Actually FSU has a good case. When the grant of rights was negotiated in 2012 then in 2016 . The ACC did not try to adjust the deal TWICE and increase payouts which was already well below that of the BIG and SEC. Then they extended them again another 9 years at the same rate as 2012. Clearly someone was strong arming the ACC who in turn strong armed league members. I suspect someone was whispering a little something something into ESPN's ear. (Back door scheming kind of thing to secure a bigger deal for whom ever). Before you get your panties in a twist the schools had no say in the extension to 2036. IE The ACC wasn't negotiating in good faith as a reprehensive of its schools including FSU. This goes back a lot further than the past 2 years with many schools that were not happy with that contract. As a matter of law if a fine fee or penalty is so excessive and egregious the court can rule that it be zero. Look up the 8th amendment, it applies to everything not just governments.

Correct, the ACC is incompetent as hell. Jim Phillips voted against the 12 team playoff this year. How does that help ACC teams this year ? When this case goes to Discovery they will settle just to not be exposed.

Bingo..Those who think this lawsuit has no weight just because “FSU signed it” are misinformed. I am no law expert by any means but have heard from several well informed people that once discovery enters the chat, the ACC needs to be very afraid. This will end in a settlement before it gets to a courtroom. This Matt guy painted the picture that FSU is cooked because they only have 2 options. When in reality none of those are the actual options.

I predict this gets hashed around in court for a little bit, and then it gets settled. FSU pays the ACC around $200-$250M and everyone calls it a day. Life goes on. And oh yes, you can bet that FSU and the various conference commissioners have discussed this in private. FSU already knows exactly where they are going when this gets settled. It's a done deal.

I agree as well. There is an exit fee and the GOR, but those fees have to be reasonable and an approximate estimation of damage the conference will suffer. If they can show that $572 M is excessive and unreasonable, they could get out of having to pay that amount. As you said, a fraction of it will probably be paid in a settlement.

FSU doesn’t have that much money to pay the acc, that’s the problem…. It’s a public school funded by the state government, boosters and donors and Floridas tax payers. I don’t think the boosters would be able to raise that much without dipping into Public funded funds.

They didn’t expect this to happen, they in the process of spending millions redoing all of their lockers, new practice fields and other stuff. Again it’s a public school they can’t just go spend $250 million plus and then expect the state of Florida to cover other expenses. It’s not just football, universities spend millions on all other teams and they lose money from almost every other boys and girls sports expect maybe basketball and baseball but those are breaking even. If a university does such a payment like This (and the acc is gonna want all of it up front not in payments) it will hurt every other part of the university. Per example scholarships, food, housing, teachers, staff, there’s so much money being spent on the school for the school.

The acc broke Florida laws so it really comes down to where the case would be heard. If it takes place in Florida the acc is screwed because of the anti trust laws and block of trade. The judge could rule that the exit fee is unreasonable and reduce the buyout to something more manageable or even not cost them much of anything at all. Matt you need to do more research and if you want to get the best fsu new that's is at warchant. The only hope the acc has is that the case gets moved out of the state of Florida where the laws are different. Oh and there is word that if Florida state is successful then clemson and unc will piggy back off what they do. Which that could be why the acc added 3 teams because they know their big 3 is out soon. The only ones cooked are the acc... #Mattbebald

so fsu has a contract with the acc saying what they can and can t do. remember a few years back every athlete had to sign a ncaa contract before getting a scholarship, that contract stated the ncaa had all rights to the athletes name image and likeness and the athlete had no rights for compensation for the use of them. how did that turn out once the courts got involved?

IF i was the big 12 i.would do my damndest to get FSU and Clemson. When it comes to revenue those are 2 big brands, with Colorado coming up (hopefully) and Utah doing decent every year, the big 12 could at leasy have 4 top 12 teams each year

If FSU pays the 500 mil they'll still profit no matter who they go to. They'll make more money by the time the GoR ends in any other P3 conference, (The ACC is NOT a power conference without Florida State.) EVEN INCLUDING THE 500 MIL.

The part that I find crazy (if true), is the fact that the Grant of rights is locked away and can only be seen with someone from the ACC present. I had flooring installed, yard work done, a bathroom installed and I was given a copy of the contract. The fact that every school in the ACC signed it, and didn’t have enough common sense to request a copy of it is crazy. That’s the crazy part of the story to me

The real problem with the ACC/FSU issue is ESPN. The court case will open the ESPN and ACC documents and discussions through the discovery process and college football will be changed fundamentally.

