Around 39:00, Arin didn't hit any cones. He ran his arm into the wall ahead of him, which is why he couldn't move and kept getting penalties every time he tried to move forward again. It might also be an emulator thing. They might be playing this on emulator, as they have other games. If it uses R2 and L2 to reverse the treads, that can cause some issues, as some controllers treat those buttons as a Z-Axis joystick (for pressure sensitivity) instead of just 2 independent buttons. This means though that pressing both won't be registered.

So at 38:45 he was not just hitting the Witch Hat, he was also hitting the fence with the arm/scoop !!! This is also why he lost forward momentum, he was hitting the fence in front of him repeatedly. You can see in his next attempt he has the scoop high enough to clear the fence giving him the space to do his desired movement, he just got carried away and didn't have the time to complete it. He then gets dangerously close to the fence again during his successful run.
