PANYNJ shouldn’t be so restrictive on PATH photography. New Yorkers and NJ residents pay the Port Authority in many ways to keep them running and their response is to ban them from taking pictures on their property? That’s just not cool

@@monty7657 Ok you’re right, they don’t, but they do use surplus toll revenue from all 3 of their Hudson River crossings and earn revenue from the ports and airports they control. The citizens are the ones paying those tolls, and the airlines surcharge passengers for flights out of there to cover the costs the airlines must give to the Port Authority. And of course, they directly earn money from citizens through PATH fares. All that money is used to operate and maintain all the infrastructure they own, including PATH. The least they could do is let people film the PATH trains

Someone should sue them - that's how the PA bus terminal (in nyc) ban IIRC got lifted, it'd probably be just as flimsy a ban as here.

Thanks for this. Brought back many memories of life in Jersey City. I'll also note that during college I worked a summer job in the Port Authority offices of the team designing the original PATH cars and equipment after the takeover from the Hudson Tubes, and I actually had a vote in the final choice for the first PATH cars. My choice of the three was the one finally adopted, so I feel a little personal pride for having been there.

Port Authority really should lift the photo ban. It just makes no sense to me.

It’s not just PATH but many of the other Port Authority properties as well. Photo ban in place on the GWB, tunnels, & the Port at Newark for instance. Not even supposed to photograph boats while at the port.

@@alidycepaisley3829 ever since the 1993 WTC bombing things started a bit more strict for the Port Authority, but when 9/11 happened that’s when things really got tighter with security. The Port Authority is joint government agency between NY & NJ with their own tighter rules & regulations for their own properties.

If it received FEDERAL FUNDING, that makes it a government subsidized company which is now obligated to abide by any protections on citizens offered, including Freedom of Speech - which includes amateur journalism which includes photos and videos for such use.
@MrSuperpiff4
@MrSuperpiff4 Ай бұрын
Hate to be that guy but that is not how the first amendment works at all. 1) Funding alone is not sufficient to trigger constitutional rights, the government funds private institutions that may restrict your rights. 2) FEDERAL funding is irrelevant as the 1st amendment is incorporated to the states via the 14th amendment and therefore state actionsby either the federal or state government can trigger constitutional rights. 3) the government can and does restrict your speech on government property if the speech would impede normal operation as long as the regulation of speech is viewpoint neutral. 4) When the government restricts speech without discriminating on viewpoint all the gov must show is that the restriction is related to an important government interest and leaves open alternative channels of communication. If you ever go to DC you cannot film or take photos of the Pentagon subway station which is completely government funded and open to the public. The government interest behind that policy is the same as PA's policy for PATH, security, namely the threat of terrorism post-9/11. The PATH regulation is viewpoint neutral, limited to video and photography (not historically the strongest category of "speech"), and leaves open channels of communication. In-fact filming is allowed with permission which would typically trigger another set of factors but I think the PATH regulation is constitutional without looking into that.

@@MrSuperpiff4 It ain't constitutional. Them not allowing filming at the Pentagon Station is completely different from the PATH situation. I know you hate freedom and hate the Constitution but your views don't supersede it. Not allowing filming at a secure government facility (such as the Pentagon or a military base) is different from a train that is open to the general public between NJ/NY. I'll film all I want on Path.

This is one of my favorite Subways since I read about from an old Book of Wonders (1916ed) when I was a youngster. I finally had a chance to ride PATH 25 years ago. Hoboken to 33rd street, returning to Hoboken from an E train transfer from 5th Ave at the WTC. I loved it! Thank you for this terrific Video.

Honestly, the PANYNJ needs to face more suits over their bans (relating to bridges, tunnels, rail, and airports) - that, if I recall correctly, is how the ban at the PA bus terminal got axed. It's just as dumbassed here to ban it as it is there, IMO (and there are people/orgs who will work pro bono for such suits).

The real rule is that you aren’t supposed to film or capture photos of the system if you cause a hazard to yourself and others, or if you’re trespassing into non-public spaces. Otherwise, it should be allowed to take pics of WTC Station as long as you’re not doing anything risky. Some people tend to misconstrue the law because they really dont want their likeness to be shared, especially on places like art galleries or social media.

The photo ban is stupid. It is basically an anti terrorism policy, the idea being terrorists could take photos and use them in planning an attack. They NJ sports ahd exhibition commision ( who own the land under swamp stadium) have a similar policy with the stadium, if you have a camera with a zoom lens it isnt allowed bc of ' terrorism'. Given that public info is readily avalaible, both are stupid.
