Don't forget Derek Bentley, hanged in 1953. The judge, LCJ Goddard, had repeatedly wrongly directed the jury. He was later pardoned and, later still his conviction was quashed by the Court of Appeals.

It is not the case that hanging was the only form of execution from the early sixteenth century. Hanging, Drawing and Quartering was available for Treason from its inception in 1359 until its abolition in 1825. Beheading was also available, the last instance of its use being in the 1740's. The 'abolition' of hanging in 1965 was, in fact, a suspension, its abolition for murder being in 1973. Hanging was retained for Treason until 1998, when it was abolished under the Crime and Disorder Act.

There is not but the prohibition on hanging is a matter of UK law by the Human Rights Act 1998 and cannot be amended by devolved legislation. Devolved legislation was not an option at the time of the original video and only Westminster could make any criminal law. So whilst there is no unified criminal law, this particular issue is an issue of UK law.

What does it matter where it leads? Death is the only just punishment for certain crimes. Where it is an option, it is possible for authority to extend clemency. If the justice system is not capable of convicting someone beyond a reasonable doubt, then it has no business sending someone to prison. It is certainly possible to reserve the death penalty to convictions based on hard forensic evidence, or, in some cases, where the facts of the case are not in dispute.

The difference is that one involves the state-sanctioned murder in cold blood of a bona fide, sentient human being and the other involves someone legitimately exercising their bodily autonomy by ceasing to directly provide their body for the benefit of a (potential) other human being.

Hanging was and is diabolical and never solved crime, Breaks my heart that innocent people were hung! Especiallym comes to mind that poor lad (I forget his name), accused of killing his wife and child, he was hung and ut wasn't him! He was a bit slow and got stitched up! Crazy to think this debate went on. What we should have is ACTUAL LIFE SENTENCES meaning life with NO parole for all murderers whether they're 12,15, 50 or 95! Life should mean life and longer sentences for any violent crime with on licence for life.
