come in to the ED with acute severe abdominal pain probably constipation related from the outrageous cocktail of pain meds she was on at home. It’s a thing. The other one saw her when she was on a recovery floor participating in therapy etc. If you don’t work in a hospital you don’t understand how a patient can look 100% different a week apart. And this is exactly the problem with people with no medical knowledge trying to analyze this case. That being said, I don’t think pink shirt lady was a good witness because she looked like she had an agenda. She tried too hard if you will and came across biased, Whereas the nurse practitioner from the rehab center, as well as the critical care docs, were extremely professional and were able to more objectively lay out what they saw in a very credible way.

@@joannelson9571 this family has been through so much all these years,when you are mistreated with the hell that they put Maya through their has to be compensation . With the loss of her mom ,her entire family went through so much trauma with Mayas health . The Hospital didn’t comply with their policies,the Social workers were way out of line and should be fired. For them to ask for what they did , they deserve every penny so they can still pay for treatments that Maya may need in the future, for the family to try and have a normal life. Just my opinion 😳😳😳

Therefore, it was only The employees in The Hospital that decided Maya"s fate, which ended by removing The Mother from the picture. Ignoring all treatments that the Parents and Doctor's outside the Hospital, had already been successful towards Maya's diagnosis and treatments.

​@@leonama6876It's infuriating when an entity like big pharma, big oil, big tobacco or HOSPITALS have endless $$$ to hire evil ass lawyers. They should have just settled. They tried. But for a PITIFUL amount. That tells me they KNOW they have responsibility in Beata's demise. Responsibility in the drawing out unnecessarily of Maya's pain and inhibiting her treatment. Isolating her from her mother. Her mother had experience with her daughters condition, had lengthy experience as a nurse in hospital treatments and procedures. The hospital took offense to that. DR Sally Smith (has a record of child abuse) took offense to that. They all suck. They all are grossly unqualified.

I am in a minority here, but I feel that the law suit is frivolous and unjustified. During my childhood, between the ages of 2 and 14, I spend many months in hospitals for anything from major surgeries to meningitis, to a kidney failure. And, guess what! Hospitals are uncomfortable, many procedures are painful and scary (especially for a child). And of course my parents were terribly worried about me and as much as they could tried to help doctors to help me. Beata on the other hand was aggravating the doctors who treated Maya. On the whole, her behavior was actually selfish and arrogant: she behaved like she knew everything better than multiple doctors (except those doctors who profited from the Ketamine treatment!). Beata's agitation was clearly agitating Maya, which surely only worsened her pain. In addition, Maya received so many heavy drugs in the short period after the onset of her pain, that it is small wonder that her body got "out of whack" with all those opioids, sedatives and dissociative anesthetics. It is not fair to blame the hospital for the tragic circumstances of Maya's pain, and even less fair to blame them for the mental problems of Beata.

A lot of people with zero medical knowledge have watched a Netflix documentary and suddenly think they’re experts. It would have been criminal of the hospital NOT to question what this family was doing. I have immense empathy for Maya losing her mother but I also wonder i f Maya would still be alive today if they continued on the path they were on.

I think a lot of people have dealt with people in the medical field who judge the second someone mentions pain meds. Doctors have a habit of not listening to parents and / or patients. They have one way of doing things, and that's it.

Exactly! To deliberately exaggerate the point, imagine someone's child is kidnapped by hostage-takers (allowing in this analogy that the doctors were AS BAD AS hostage takers!). Would the mother of that child aggressively yell at those hostage takers, insult them, demean them and make them angry in all other ways? Or would a normal mother try to placate them and appease them just to keep her child as safe as possible while she is being held captive? The answer is obvious: appease them and placate them for the sake of your child. But Beata did exactly the opposite. But of course those doctors were NOT hostage-takers, and they did not deserve being treated like crap while they tried to help her child. Beata obsessively needed Maya, but obsessive neediness is not love...

Maya’s attorney comes off like such an asshole badgering this critical care doctor. Anyone who has any medical knowledge or has ever worked in a hospital can see she’s answering what he asked, and then he snarks at her “anything else you’d like to add?!” as if she’s somehow not being cooperative. He’s completely misrepresenting things and out of his league, obviously having no medical knowledge. He’s trying to insinuate they wanted Maya off all pain meds and placed on anti-psychotics just because they had a prn order for haldol in the ICU. That’s absurd. Haldol is used all the time in ICUs to make patients comfortable. This is hard to watch.

A pet peeve of mine is when people under oath answer questions with "To be honest..." or "To be completely honest...". All of their testimony is to be the complete truth and this phrasing bugs me. It also bugs me when job interviewees do this. All of their answers should have been honest. I know that this is simply a turn of phrase. Still bugs me.

