On the last day of the winter session of the Lok Sabha, the BJP-led government on Tuesday tabled a constitutional amendment bill to provide 10 per cent reservation in jobs and higher education to economically backward sections among the upper castes. The Union Cabinet, headed by Prime Minister Narendra Modi, had approved the Constitution (One Hundred and Twenty Fourth Amendment) Bill on Monday. Now that it has been passed in the Lower House, the Bill will be moved in the Rajya Sabha on Wednesday - the winter session has been extended by a day for members in the Upper House. The Bill needs to be passed by a special majority of two-thirds of members present in each House, not less than half the strength in both. Following this, it will have to be ratified by at least half of the state legislatures. It will also have to face legal challenges if any. On this edition of the big picture we analyse the Constitution 124th Amendment Bill.

Why Reservation ......Instead of giving reservation provide them free coaching and personality development programs. ... Reservations is just sucking our country's growth ... our mentality is still backward

Exactly.. Not every socially bkwd is poor or unaffordable to apy laks for getting into a training pgmme by private institutions.. And not every general candidate can afford for a good coaching.. So leave the idea of reservation altogether and improve skills.. Also conduct exams fairly

Your idea seems right but our country cannot afford such huge expenditure. Also free coaching means govt has to interfere, leading to lesser revenue for these coaching institutes and finally destruction of free economy concept. Although reservation is again against a free economy, but in the present scenario it seems right, but should have a stringent sunset clause.

I am fed up of such kinds of reservations..... 50% total reservations already existed for SC,ST'S,OBC AND Reserved ones.This was not enough and there is again 10% reservation.... I mean why so must injustice towards medium class general cateogories..... AT LEAST WHY NO ONE IS THINKING OF NATIONAL INTEREST.... IT'S IN THE FAVOUR OF NATIONAL INTEREST THAT MORE QUALIFIED AND SKILLFUL PERSONS CAN GET THE DESIRED POSTS AND SEATS EVERYWHERE.... Didn't you hear Mr Tondon ? He clearly mentioned SC , STs and obc consist of 70% of population but the reservation is just 50%... the rest of 50% are clearly 'reserved' for general people, but that's the case only when you see it that way... Secondly, 10% reservation covers 95% of the population !! Still 40% remains, that being said, there's no provision like that those who've applied for the cap of 10% quota won't be able to get a seat outside of it!! It simply means, 30% of population is ruling 50% of seats!!! You know what it means, means that there should be 70% reservation for SC ST and OBCs... That's how there can be fair play...!!!

Noted Advocate Nani Palkiwala said during the Indira Sawney judgement, that it will cement castism in India. Now this will cement classism in India. Reservation of caste seems to have no sun set clause. Now this will go down the same road.

Good discussion. I still have some doubts. There is no exclusive state lists for general category castes in many states. If an economically weaker candidate of general category wants to apply for a job under state public service commission what is the requirements he/she has to qualify.

The current legislation is for the reservation in central services and educational institutions. So the some criteria won't be applicable to the states, for state services and educational institutions one will have to go through as to what states may specify.

where does reservation solves the issue of financial backwardness. Imagine a situation where a student who is financially backward and he clears an examination and goes in a wonderful univrsity, now how does he pays the fees at a time where government is busy privatising things and giving huge autonomy to government universities.

It's disgusting. Those who were for meritocracy are asking for reservations. And in our country 30% people live below poverty line and can barely earn 3000 INR per month but people with 65000 INR per month are considered poor. Pathetic!

Special Thanks to Mr. Sai Deepak, you are awesome. I guess there won't be any significant change in Competition level because >95 % people are falling under eligibility criteria, rather it would just make the 10% unreserved seats unavailable for depressed classes( SC, ST, OBC, and others) who used to clear General list. But definitely its going to pave a way for economic considerations as far as Reservations are concerned.

The property cost can be high, that cannot fetch monthly income or raise standard of living or provide jobs or education merit seats. A home below 1000sqft in bangalore is not going to fetch a large amount

Well I think the income cap is kept a bit high as still the needed ones have to compete roughly with 1.2 bn out of 1.25 bn which changes almost nothing.

