no one has perfect memory especially after such a terrible event. you really can’t blame the victims, it’s a horrible thing that he lost sixteen years of his life. He should be heavily reimbursed, and I understand why you would want to pin the blame on her, but this whole thing would have been avoided if the justice system, not the victims had taken more time to correctly identify him. he did nothing wrong he’s a victim of the unfair practices of our justice system. And she’s still a victim of rape. Hair DNA has been found to be one of the LEAST correct forms of identification. She may have thought it was her rapist but the system made the mistake not the victim, the man is a victim as well possibly more of a victim than her, in some cases but that doesn’t mean you should blame the person who was raped. It’s the systems fault for using an outdated way of identifying someone. Sorry for the essay

Here’s the thing. She truly thought he did it. Apparently he looked a lot like the guy who did rape and beat her. She went to the police and I presume the hospital and did her best to identify the rapist. After that happens, it is up to the police to and district attorney to investigate the facts of the case, decide whether there is enough evidence to determine if he is guilty and can be proven guilty, and to make their best case if that is what the evidence shows. And it is up to the defense attorney to make sure he gets the best defense available to advocate for him, minimize the chance that an innocent person will be sent to prison, and if he is convicted to make sure sentencing is fair. She wasn’t being malicious. Plenty of witnesses accidentally misidentify the person who committed a crime. If someone is convicted solely because of an identification-if the victim and perpetrator don’t already know each other, of course-then someone didn’t do their job. Another thing to remember is that they didn’t have DNA testing back then. The best they could do with blood and semen was determine someone’s blood type. I feel bad for them both-him for losing such a big part of his life and having to deal with a decimated reputation, and her for how horrible it must feel to know your mistake cost someone so much for so long and realizing that the person who actually did it is still out there and she will never know who actually did it or get any justice.

After the assault, she had to have surgery to repair the damage that the rapist did to her--he literally ripped her open by violating her with his fist as well as raping her. I don't think she realized she had the wrong person. It sounds like she was young and hypervigilant after the assault, was in the area and her brain made a connection to someone who looked similar. Our minds don't always have great memory of traumatic events. It was up to the prosecution process to make sure that her story added up to connect to this man in particular... they clearly did not, if a man reading her book could figure out that it didn't match.

(She did get r*ped, and she was a victim, but she couldn’t correctly identify the right person. It’s a mistake, and I definitely think this guy was a victim, but we also shouldn’t paint her as a bad guy, if anything it’s the legal systems fault.)

Excuse me? No, the police should apologise. Ms. Sebold didn’t even identify this poor man in the original lineup - it was the police who chose to pursue him. Witness testimony and identification is notoriously untrustworthy and should only be relied upon as a last resort as evidence, however it is ultimately the police’s responsibility and the responsibility of the judge to use their expertise to determine the real perpetrator. How dare you put the full responsibility on an 18 year old girl, instead of the trained adults who should’ve done their job properly instead of racially profiling a young man.

Over here in Europe people get compensation from the state, but the amount is ridiculously small. He should get compensation from the state and compensation from her. I don't necessarily want to make him a rich man as that might actually come with lots of negative aspects, but I want to have him lead a good life without having to worry about money, especially since he's already 61 years old. Plus, I'm pretty sure as a successful author she could pay him a good compensation without it pushing her into poverty.

She fully believed it was him who raped her she didn't falsely accuse him simply out of revenge like most false accusations. Her rape was so traumatic she needed surgery. She wouldn't remember the events properly, the authority around her pushed her towards the wrong guy not even bothering to questioned her mental wellbeing. The system failed miserably here. All they had was a failed DNA system and her broken memories. If they had worked longer with her they probably could've imprisoned the right guy but were just lazy. The author believed in the authority around her and didn't questioned them. Its similar to the Milgram experiment. In the experment 65% of people essential believed in "authority" which would've killed the subject had the tests been real.

Your mentality is harmful, the truth is that she wasn't entirely sure it was him but she decided to go along with it just in case it was, and that is a terrible thing. She didn’t lie about the rape. If you read about the case and how he was exonerated, the producer said he believes her story, the rape but it was the trial + investigation of the case. The prosecutor manipulated the lineup…read about it yourself. It was a horrible mistake that can’t be undone, but I will never disregard the traumatic experience of what a rape victim goes through. No one won here, everybody suffered due to this case. The victim (who went through various tribulations due to PTSD) the horror that comes with that forever and the falsely accused…who had 16 year taken from him. I blame the actual rapist for all of this and the people who manipulated the justice system.

@@KatiesArabVision She may not have lied about it but at the end, she still lied about an innocent man and did NOTHING to try and correct herself. The reason she deserves no remorse is because she had YEARS, to try and correct herself, but never did, and even is hurting other women by letting the actual criminal roam free. Even here she never chose to take accountability, because she dared to say "I'm sorry for what happened to you" like she was not the main cause of it; she's a writer, she knows what she's doing. That is disgusting. This also hurts future victims because now people will not believe them right away and ask for prove, even if there isn't any and make them more not willing to talk. This women, along with those who tempered evidence, is part of that problem the moment she chose to never speak up and let an innocent man rot in jail where it not for the producer. She is a victim but she is not guilty free. (This coming from victim as well; I felt remorse but the moment it harms someone else, no more. You can be both a victim and the problem.) I may be harsh but it's because this a serious topic, that unfortunately has to be one way or the other.

Everybody, don’t jump to blaming this woman. She’s a victim too. She was raped when she was 18!! She thought she found her rapist. Look at why this man was exonerated…it’s clear as day that this man should have never been convicted of the rape. She identified a different man in a lineup, for Pete’s sakes! Wrongful convictions happen for many reasons. Inadequate defense is a huge reason. Eye witness testimony is not reliable. There’s studies about eye witness testimony, proving how unreliable it is! Especially if you have a traumatized victim. So this woman wrongfully accused this man. But at the time of the accusation, she truly was sure he was her rapist. She did not intentionally send the wrong man to prison! . It’s not her fault that she got it wrong. Does she owe him an apology? Yes. It’s the right thing to do. But is she the only or even main reason he spent 16 years in prison? Nope. Police surely screwed him over, prosecutors screwed him and his defense. They all owe him apologies. The justice system failed him. But it failed her too. Because now she has to live with the fact that she put into motion the destruction of this man’s life. She also now recognizes that her rapist is still out there. Free. Stop the hatred of this woman. She deserves compassion.

She may be sorry but she definitely does not regret it. His conviction allowed her to feel free, to feel like justice was served, and cleared her head enough to write a best selling book. It’s possible her career may have never taken off if this man wasn’t convicted. Her success came at the expense of an innocent man. Would she take back her best selling book? Would she take back her 16 years of freedom and trade it with this man? Nope she would not. She has made no effort to make amends either. She’s just glad somebody got convicted for her.

@Yeshua Is Lord no she pointed someone else out but the cops told her she was wrong and led her to convict this guy. They had a DNA test that was unreliable. The judge should be blamed as the evidence was a fragile mind of a traumatic teen who was manipulated by people she trusted, and a useless DNA test. There's a reason the guy is forgiving her and not the legal system. She was controlled in her most vulnerable state., and the judge didn't care enough to questioned the evidence. He deserves an apology and money from the legal team that did this.
