I My obsrvation to this point was once a vet got the TDIU , he already reached the peak of the disability ladder and any desire to claim additionael disability will appear that the veteran want more benefits above the maximum of 100 % disability benefits, even he’s qualified to that benefit I was qualified for SMC but when. I told that the lawyers assistant that I had TDIU granted, She seemed to lose interest in my case when she learned of my TDIU. I was told. I will be referred to one of their partners who never get back to me. It’s no going to be easy to add additional or supplemental benefits after TDIU. They’re looking for higher rating claims to have bigger or higher share of the veteran’s’ benefits.

I've only worked in the healthcare field my entire adult life. The SSDI took 15 minutes to award my disability. I was told 100% unemployable. The exact same thing that the MS department of rehab stated after i attended approximately 2 to 3 weeks. I tried everything, i kept getting fired. I never quit until the last job. It was getting just too humiliating. i am home almost always. I don't eat out, go to movies, nothing fun.... ever. I only shop for groceries. This is reflected by the extremely low mileage on my car.

I totally agree not to spend money on a vocational assessment while filing your claim. Instead, include a detailed, personal statement why you can’t work. In a matter of several months my TDIU was granted.

I was TDIU before I was scheduler. If you are not presently working due to your service connected disabilities, there is no need to wait to file for unemployability.

@@HardDeck Work is work. Self employed or not. If you are not able to accomplish your work due to service connected issues to where your income is above marginal employment, then you qualify for TDIU.

@@HardDeck There's an exception in 38 C.F.R. 4.16(a) that allows veterans who are in a "protected work environment" to still receive TDIU regardless of how much they earn. I regularly argue that self-employment is a form of a protected work environment, so you should consider applying.

@@Greg4VetsI'm in that exact situation and still worry about the VA putting eyes on my ratings and ultimately removing me from TDIU which I've been on for almost 10yrs even though their records state that it started in 2016 which I know is incorrect because I've been receiving TDIU payments longer than that according to my payment records. So my question is, do you know of anything that mentions what you're referring to as far as working for yourself being a protected work environment? Thank you!

Surfing 🏄♂️ on YT found your channel. Mr . Newcombe. Last month Dec 2023 I submitted a supplemental claim for tdiu (mdd) . Initially filed tdiu Nov. 2022 claim deferred then denied June 2023. The VA has now sent a letter stating no further action will be taken on my supplemental claim until I file the form 21-526EZ . Why must I do this??? This isn't a new claim , I disagree with the denial of tdiu. I am considering not finishing. I sibmitted my new and revelant evidence . Thank God I am rated 90%. As of Nov 2023 my 2nd claim submission for ssdi was approved a tremendous blessing..

@@JamesB02 It all depends on why you were denied. A 526 is required, so if you did not file a 526 with your initial TDIU application, then the VA needs it before they can process your claim. If you did file a 526 claiming TDIU, then the VA is obviously wrong; in this case, the easiest way to solve this situation is to send VA a copy of the 526 you already filed. It seems that when a veteran has TDIU already awarded and would like to file another claim, many of the lawyers that used to help veterans have lost their eagerness to represent the veterans on their claim or appeals. I guess when TDIU was already met, any succeeding claim becomes less attractive due to less monitary consideration from the fees obtained.

Typically, once a veteran is getting paid at the 100% rate there is no money to be made; thus, lawyers don’t have an interest in these types of cases. Which is only fair, after all who wants to work for free. Besides me that is. There are some pro bono attorneys out there for low-income individuals.

