Life in Prison is only worse IF you're in Solitary Confinement for the entire time. A Life Sentence in prison's General Population is immeasurably better than the D.P. I think the D.P. should only be used for the absolute worst of crimes that are the most heinous versions possible, AND only when there is NO doubt whatsoever about guilt. (Which is a much, much higher standard than "no reasonable doubt". Absolutely no doubt means there is 100% surety that the defendant is responsible.) If the person is an active threat, like part of a trorist cell/ group, dangerous gang, etc., then under the first standards, it also makes sense for D.P. But for vast majority of D.P. cases currently done, it's not appropriate. Besides potential innocence and unequal applications, there's also the hypocrisy of it. If the Gov claims it's ALWAYS wrong to un-alive, no matter what, because nobody has the right to take someone else's time on Earth, then the Gov is contradicting that very claim by sentencing the D.P. By removing the D.P. as an option for all but the most extreme, it removes the hypocrisy, and shows consequence for wrongful acts without contradicting justice. Otherwise, if they want to keep the D.P. as an option as it currently is, they need to change the law about " nobody ever has the right to take someone else's life", so that situations that are justifiable aren't punished, or at least not as severely. Like when a woman unalives her grApist, or a man unalives someone who hurt his daughter, etc. I'm a woman who served 10 years in Maximum Security for ending my father's time on Earth with a metal bat when I was 19. All 3 of my older siblings had been locked up before me for attempting to do this to my father. He had done every type of horror imaginable to us and our mother for over 20 years (before I was born). The State conceded this history, but claimed I was still wrong because I didn't stop swinging, and that I should have run away (despite living deep in the rural country, and had tried fleeing multiple times growing up, but he always got me back, usually using the system against me. He was a very wealthy millionaire, and got away with everything, and always got what he wanted. His role as a local political donor and church member and Wall Street executive gave him excessive reach, power, and cover.) Luckily, my State didn't have the D.P., although the feds expressed interest in charging me in a D.P. case at first, before changing their minds and leaving me to thr State after learning the family history. Long story there. But yea, the DA wanted 57 to Life (I caught another violent felony in county my first month, for kicking another inmate in the jaw. My black belt was used against me by the courts for this), but the Judge circumnavigated him, and gave me 10 Flat. In other parts of the country though, I would have gotten the D.P., and in some places, I would have been released with no charges at all. Our laws are so archaic in most places, and based on revenge more than justice. But I would 1000% prefer life in General Pop, versus having it all ended early. I made life-long friends there, had visits, cooked food with friends, went to festivals/ events (within the prison), had my own TV, played chess and other games, played on a soccer team, learned hand-ball, participated in religious ceremonies with other Native American inmates (I'm native), and much more. There was plenty of trauma and suffering and pain, but many good times, too.

In the United States, the decision to impose the death penalty typically involves the jury. After a defendant is found guilty of a capital offense, a separate sentencing phase occurs where the jury considers whether to recommend the death penalty or life imprisonment. The jury's recommendation is usually given significant weight, but the final decision can ultimately rest with the judge, depending on the jurisdiction. 9:45
