Hi, long time viewer, first time commenter. Not sure if anyone else has pointed this out, but her failure of the horizontal gaze nystagmus test could’ve been caused by Xanax, which she has a legal prescription for. Additionally, the fact that the officer estimated a margin of error for his PBT of .06 (he estimated that her BAC was closer to .12 when his PBT read .066) shows that he has no idea how to properly calibrate his device, and it likely hasn’t been properly calibrated in months. These two facts, plus her sober seeming demeanour, make me think that she may not actually have drank at all since the prior night (though she may have drank more than she let on the previous night).

I agree with this comment so much Also I wish she would’ve said. Everyone else in this room give a sample and I will send op. That way we know for a fact if it’s perfect or not. If there isn’t any error it should have read zero for the others. She was absolutely railroaded and it was disgusting. Could’ve been a plan masterminded all along. @@terryKessler42719 Hi, I’ve been trying to respond to your comment for a while, but KZbin keeps deleting my comment when I try to include links to sources. While it may not feel like Xanax effects your vision, it can still cause horizontal gaze nystagmus due to it’s similar mechanism of action to alcohol. Benzodiazepines and alcohol are both GABAergic CNS depressants that cause similar involuntary physiological responses (including horizontal gaze nystagmus) due to their similar agonism towards GABA receptors. Other GABAergic CNS depressants such as barbiturates can cause horizontal gaze nystagmus for the same reason. I tried to include sources at this point, but KZbin wouldn’t let me, so I’ll instead encourage you to google the following: NDAA horizontal nystagmus: the science and the law (from the National District Attorneys Association) TDCAA field sobriety test review (from the Texas District and County Attorneys Association) Apologies for the inconvenience, I hope you find this information helpful.

babe, she was an alcoholic. she was drinking on her way to work. she was drinking at school. she was doing those things. the breath test can be inaccurate, but it can't say you're that much above the limit out of nowhere. listen, i have such empathy for her. addiction is a painful cycle, and the profound shame she's feeling in the video is impossible to miss. i remember when the video was first posted, and i remember thinking: this is humiliating. it shouldn't be public. and! to say teachers are undervalued in the united states is the understatement of the century. teachers are the backbone of our early development. (have you seen that key & peele sketch "if teachers were treated like athletes"? it always makes me laugh and then feel a little bummed out lol) but the fact remains that this woman was drinking at school. the school didn't make her drink, they found out a teacher was drunk while working with children. can you imagine the lawsuits that would crash down on that school if any parents found out they let her stay? those parents would lose their minds! and you can hear the disappointment in that school admin's voice. i guarantee they wanted her to stay. but she was drinking at work. they _factually_ had no choice.

not to mention Oklahoma is one of the worst places to be a teacher. They are dealing with a teaching shortage and give thousands of emergency teaching certifications to make their schools even slightly functional. when I worked in an Oklahoma school the wonderful, committed teacher whose classroom I worked in was on food stamps due to low income and commuted over an hour daily despite the fact she'd been a teacher for decades in the state, literally had cared for kids in the middle of a tornado as it hit a school. teaching is a devalued profession in Oklahoma, if they want things like this to stop happening (second viral drunk teacher video of the year less than a month into the school year) it will take more than public humiliations of those dealing with addiction. "From 2001-2018, Oklahoma’s enrollment in university education programs dropped by 80%. That decline caused Oklahoma City University to phase out its early childhood and elementary teacher preparation programs altogether." "Oklahoma’s teacher shortage led to a record-breaking 3,780 emergency teaching certifications issued in 2022."

The officer then tried to say his prescription was a controlled substance which it's not as it's is a non narcotic and simply says handle machineryand driving with caution until you know how it effects you. The officer could not detain him or give him a DUI but refused to let him drive the 10 minutes home; he had to call my mom to pick him up and then get dropped off at his car the following day. As embarrassing as it was, the way the cops handled this basically gave her a get out of jail free card. No miranda warning, making her disclose medical information in front of uninvolved parties, taking her to jail essentially at the request of school staff…just absolutely unprofessional and very obviously done to embarrass her and punish her for her actions, which is absolutely not the cop’s job.

