Talaq (Divorce), Iddah (Waiting Period) and Khula (Woman's Right to Divorce) - Ahmad Sakr

For those who are not clear, I just recently went though a Islamic divorce so this is how it goes: the first time a husband says talaaq or you're divorce (even if he says it 3 times in a row), and even if he didn't mean it counts as the first time, they can get back together with in the 3 month idda period, the second second he says it again (talaq or I divorce you), again they can get back together in 3 month idda period, if any of the first 2 times they don't get back together with in iddah period, they are divorced and have to redo the nikah and marriage ceremony all over again. If the 3rd time he says talaaq or wee divorced even In a joking way they are officially Islamically divorced and can not get back together until the wife marries someone else and if that marriage doesn't work out, she can remarry the first husband if she wants. The second marriage has to be a real marriage she can't just use someone to marry and divorce him soon after just to get back together with the first husband.

Rubbish. three are THREE. If he says it three times, he went against Allahs command and took a shortcut and did not leave a chance for reconciliation. The woman will still observe her iddah for obvious reasons but she CANNOT reconcile with him. In islam divorce is a loss to the man NOT the woman.

the wife or husband should solve the problem with mutual understanding other wise they must take divorce rather than fighting for the whole life if divorce is not a good thing than fighting for the whole life time and making the child spoils as well is also not a good thing bcz fight in home all the time also makes the homely environment as bad thus we can make it good if we create peace and peace is created by listening to each other and forgiving but still al the time we cant forgive each other and thats why instead of fighting for the whole life time we can give divorce to each other bcz one single divorce is more better than for the whole life time problems

Also a court divorce in whatever country you live in also does not count as a Islamic divorce, you still have to get a Islamic divorce separately from court.

divorce and khula are not considered as good in islam but still we have the right of khula and divorce in islam thats why we should not considered that too much bad that the people may stop getting it its true that we must do adjust our selves with each other but still we should not make fun of those or do back bitting against those who are divorced bcz no matter how much bad bad is this khula and divorce still we have the right of taking khula

My husband told me “i gave you talaq” 3 times … when he called me .. we were having a bad situation. But i just want to know if I need the divorce papers !!! I just embraced Islam 6 years ago . And I want him to be free and happy even if his happiness is not with me … so the question is …. Do I need my divorce papers ? Because i put my sign when I married him .

The divorce is three. Papers could be needed if later on you need to go to court for a legal formality but i doubt you would end up in court.

Not correct, Even after giving 3 divorce the man says that he did not mean even one divorce. Even after giving continues divorce regularly he says that he did not mean it. This does not mean that they can live go gather. There are clear hadith which says that after 3 divorce the relationship is broken for ever . This is not to be played. It is serious.

Sasa Khan for the women in her iddah, according to the shari'a, she is supposed to spend her iddah in her husband's house with the hope they can reconcile. after the 3rd talaq, the couple is not allowed to remarry each other unless the woman remarries another man and divorces him then she can go back to her previous husband. however, she is not allowed to marry another man and divorce him with the intention of remarrying her previous husband. I am not clear about what is the iddah period for Fasah procedure and how to be in iddah period... Someone please clarify.

I am pregnant and all of the sudden my husband is saying saying our nikkah is not valid. He first said talaq to my mom in 2020 and I was pregnant so he returned and reconciled within 2 months. Then after my miscarriage in 2021 he said he’s giving talaq to my father. One year later he resolved his issues and we remarried in 2022 , 10 months later he returned saying some molvi told him since he tried to state talaq during first idah and that counts as more talaq, but that is not true in my opinion. If he said talaq once in 2020 thats one, then the reconciliation was valid. Then in 2021 if he gave talaq once more that is a second talaq. So he has not given a third talaq

I believe there is a discrepancy in the way Wahabi Shafi vs Berveli and Deobandi Hanfi people count divorces. It is illogical to give someone more talaqs while someone is already on iddah but the Hanifi sectors even count that … It doesn’t make sense that when someone has already declared it and without reconcile they think 2 mins later they can say it again or a few weeks later they can say it again and it’s a new talaq.

@@karinarazakhan1039 it IS logical. Too many people don’t understand their own religion. Talaq is a word that carries weight. While the woman is in the iddah she is within the nikah. And a man can only divorce *his wife* So if he said it again within the iddah it is another divorce. However, if he said it by way of reminding the woman that he has given a talaq already, merely repeating it for that reason alone that is not a talaq. This question was put to mufti tariq masood and he said its not a talaq if its a reminder. If a man divorces his wife three times in one go, she *still* has to observe iddah despite the fact that they cannot reconcile. So she cannot reconcile but she is not free from her nikah to marry another man either.
