It is a job of Atty Topacio as a lawyer to defend his client against human rights, rights to remain silent, rights to be considered innocent until proven guilty, etc. etc. What I can see during senate and lower house hearing is that, these lawmakers are acting like prosecutors, judges and even accused the resource person guilty before the media. The process is beyond the ambit of their function as lawmakers and if they cannot get an aswer, they became crazy.

@@derickperalta1493 EXACTLY! She is also legally represented. The senate appears to have been behaving beyond their role. Regardless of what Ms Ong had done, she or anybody has the right to remain silent until proven guilty. The way the senate hearing is being conducted is so inappropriate to call her "names" and each answer she or others make, the senate judge them with "contempt" even if advised by her counsel. This case should only be dealt with in the court - lawyer to lawyer and her vulnerability and those being investigated online by the senate shows how this is being dealt with openly in public. Ms Ong and the rest of those accused have the right to exercise their rights. Anything they say can incriminate her or them. I understand how the court system works in western countries when representation, jurisdictions and rights are concerned. The senate are not Judges. Wouldn't it be better to investigate this behind closed doors rather than use so much funds to air it publicly with dozens of senators/reps and resource persons involved. This is a waste of time and abuse of power. The court has the only power to deliver its judgement upon its merit, evidence and facts, not based on "hearsay". I find it humiliating how this panel is going. How I wish the senate would hear how Filipinos overseas are disappointed by this hearing. Why not deal this case in the court and done with it!

@@Miaww-woof Well said. In fairness to those who say "the person is obviously guilty" is not fair as only the judge can say that after the case has been heard by both parties. The senate hearing is acting beyond their duty (especially those non-lawyers who are trying to accuse the resource person by offering some evidence to put him or her guilty (outright) and worst when senate personality (raising their voice) will use their position to threat the resource person in contempt and without allowing the defendant lawyer to intervene).... Better send this type of cases to the judge/s and give a person a day's in court....

first of all, it is the court that decides on the merits of the case not the defense lawyer. second, whenever the accused gets acquitted, it is always presumed that the prosecution fails to prove the guilt of the accused beyond reasonable doubt. third, even when we assume that the defense lawyer takes part on unethical acts like cover up or evidence tampering, the prosecutor must be able to prove it unless there must be a presumption of regularity.
