@@aijokker The names are not remotely similar or easy to mistake beyond the pronunciation. It's also a rather descriptive name for link hoarding and hordr didn't have a huge user base that the bigger open source project tried to steal by imitation, so I don't think this will stand up in court

Plus that's not what's happening, you could've read the Reddit post yourself, but I can see doing things by yourself is hard for you, thus I help. The company doing the take down is called "Daydia Inc.", can't be a great software company when they forgot to change the Hordr website template footer from "Untitled. All rights reserved." to their own company name... Plus in their company website about us section they miss spelled their own company name. Plus their isn't a LinkedIn page for their company which wouldn't be a red flag, if their "CEO" wasn't on LinkedIn has the CEO of a different company, or their CTO has a full stack developer for Walmart Tech.

If they really sent a DMCA notice then that's fraudulent as that applies to copyrights, not trademarks. Second of all, you can't trademark the word hoarder or any other dictionary word, so attempting to claim a trademark violation when the app name he chose is Hoarder is likewise fraudulent. It's the equivalent of claiming a trademark on the dictionary word itself. I hope he sticks to his guns and keeps the name Hoarder and maybe teach those douchebags, who clearly just want to soak up profits they haven't earned, a lesson.

The problem is scammers register names like "National Pasanonic" then create a similar logo to the real company (National Panasonic), knowing full well lots of people will think the fake one is the real one (mostly non native English readers).

Funny thing about trademarks, if you don't actively defend your trademark, it can be invalidated on those grounds in the future. This is what often triggers seemingly silly actions like this.

This remembers me of the same thing Bethesda did to Mojang because of a game in development called Scrolls. Bethesda filled a lawsuit against Mojang and their reasoning was that the name of the game was almost identical to their trademarked name Elder Scrolls and Mojang was infringing their trademark so they needed to change the name of their game, but in this case Bethesda almost lost the case and they made an agreement with Mojang for then to keep using the name Scrolls but with no right to release any other sequel using the same name.

Unpopular opinion but I think Hordr is right. Don't get me wrong, I usually hate this kind of behaviour as much as the next guy, but you can't argue with their argumentation, they literally have a legitimate point. I don't get why the opensource app just doesn't change their name. On the other hand, from a pr standpoint this is a huge miscalculation from Hordr, way to get yourself really hated lol.

Wait, I am confused. So the hordr is a bookmark sorting app, that appeared around 2023. Then the hoarder with the same idea appeared around 2024. Who... who is in the wrong here? If there are no financial strings attached - change the name and you are good to go.

Here's the thing; the accuser trademarked the name, so there IS financial strings attached. The defender didn't. Morally, I would agree that both names are generic and not the same, but who knows how legally it is. If I'm not mistaken, a case can be made if the person is not using the name at the moment, but that's just in theory, in practice I wouldn't be so hopeful

I mean OK sucks he needs to change the name, but this is a pretty cut and dry case. Definitely not “crazy”. He picked a name very similar to a direct competitor who was there first and even registered the trademark. What else is there to say? The author will just have to take it as a life lesson. Life’s gonna throw much harder punches down the line. If you let this overwhelm you you’re in for a bad time. Change the name, be done with it. This isn’t a David vs Goliath situation. The request is perfectly reasonable.

That's like saying no company can have a competing product named a Watch because Apple has the Apple Watch. "Hoarder" is a pretty descriptive name for an app for hoarding links or whatever, and it isn't similar to "Hordr" at all. It makes sense to object if another company names itself Applie and puts out smartphones and computers with a half bitten plum because that's clearly imitation meant to confuse customers. I don't think Hordr has any chance in court.

There is a lot of ignorance about trademarks here and in the comments. The easy solution, however painful, is to change the name and come into compliance. What is stupid is pretending that the guy who released an open-source project without doing any due diligence is being stolen from or abused. Clearly, he wasn't very worried about the name, given he hadn't looked into it at all. Trademark stuff is often confusing, but this isn't a case of a company being petty with its actions. The app is a direct competitor. If you don't like how trademarks function, work to change them. Take it up!