The conditions of sc/st is still deplorable.Only minimal percentage of its population raised upto the benchmark kept for EWS reservation.All things are political gimmick to woo the uppercaste voters in the backdrop of NDA-1 failures in runnings the government in every front.🇮🇳🇮🇳🇮🇳

Mister, more than 90% Indians have been covered under the bill. I like this bill but need to pass before the june 2019 so I seek reservation . If you don't like this bill than tell the government that they need to build schools just like IIT for the poor. The children of rich born with silver spoon that is why they get top class education. Now time has come for the poor to stick together. Give us level playing field before college then we support for the end of all reservation.

I only want affirmative action benefit at school level not university level never for jobs as it would be recipe for disaster as only smart and hard working deserve jobs and admission at college. If no reservation then there should not be any funding to any universities, public and private school as it would only benefit in large part to the rich and the upper middle class, period. Level playing only at school level from K to 12.

@@rambhakt2626 8 lakhs criteria for OBC creamy layer, or for any community for that matter, is to exclude people who are well off within an social backward community. The current one is to include people from general category which doesn't have suffered from social backwardness. There is a difference between these two and cannot be equated.

This bill is going to have long term ramifications like Mandal and if ratified by SC too, it is going to open the gates for the discussion about overall revision of reservation system.Bcoz , though 'affirmative action principle' is equivocally accepted, One should not forget its against the equality nd should not be continued for indefinitely long time - 'Unrevised'!

This bill along with the upcoming "OBC sub categorization" commission report will be an improvement over the reservation system. But ultimately, everything depends on implementation.

I am also thinking about whom got reservation before, but at the same time many within reservation catogary but their income is less than 50000₹ What does government have courage reservation within reservation only 20% for who are weaker in oneself

The only problem faced by children of socially advanced castes who are genuinely economically backward is that they are not able to afford education to the fullest level. This problem can be solved by having a scheme of scholarships and education loans so that it can support the economically backwards classes.

We asked them to remove reservation, they came up with a new one. I found the 8 lakh rupee threshold a big mistake, it must be around 4 or 5 lakhs so that the real needy can be benefitted. NO HARD FEELINGS. #PEACE

10:35 in Indira Sahini case Supreme Court of India ruled in 1992 that reservations could not exceed 50 percent anything above which it judged would violate equal access as guaranteed by the Constitution

Absolutely political decision at this time as also conveniently proven by the esteemed panelists that none of the parties would object to it. As it is the posts in the govt are decreasing eg: UPSC, over and above the already set ceiling of 50% reservation another 10% for EWS is a direct slap on the generalists. Should this said 10% be given at all, then it must be accommodated within the 50% category. Doesn't matter which party forms the govt but they must be mindful of the implications they have by their decisions and in this case very far and wide! Disgusted!

I would say it's a welcoming idea of giving reservation solely on the basis of economic parameters, not only to upper cast but to everyone irrespective of caste.....it's already been 70 years NOW!!

It's all about MODIS MIND of politics. I personally don't think this is going to be executed. Reservation giving on the economic concentration cannot be given. Reservation was given to make free from the burden too which the lower caste people are faicing but that is not even cleared. Why don't you cancel all the caste. Why there is a caste if we neglect the caste half the problems could be resolved.

If one has finished the required qualification ,one has the passion ,one wants to be an ias ,one also urge to seek the coaching to get some outline of the whole process ,but one sacrifices the dream because of the fact that he/she is born in a poor family ..

what I got from it, a- person whose salary is 65k per month is poor, though most of the gov jobs dont provide this package at initial level at least, b- political parties could not oppose because they cant afford it, may be they like it or not. c- Its leading to a more refined aspect of reservation like for women, 3genders, refugees etc, now what lead the gov to take this step in the last day of parliament or BJP gov, d - no data is given to back the this argument of backwardness and creamy layer, as per my knowledge. 1-It failed to create the jobs in gov and pvt field both miserably as it had promised and made people dream by make in india and other programs. 2- Education system is junk, it can produce cheap labor for USA not scientists or ENTREPRENEURS. 3- Neta have enough money to send their children abroad for study and most of the indian collages belong to them. 4 - If we really want progress, will have to appreciate merit not cast. its better to make the cast meritorious not the merit on cast. pls forgive for mistakes :)

he/she will be given general seat given he/she qualifies every criteria of General category i.e. age, attempt and have qualified each stages above general category cut off.