Patients are more than their disease. Hospital, Doctors, Nurses, staff must treat a person with dignity, treat the patient’s whole body, not just their symptoms. And if the parent rubs you the wrong way, is anxious and demands care for her child, maybe step back, take a deep breath, and listen. Illness affects the entire family when a child is chronically ill. Compassion should be a requirement at a Children’s Hospital, not jumping to conclusions and threats. There is always something to learn. Continuing education for disease management and patient services should be on-going.

I can say from experience, Nurses do not always put EVERYTHING in their notes. Especially something that could be seen as inappropriate, or that could get them in trouble! (possibly).... so having these nuses and doctors " Notes" would have very little weight with me, if there is evidence to prove otherwise! I also think it is a shame that hospital doctors do not think it appropriate to talk with the patients primary care physician, especially in a case where the parent is telling of a dignosis, and how normal treatment is adminitered! You would think they would CHECK with the doctor that gives normal care to the patient! My granfather was on 21 medications because none of his doctors were speaking or checking records to see if there were counteracting meds he was already on! He was in poor health BECAUSE of counteracting medications! once I brought this to their attention he was cut back to only 7 meds, and he lost 23 lbs of fluid in two days, and felt better than he had in years! Lastly... The truth of why hospitals will not tell you that you "can leave" the hospital against medical advice, is because it gives insurance companies a way to get out of PAYING the hospital! It is more about money!

Did you not hear the ER doc testify that she called Mayas Dr and only got through to a nurse at the office who simply read back the dosages of ketamine they were giving? It is not standard practice for physicians to get educated by families on “what is normal treatment.” If physicians prescribed every drug a family member told them to prescribe we’d have a huge problem on our hands. Also I agree with you about the problem of physicians not communicating resulting in polypharmacy (patients on way too many drugs) but the irony of your example is that in this case the doctors were the ones trying to get Maya weaned off this ridiculous cocktail of drugs. She was probably having health problems like severe constipation and abdominal pain BECAUSE of all the ridiculous meds she was on. Maya was your grandfather but her parents were the ones pushing all the drugs, not the hospital docs!

@@letusgather...7820 I don’t know if she was given SSRI’s, but if she was it apparently worked because today she’s not only walking and eating and doing her own self cares but she’s participating in school, playing sports, doing magazine cover shoots, etc. Nothing like the malnourished child who couldn’t even use her limbs at age 9. I continue to be deeply sorry for her loss, and I also believe she is medically in a much better place today. The proof is right in front of everyone, but for some reason you’re all ignoring it. I do hope the system changes in the future where children who are taken into custody have more safeguards put in place to protect them.

@@embeth446 I agree she is in a much better place now...but also when she was released from the hospital, she was WORSE off than when she arrived, according to testimony of the people closest to her. I got the impression that she has gotten off nearly all of her meds...but her regained health (such that it is with her continuing CRPS) on her own...nothing to do with medicine or doctors (of which she is terrified of). Regardless...the hospital is not innocent. She was obviously abused. Isolating an individual from friends and family is a hallmark form of abuse and that's what JHACH did or condoned.

Beata and maya were mentally unwell and jack failed them both for not getting beata good quality psychiatric treatment instead of wasting their money on 4 family lawyers whilst maya was in hospital - he thought she took his gun for gods sake and called the cops. He knew she was on the edge and did nothing. JH are not responsible for her death, beata made that choice for herself.

Caring staff? Real life is not a fairy tale. Many had preconceived notions, passed along from one staff member to another, before they even met Maya. Some Dr.s and Nurses avoided her, treated only her symptoms, but they sure liked gossiping about “ketamine girl” and her family. I am finding it real hard to believe that Beata told this doctor she was suicidal. Firstly, all the witnesses so far that did not work for JH, they all said she was a very intelligent woman, very organised and together, at no time up until this point had she ever said she was suicidal to anyone, so why would she tell a random doctor, who she had just met, and was treating her child? That makes no sense to me. It also makes no sense to me that this doctor did not tell Sally Smith that Beata told her she was suicidal, when the hospital was looking for all the dirt they could find on Beata so as to maintain custody of Maya, like you would think that would of been real important info considering they were trying to paint Beata as unstable. I also think it odd that this supposed conversation is only coming to light now, when the family are suing JH's for Beata's wrongful death, and driving her to her death, obviously it is in JH's best interest to suggest that Beata was suicidal on day one of her encounter with them, and I just dont think its true, and there was something real weird about how this doctor delivered this information, she almost looked smug, like she was holding back on smiling, and she turned to the jury as she was saying it, and she really looked like she was trying to gauge their reaction, to see if they believed her. I'm not buying it.