To me, it would seem as if depending upon your reasoning for the TDIU, you would need to be careful about working at another job because they might be able to think of a way in which you could go back to work. In other words they can find a pathway for you to do a job after your educate yourself and then taking you off of TDIU. I don't have the experience so I'm not talking from experience I am speaking from trying to think how they think. And if it would save them money, what wouldn't they do it. Why wouldn't they start thinking of future plans by looking at your occupation for those who are sustaining employment past one year. Just saying

I have a 40% but 90% combined. 2018I was on DBL from work for mastectomy which my SCD were aggravating my recovery. I was able to RTW w/restictions- but unable to do MY (trained & educated for) job with those restrictions. My position was terminated and no job description in the hospital i worked for that could accommodate said restrictions, even sedentary positions . 2019 filed for SSD, which saw/used my 90% SCD rating in making decision and was approved for ASAP. I was unaware of tdiu until it was mentioned by a VSO when i had questions about the PACT Act. He asked why wasnt getting it, i said it was because i never heard of it. FF to 2023 filed claim for tdiu, denied twice but states all my SCD as "favorable findings in decision". Ive called and emailed VA claims officer to find out what i am missing or not understanding as to why im denied- no response from them.

TDIU is awarded when service-connected conditions result in an inability to find or maintain gainful employment. In your case, and in all cases, you must show how your service-connected conditions cause the unemployability. I suspect your claim was framed around the mastectomy which would be the wrong way to present the case, unless the underlaying condition that necessitated the mastectomy is service-connected. All TDIU cases must focus completely on how service-connected disabilities are related to the unemployability: the whys are not important; thus, the mastectomy is irrelevant to your case. Work with your VSO to present an argument entirely grounded in your service-connected conditions. If that fails, contact a lawyer specializing in representing veterans.

Thanx for the info. I'm becoming Homeless again because Billing doesn't have a readable DD214. The regional office has the same difficulties. Billing is taking a portion of my SOCIAL SECURITY and all of my disability to pay for meds received due to Camp Lejeune's water poisoning.

You likely have already heard this, but if you haven’t sent for a copy of your DD214 from the national archives do so asap (www.archives.gov/veterans/military-service-records). You do not need a copy of your 214 to file for disability benefits as, with your permission, the VA will send for your records from the archives. These issues are presumptive conditions linked to Camp Lejeune: Adult leukemia, Aplastic anemia and other myelodysplastic syndromes, bladder cancer, kidney cancer, liver cancer, multiple myeloma, non-Hodgkin’s lymphoma, and Parkinson’s disease. Contact a veteran service representative for claim assistance. Contact a VHA social worker or patient advocate for health benefits and housing assistance.

12:45 I am at 30% for asthma . My primary care doctor wrote a letter to my Postmaster about my limitations,what I should be doing. Because of the letter I was forced into disability retirement. I knew nothing of the unemployability at that time. But I have been trying to get an increase for my asthma for a few years now. I keep getting denied. This was in 2007 in June or July. I have not worked since then. My asthma is service connected. Because of coal dust while I was stationed in Turkey. The problem is I do not have enough percentage in order to file for unemployability. What should I do? I retired on disability from the postal service.

Asthma is rated per code 6602. The 60% rating requires: FEV-1 of 40- to 55-percent predicted, or; FEV-1/FVC of 40 to 55 percent, or; at least monthly visits to a physician for required care of exacerbations, or; intermittent (at least three per year) courses of systemic (oral or parenteral) corticosteroids. Either you meet that requirement or you don’t, so don’t bother filing for an increase until you meet the requirement. If you are having exacerbations do not self-treat, get it documented per the 60% requirement “at least monthly visits to a physician for required care of exacerbations.” As for the TDIU, as explained in the video, you can still be approved with any rated condition that makes you unemployable even if it is only rated at 30% as is your case. It all starts with a good statement. There is a TDIU statement example at my website vamadness.com.

New to your site-says this 53yo Vet. This Corpsman 13 years ago got persuaded to rush to TDIU since my TBI then Brain Surgery/Epilepsy from 30 years ago. We all got our stories but what I am getting at is this. The 100% plus SSDI(average $1,200) and legal work to no more than $1,000 per month. Well,… $3,600(tax-free)+ $1,200 + $1,000(non-tax)= $5,800. Or gamble to drop TDIU for ratings and jezus be allowed to make more than SSDI allows! $2,200 I was not informed 11 years ago. 😩 Corpsman Up!