I feel bad for this woman. I've spoken with my daughter's teacher and teachers are under so much stress these days. Especially with covid, many parents are still afraid to send their children to school. I used to serve as a civil servant in a position of public trust where any intoxication would be a big problem. In many ways analogous to this situation. In all my years I was never aware of anyone being treated like this. We had an employee assistance program and often these matters would be handled by HR. The agency I worked for also had its own law enforcement capacity, but I'm doubtful that they would have jurisdiction over something like this. This would be seen as an embarrassment to the organization, and never handled in such a sloppy, public way. The school should accept some sort of responsibility, and have at least sought to protect its own from such a public debacle. I think this should be just as embarrassing for them, as it us for this woman- especially if this was something she struggled with for some time. This video exposes gross mismanagement of personnel. Not excusing this woman's behavior, just noting that the school system bears some sort of responsibility as well.

As someone with issues with substance abuse (not alcohol, a prescribed stimulant) I can tell you right now that it's not easy to get help. When you have bills to pay, you feel like feeding your addiction is the only choice, because you can't perform without it, without going through rehab or a period where your ability to perform will drop significantly. For all I know, that woman knew she had a problem, but didn't have a way to address her addiction without sacrificing her job. It's super easy, and honestly, sometimes the best decision when you have people relying on you, to put off dealing with your addiction. Sometimes it's just something you don't think you can afford to deal with. One day, you just wake up in a hole, and it doesn't ever feel like you really understood that's where you'd end up.

Okay I have to say something serious here. My mom was an alcoholic I lost her at only 65 a little over 3 years ago to this disease and she only ever drank wine 3 glasses a day max!!!! My whole life as a child I remember mom having her apple juice is a cup while she drove me everywhere. I even hid her special apple juice dueing a car accident when i was 8 yrs old. As an adult I'm soooo pissed she got off on her DUI bc she could have killed so many ppl and would still be alive if it wasn't for her having a good lawyer (no offense Bruce yall kick ass at what your do) but one night she drove over 2 miles with 4 cops behind her trying to pull he over, she finally stopped blew a 2.38 and on her court date only got freckles endangerment for not pulling over for police immediately. She deserved that DUI and totaled a car 2 weeks later and drove it home at midnight and I woke up to find it in the driveway(how she drove it home I'll never know) she hit a telephone pole at 45mph reversed and drove home. I thank God every day she didn't kill someone and many fights we had when she wouldn't dump her wine our as she left a gathering to drive home (bc lord knows you were never going to get her keys from her and I had called the cops on her any times when she left praying they got her in time before she got home) they never did but God i tried everything after she got off on her DUI. I miss her every day but I wish more people were vocal about how not cool it is to be a mom who drinks whine to get through your day. I see tee shirts and cups glorifying drinking as a mom and it breaks my heart bc ofbthe trauma I dealt with as a kid having a mom who chose wine over her only child every day until her last day. I don't drink but a few times a year bc it scares me knowing how easily it becomes a coping mechanism and as an ex addiction from other substances I know I how easy it is to fall victim to these things. I just wish these BPTs did hold weight in court especially when they are high high like my moms was. She failed every field test and still no DUI bc she had a good lawyer. Speaks volumes for the layers like you Bruce but at the same time she faked her way through all of the courses she had to take and never drove sober botba day since I was born.

Termination and arrest of someone who has a pretty minor alcohol addiction is only going to make things worse for her instead of getting her a small amount of help that she needs. IDK... I suppose those are all things that the woman should have thought of herself before she was drinking at school. @@jtr82369I agree, if this is the first time she has been seen drunk/drinking, it’s likely that her problem is just starting to ramp up. She needs help, so making some program or testing a requirement for employment would be a good wake up call for her and could _actually_ do some good. Arresting her was unnecessary. Losing her job and the humiliation of such a public arrest is more likely to put her on a downward spiral. I’m not saying let her get off scott free, but taking action and accountability would be more functional as well as more human. Also, it would hopefully serve as an example for other teachers who might have addictions or severe mental health issues - instead of feeling like they have to hide it even more, they would know that help is available and it’s not the end of the world if they mention it. Seeking help should be incentivized. Teachers are especially prone to addiction because they have so much on their plate; they have to deal with kids (or worse, teens), they barely have a budget and sometimes have to buy stuff for the classroom themselves, AND they get shit pay (in the US). It’s a thankless job but the best teachers are in it cause they care, and even the best teachers can burn out and turn to alcohol or drugs to cope. This teacher could’ve sucked and just not cared and drank on the job, but we don’t know. I’d always rather treat addiction as a mental health issue than a criminal matter.