Zero dollar payout. Simply breach the contract and have the state legislature indemnify Florida State from breach of contract lawsuits. There is a precedent set forth in Leach versus Texas Tech. Leach was unable to sue Texas Tech because they are a state university and are exempt from breach of contract lawsuits. Its called sovereign immunity. FSU attorneys have already stated these contracts FSU admin signed violate state law. FSU is a state university. State lawmakers could never let them get sued for that amount of money, its absurd. There is also what is termed discovery. It means through this lawsuit FSU would have access to all espn, acc members, etc personal information. Texts, who's screwing who behind closed doors, emails, etc etc. Now, the ACC preemptively filed a lawsuit in the state of North Carolina. Seems like they're trying to get this moved to NC. From a legal standpoint, the situation is more favorable for Florida State than you may realize. All of this 572 million would be considered an illegitimate penalty under state law. And technically a state university is free from breach of contract lawsuits. Theres a precedence set forth in Leach versus Texas Tech.

FSU will get a reduced GOR. The fact that ESPN negotiated their own opt out in the contract in 2027 will give FSU the leverage in court to get a buyout prorated from 2027, not 2036, thus greatly reducing the buyout.

The a c c was the worst conference? The acc had a winning record against the sec and the big ten. The acc is second behind the sec in championships the past 20 years. Every single conference is top-heavy with 2-3 teams, then everyone else

There are lies, damn lies, and statistics. You can use w/l records against mismatched teams or you can open your eyes and watch the size, speed, and skill disparity between the conferences. The Big 10 and SEC are by far the best 2 conferences. Just look at the last 20 National championships and playoff participation. The SEC has 8 teams with a cfb national championship since the bcs era forward. The SEC is so far of everyone else it's laughable.

Big 10 has by far been just Ohio state and the acc has been fsu and Clemson..only difference is the acc has the second most championships in the past 20 years and the big 10 hasn't been relevant

Tell me why the SEC has the most players on active NFL rosters, of any conference? It’s because the SEC is superior and dominant and has been for the last decade. The ACC is a weak conference, and talk about top-heavy, the ACC is exactly that.

The worst conference out of the Power 4 but it's second in NCAAF national championships over the past 20 years. FSU is part of that reason. So was Clemson. You can only go back about 20-25 years because any longer than that the dudes playing wouldn't have been born yet. Someone would be talking about their father or grandfather’s day. The Big 12 is dying and nobody noticed. Maybe people are waiting on rigimortis. The programs that won their national championships over the past 20-25 years are gone or committed to leaving next year. Nebraska: Gone, Texas: Leaving next year, Oklahoma: Leaving next year. If anyone leaves the ACC they would be doing it for the year following because the date to inform the ACC of your departure for next season has already passed. So next year the ACC will have all its national championship programs while the Big 12 will have none of them. The most national championships in that statement by the ACC are for all NCAA sports. The other ones you didn't know your favorite SEC program had. One thing to know is that FSU hasn't been the dominant program of the conference. The perennial Alabama if you will. They've been bad or meh for at least half of the 20 years. They usually win a natty and disappear for a while. Clemson had a dominant stretch like what I said about Alabama. I know FSU was bad for at least half of it because the divisions used to be the Atlantic and Coastal. Setup to get FSU vs. Miami. They didn't have any dominant run in the ACC Championship Game. Am I telling lies? The ACC has done very well to prop them up and they're still not dominant. The conference can't add significantly more money for a few years at least, if at all. The GoR is longer than the ESPN contract. However, they can start to close the revenue gap with addition by subtraction. Anyone is free to go but we gone need that 💰 homie. For the opportunity to shine the conference gave all members, we’re going to need to hold half or a quarter of a billion. Pay the money and go. You’ll help subsidize the remaining members to add to the TV money. Anyone wanting to leave will help the remaining members close the revenue gap a little. Probably couldn’t have done it with you for a while.

Not even close. The school with the most Division I championships would be Stanford. Florida State isn't even in the top 40: en.wikipedia.org/wiki/List_of_NCAA_schools_with_the_most_Division_I_national_championships

This makes Notre Dame look like a loser by joining a conference that teams want to leave. I don't think FSU was mentioned when the SEC expanded with A&M and Mo. but was even visited by SEC CEO when the SEC added Ark and USC. FSU said no because they wanted a sissy conference that they could push around. Now they are crying about it and I don't blame them. If they had their current record in the SEC, they would be No. 1 and would be in the CFP. The SEC might still be angry at FSU for humiliating the SEC by turning down an invite back in early 90s but they might overlook that to keep the B10 out of the South. Sure FSU has a landing spot or this would never have happened and my guess is it is the SEC where it has natural rivals. The SEC got Texas(which will never join the SEC as some blowhard stated). Guess what discredited big mouth.

Before you pretend to understand this lawsuit, you should have at least seen the word wholly! Wow! Again please, stop admitting to this. Anyway, no one knows if FSU will be successful in getting out of the half of billion (or so) paying Grant of Rights. You are not reviewing the 38 page lawsuit, maybe because of too many words, Lol. But!!! FSU does make some good arguments against this payment. Most likely, this case will end up in Federal court where anything can happen.