I had lung cancer at age 42 in 1988. I served in the USAF for 4 years including American Occupied Okinawa, Japan. I lived in old barracks in Texas, Okinawa and Florida for 4 years all with asbestos including lead and asbestos in paint. I was honorably discharged in 1971 and in 1988 was diagnosed with lung cancer and the pulmonologist at the time said the best way to go is to have a total R Lung Pneumonectomy and I did that. I did not file a claim with VA back then due to ignorance and I was young with a good job after recovery. I just had my bladder and prostate removed in May 2023 and I am now filing for the cancers and residuals. I am doing it myself. I filed an intent on Sept 3 and am almost ready to submit. I did a lot of research and decided not to hire VSO or a coach, etc. I am hoping to get TDIU as with an Ostomy and severe COPD now I cant work. I will get help if I lose.

You won't lose - got 90% by myself [ asbestos , toxins , COPD, OSA , pulmonary fibrosis ... ] , hiring law firm for TDIU . Dealing with VBA bureaucracy caused burn out . Not religious but God bless you .

1) What is the difference between "Extra Schedular" TDIU vs. TDIU T&P? 2) I currently am on Social Security Disability and rated by the VA at 90% Disabled. If I apply for TDIU and get approved, is there any chance that my Social Security payment will be reduced or offset since I would get more money from the VA? As explained in the video, extra-scheduler TDIU just means TDIU considered as not meeting the minimum rating requirements. In your case, you likely meet the requirements as noted in the video. I also have an older TDIU video which you may be interested in watching. SSDI and VA disability are not related and both can be awarded at the full rates with no type of offsets. I know this is an older post but a quick question to the community. I am currently 80% (50% anxiety, 40% lower back and a few other smaller ratings) I applied for TDIU about 4 months ago. I have not yet recieved any notification of C&P exams. i've called VA and they confirmed there are none pending. Could that be because I already meet the criteria for TDIU and the VA doesn't need repeat C&Ps or.... Initial review found problems with my claim and are able to deny it without C&Ps. Most of my prior ratings and C&P exams have been within the past year and a half... maybe since they were fairly recent, they can just go off those previous exams? Anyway, my claim is currently in "Preparation for Decision" and i'm starting to feel like it's a denial! Any advice on this or what I did wrong?

As noted in the video, a TDIU case is considered a request for an increase for the issues listed on your application. An increase would require a new exam. Keep in mind, VA is an incompetent organization, so any dumbass thing is possible. Not knowing how you prepared your claim, there is no way to know if you did it well or not. Hopefully you submitted a detailed statement noting your normal occupational duties and an explanation why you can no longer perform those duties. You could ask for a hearing as explained in my RO hearing video; however, that would delay your claim. At this point, it’s likely best to wait for the decision. As noted in the video, I do not recommend getting a vocational assessment up front. Typically, a well written statement is the best evidence for a TDIU claim. Follow my example TDIU statement. Do you look over decision letters and provide ypur insight? I recently got denied for mental health but I didnt go to C and P because I submitted a nexus and DBQ. I have been denied previously so thats the reasoning for not going to another C and P.

Hi I was in service in 70s I am rated at 50%migraines service connected and now I'm going for TDIU with depression and anxiety cause of migraines and back in 88 after my divorce my twinn started a paint company cause of migraines and he died in 2015 and been out of work since I'm 67 now so do I have a chance to get TDIU? I was denied few time because I was disabled from Railroad and they couldn't find anything in the social security system and they kept denying me until I told social security to give me a letter explaining why I am not in the system

I'm not sure if you could answer this or not but I'm currently in the remand process for extraschedular TDIU. I was medically discharged from service for several low back conditions in 2013 and haven't been gainfully employed since. It is even recognized on my latest decision letter from the BVA (that remanded the TDIU) that I haven't had any gainful employment since active duty in 2013. However, I did not file my actual TDIU claim until 2016 because that's when I was finally told about it from a VSO. My question is: If I do finally get awarded TDIU down the line, is it possible for my effective date to go back to 2013 when I was originally medically separated for the same low back conditions that don't allow me to work?