I've done the hgn test on completely sober people before and still saw some "jerkiness" so it's not exactly a reliable test in my opinion Also just wanted to say, as a cop you had me cracking up all the times you called out exactly what the cop would say 😂 you know the playbook well sir! I completely agree that this was a pointless arrest that helped nobody. Here in Texas that would be a class C misdemeanor (lowest level we have) and I would've used my discretion and just either A. Let her get a ride home from someone, or B. Just given her a ride home myself. She's already suffered enough consequences for such a low level offense by losing her job, why arrest her?

My dad use to work for Walmart. Around Christmas one of the bank drops went missing. He had been the manager to deposit it. It was around $100,000. The FBI got involved with the case because of it being a bank. My dad was very honest person. I saw him find a penny on the floor at work and turn it over to the office. Anyway, they told him he needed to do a lie detector test to prove he didn’t steal it. My dad was so nervous he failed the test. Before anything else could happen it turned out some kids were using fishing poles to grab the bags as the bank night deposit didn’t have a lock. So I am wary of police if they say it will just help you.

Thank you for a compassionate reaction. I really believe she is an alcoholic and needs compassion. As a recovering alcoholic, my heart hurt for her to lose everything. Yes, she works with kids and it's not ok. But at least give her a chance to get treatment and rehabilitate her instead of throwing her away. I felt that she responded well and wasn't out of control--she didn't seem very intoxicated which makes me think she probably didn't drink that morning. I appreciate that you felt the arrest wasn't necessary. Hope she can get help through this. Recovery is stressful without public shame, she will need support.

Several thoughts on this video: If this were to go to trial, wouldn't she have the right to face her accuser? Someone accused her of being drunk on the job -- doesn't she have the right to face that person? Also, they never did mirandize her -- told her she was under arrest and let her keep talking. And yes, now this is all over the internet. Also, I hated that the principal had a resignation letter drafted for her to sign -- in that moment of distress when she certainly wasn't thinking clearly, regardless of how much alcohol she'd had.

They don't need to mirandize her in the fashion you're assuming since she blew a .06 (which yes is lower than .08, but the other officer explains why its still 'illegal' in this context). It's akin to an officer not needing to mirandize someone when he witnesses a crime having taken place. If an officer witnesses a hold up at a bank, he doesn't need to mirandize after neutralizing the threat and placing the defendant in custody. Unfortunately, we don't really teach our citizens their rights and how to handle themselves in these situations. If anyone thinks Miranda rights are going to be spouted this soon (ala a Law and Order scene) we need to stress differentiating reality from pop culture tropes.

I have to say that after I heard that she had a prescription for Xanax made things a lot more clear. This woman suffers from anxiety. And I don't think anyone who doesn't suffer from anxiety understands how terrible it can be. So the inclination is to self-medicate. The alcohol allows someone who suffers from anxiety to interact with other people in a social fashion. Even though ultimately the alcohol makes the anxiety worse it's worth it to able to be with other people socially. And the Xanax allows people with anxiety to work. Someone very close to me suffers with this and has finally gotten through rehab and is sober thank God but still takes other medication for the anxiety. This woman definitely needs help and unfortunately our culture just wants everyone to just get it together and get over it and that's not how it works

But this lady is under the limit, still got arrested, still got fired (or was given the opportunity to resign, isn't that nice) and it just seems like railroading. And with me that had undiagnosed adhd, I always got the worst of it and I was singled out in every activity. It got so bad, my mom pulled me out and homeschooled me. Re-watch this and just focus on the teaching staff, this is the most exciting moment of their entire careers and they get to play police in deciding this woman's fate. No doubt, she's been an annoyance in the break room and pissing us off at meetings, let's really make sure she don't come back and coerce her into resigning, not thinking beyond their petty issues outside the law. Well, the wheels of justice start rolling and when she's coerced into resigning and pleading to at least call her sister, that's where watching the staff around her pays off. Around 35:00, they each realise to themselves what they've done and how uncomfortable it is as they scamper to look 'busy' on their phone or computer, doing something else and not responsible.