So here is just a sad artifact for the plaintiffs... if the hospital wants to argue that this wasn't "forseeable harm" -- now we have two doctors with supposed information about Beata's mental state -- one who said that she is fine because "she has her family" and another who says it was predictable because "she's seen it happen before". And yet they want to claim that these doctors initiating this process against the family and prolonging it even long after they knew full well they had enough medical info to rule out factitious (munchausen by proxy in particular) STILL fought with their attorneys to keep the family separated. DCF may have stepped in. A judge may have eventually initiated an order. But the hospital started it and continued it knowing the risks and even after they had plenty of exculpatory evidence that Beata was not causing Maya's condition at all. I know that legally that this is all murky and that there may not be much the plaintiffs can do -- but the behavior of this hospital team and their derogatory and abusive treatment of this child and this family -- and even just how horrible they were to Maya about keeping her in isolation as if she were in the shoe essentially, not even allowed to have visitors that had nothing to do with the accusations regularly. I have been in the hospital once for almost a month, and I had free acess to visitors, and it was still incredibly isolating and lonely when I couldn't have access to family or friends. Visitors were the one bright spot. I WAS AN ADULT and I also had total free access to the TV and internet. I cannot imagine the extreme torture of isolation of a child this young being so limited access to anyone and everyone. This is horrifying. Even if there were some orders against the mother, it is awful that she had such limited access to her father, brother, priest, other supports from her church, or even just kids on the unit. And I gotta say -- that judge's order better say that Maya has to be isolated from everyone for some good reason AND that she can't talk to any kids on the unit AND can't have access to religious supports AND that for all calls she can only speak to her mom so infrequently and that it needs THREE people monitoring the calls -- the GaL, DCF, and the hospital all monitoring at once. Because if the order doesn't say that I think the hospital is going to have a difficult time explaining why she couldn't get access or visits on holidays, birthday, why she couldn't speak to anyone hardly at all. None of it makes sense. Whether we're dealing with abuse or suspected mental health, there is NO PRACTICE that is ethical that involves keeping a child this isolated for such an extreme length of time. The coercion is disgusting. Abuse happened here -- but not the family. They're just trying to get off on technicalities and that is so disgusting.

I agree....and I THINK (can't say for sure) that the shelter order leaves the treatment and day-to-day care up to the discretion of the hospital. If that's true....we're done here and Kowalskis can go home like David and his slingshot.

The whole problem with this whole trial that I see all the facts are not comng in because of defense an this judge. I will keep saying it i would love to be a fly on the wall when these jurors go back an watch these videos an they see an hear how all this went and what all was kept out that we even know about about. I would hate to guess how much has been kept hush hush before this trial started.

The reason she didn't want the stickers placed on her while her Mother massaged her back is bc the monitor would show her blood pressure was most likely normal or low bc of the narcotics given @ home. That would definitely set off red 🚩 after demanding a ketamin IV along with all the other potent drugs makes absolute no sense. The C. T. Scan doesn't touch you're body. It's amazing what she wanted them to know yet wouldn't allow any other help. She wouldn't get away with that the first time here! I still don't understand why the father still isn't speaking up or standing up to his wife! I think Maya & her Mother both suffer the same mental illness. It's amazing they got away with this hospital shopping! 😮

Wow as soon as Maya's Mother realized her daughter was successfully whined off one of those drugs without any problems & she was still given strong pain meds that Maya was fine on. Her Mother wanted her transferred to yet another hospital for ketamin pump in her spine is insane!. If that doesn't scream out this Mother has severe issues then you've been brainwashed or have no idea how chronic pain should be treated. She was given such potent drugs that you'd never get here & the Red 🚩 we're burning bright. I don't know why her father was scared of confronting his wife? Chronic pain patients wouldn't be as lucky to get one of her great pain medications. She's lucky she's still alive but had this not been stopped she wouldn't be here. 😢

Maya is still taking pain meds, she still has CRPS. She has good moments and bad moments. They tried saying it was all in her head, but she still left hospital with a CRPS diagnosis. The hospital Drs. admitted to weaning her off some meds, only to provide others that fit their protocols. They also gave Maya Ketamine therapy. A person who has had chronic pain knows there is no one way to manage it. We are all individuals, and what works for one person may not work for another. I hope you never have to deal with chronic pain.

@@dianealarcon8304 Hi, thanks for clarifying the pain pump bc I could swear even the Dr in Mexico refused to insert a certain pump would be near her spine! It's a little hard to follow @ times bc there's testimonies & depositions from numerous doctors given over the years as this case has been going on for years until now. I do suffer from severe chronic pain & bc of the drug epidemic that was worse in the 🇺🇸 than here they over reacted & it went downhill from their. Pain patients here we're switched to less effective medications & it can't exceed so many mgs. I was on 1 long acting pain medication taken 4 times a day for 10 years that gave me back my life. I was 125 pds 5-6"fit & the last 6 years has become unbearable. I now weigh 90 pds. Trust me I know what it's like to suffer. I'm glad Maya is doing better now & has a boyfriend!❤️ I worked for years in a hospital & have had multiple surgeries & other conditions. I've dealt with God like Dr.s that think they know what their talking about. Unfortunately doctors aren't taught much about pharmaceuticals or much regarding pain in Medical school! Thanks again, Ontario, 🇨🇦