Until you actually file a claim (any claim), there is no possibility of backdating. If you filed claims in 2013 or after, if any of those claims note evidence of problems finding or maintaining employment due to your service-related disabilities, then it would be possible to get backdated to that time period. How does the VA in General view and consider a Disabled Veteran for Refusing to Settle and Sit ar home. Rather, fought your Way through going back to Get a Master's Degree, and denied the Pain and Discomfort to put in a 20 year Chemist Career until it wasn't possible to continue. Ended before 50 with Chief Chemist and Chemistry Professor as final positions. Believe me, I was happy making 6 figures and another few years would have really helped. I don’t think the VA cares what a veteran does or doesn’t do. They just aren’t interested in any veteran’s specific situation. Keep in mind, the VA and social security have different criteria for assessing what’s what.

It would depend on exactly what VA did. If what they did was justified, there isn’t anything to do. Visit a veteran service officer in your community to evaluate your situation.

I have a question if i applied for tdiu got denied the denial was final due to me not appealing within a year and i file for an appeal now what would the effective date be?

Since you did not contest the denial within the appeal period, you lost the effective date related to that submission. It’s not possible to appeal now; however, you can file a supplemental claim. If you win, the effective date will be the date the VA receives the supplemental claim.

TDIU is only for veterans with less than a 100% rating, so you do not qualify. The point to TDIU is to pay an unemployable veteran at the 100% rate because they cannot work. Since you are paid at 100% already, TDIU is irrelevant.

TDIU is about your ability to find and maintain gainful employment right now at this moment. The question is about today. If your service-connected disabilities make you unable to find or maintain employment in your normal occupation, you should file for TDIU. If you’re been 100% for 2 years. 8 months ago you file for an increase that was 30%, you got approved and increased it to 70%. Do you still get back pay from the 30 to 70? I’m hearing since you 100%, there’s no backpay even though it increases. I know percentage wise it’s not going pass 100%, I’m only referring to backpay. Thanks

@@VAMADNESS 😲😲😲ohh i see!! It must predate the 100%. Make sense. I got 2 cases I’m continuously pursuing that’s from july 2020, so when they’ll just pay it up to August 2022, when I got my 100% then. Okay. If that’s the case there’s no need to file Pack Act claims since it was passed after my 100.

Well, depends on your exact facts. Basically, if you had active claims after you stopped working and claim adjudicators had evidence that your service-related disabilities may impact your ability to work, then it is possible to get TDIU awarded before your current 100% rating date. If you can get 100% from tinnitus, there’s something wrong. That’s why the veterans administration is so strict. Malingering makes it hard for us combat wounded veterans that are really earned compensation.

I have helped many combat veterans with their tinnitus claims; a few of those, have reported to me that their tinnitus drives them absolutely crazy. Tinnitus is the same as any other medical condition; thus, the symptoms can be mild, moderate, severe, or worse. Is it within the realm of possibility that the tinnitus could render a combat veteran unemployable? I imagine it is possible. We can only trust the word of that veteran. I personally, have not seen any TDIU claim won per tinnitus alone nor has anyone contacted me with such a claim. I advise veterans on how to win their claims. I don’t judge. I take for granted the veteran has a valid claim. If I assumed veterans are liars, I wouldn’t be helping them with their claims. I completely agree with you on the thought that there are malingers and scammers that game the system; sadly, the system is ripe for abuse. The answer to stopping scammers is to fix the system. I write congress and the VA leadership every year with suggestions on how to fix the system, but I am ignored. Scammers do not make the claim process more difficult for honest veterans as claims are decided per evidence. Thankfully some scammers get caught. I also do not distinguish between combat veterans, combat wounded veterans, and non-combat veterans; in my eyes, they all have earned their benefits. Keep in mind, 94% of American adults never serve in the military. We veterans are really special Americans.

Interesting interpretation. There are many opinion-based ways to interpret the word “disabled.” Most amputations are rated at 60% or below, by your measure these veterans aren’t disabled. A right-handed veteran missing all five digits from their left hand would most certainly disagree. In reference to this video, I guess the question is “does a disability make a person unemployable.” The answer, as always, is dependent on the person answering the question. Some would say yes and others would say no.
