What bothers me about the Craig and Bentley case was that Bentley had already been arrested, therefore was out of the equation, the fatal shooting happened after the burglary had been discovered and acted upon, a separate incident, subsequent to the first. Thanks Steve your presentation is first class😊

I love the music at the beginning of the intro. It is both ominous yet hauntingly beautiful. It tells quite rightly the theme of what is to come. The law was not very merciful in 1913 to people with possible disabilities who committed crimes of a grave nature.

May I suggest a program on Persulious Crosby, the 1950 murderer of Ruth Massey in Leeds, we are enjoying your programs, but would suggest you add to it the execution of WW2 Nazi Holocaust killers, both men and women arrested from 1945 onwards.

@@thehangmansrecord2860 I will try and get you a photo, I had two Crosby cousins, two brothers long dead, whose offspring? may have photos. An idea for you: People who should have been hanged but weren't. I can easily find twenty five who would have been improved by being dropped. And what about photos-SERIES of the old execution chambers in the UK? The worst law ever passed was the 1964, to abolish hanging bill.

The picture at 5.50 is of the Goose Fair in Nottingham before 1924, when the old Council House (behind the fairground attractions) was demolished, and the new one completed in 1926.

13:58 Steve says, "back in 1889 two youths were hanged at Maidstone.." The two Coombes brothers Robert aged 12 yrs & Nathaniel aged 13 yrs were charged with their mother's murder, neither was hanged. Robert was found guilty and sentenced to an indefinite period in Broadmoor Hospital for the Criminally Insane, he was released in 1912 at age 30 after serving 17 years, he died at Coffs Harbour Hospital in NSW Australia on 7 May 1949 aged 67 yrs. Nathaniel Coombes who was found not guilty died in Newcastle, New South Wales in 1946 at age 69 yrs, he had enlisted in the Australian Imperial Force early in the First World War, and won the Military Medal in October 1916 for conspicuous bravery as a stretcher-bearer during the Gallipoli Campaign. and yes no; after 1957 the felony murder rule was abolished and the act stated that both parties must have murderous intent to both be guilty of murder , however the Accessories and Abettors Act 1861 still stands which states viz; 8Abettors in misdemeanors. Whosoever shall aid, abet, counsel, or procure the commission of [F1any indictable offence] , whether the same be [F1an offence] at common law or by virtue of any Act passed or to be passed, shall be liable to be tried, indicted, and punished as a principal offender.

In cases such as this people often said that the sentence should be for the Judge to decide rather than there be a sentence fixed by law making the death penalty obligatory. This sounds ideal on the face of it but when you consider how inconsistent judgements might become with each Judge having differing opinions, prejudices and subjected to pressures it surely would not lead to justice. One person would be hanged where another convicted of an identical crime might be sentenced to life. It took Parliament a long time to find the solution which was to end capital punishment.

actually after 1957 two degrees of murder were enacted; capital and non capital murder ! unfortunately, the felony murder rule was abolished in 1957 except if both felons could be shown to have murderous intent .

Steve , have a look into the Abdy farm murders 1912 . Walter Sykes was hung for them but locals thought the father was the murderer and that Sykes was innocent .

Yes I mention that in the conclusion. I think the biggest difference between the two cases is that in this case both carried out the brutal attack whereas in the Bentley case it was Craig alone who fired the shot and Bentley was simply convicted thru joint enterprise and allegedly encouraging Craig to shoot. Look out for a forthcoming episode on Appleby and Ostler 1940 that has far more similarities to Craig and Bentley than this one
