What did she do that makes her trash? He instigated from the very first thing he said. He didnt even introduce himself, he just demanded she roll down the window and when she asked why he started immediately scolding her like a child saying BECAUSE I SAID SO. Thats not how a human talks to another human who did nothing more than stop over the invisible line at a stop sign. You must be going through some similar trauma as this officer if you think him threatening to break her window within seconds of the second stop is reasonable. Calling her a criminal and asking if shes a sovereign citizen when she did nothing to protest anything. Absolutely ridiculous. Keep propping up the police state over minor traffic infractions that caused no harm to anybody. The fact that you call her trash when she was calm, cool and collected the entire time as opposed to the officer who lost his sh*t from the beginning speaks volumes about your attitude in life. Its likely that youre the trash and youre just projecting that on people that make traffic mistakes.

She escalated by refusing to do what he asked (which he was well within his rights to ask) She was the one who pulled past the stop signs, she was the one who didn't have her registration, she was the one who had expired plates, she was the one who sped off doing 55 in a 25 in a school zone. She also escalated it when the officer told her why he pulled her over, she disagreed with him even though he has it on video. She further escalated it when he had she refused to roll down her rear window. Further escalated it by looking for her insurance while the officer was asking for her license, and he had to ask for it too many times. She continued to escalate it by arguing that he couldn't make her get out of the car (which he can, he doesn't even have to give her a reason - USSC) Every word out of her mouth was escalating the stop. If she would've gone along with everything the officer said after she stopped the car the first time, she may well have gotten off with a single ticket. Once she gave him a hard time, he wrote her a ticket for everything she did wrong. Then instead of fighting the tickets in court she decided to drive over 2x the limit and thinks the officer is doing something wrong when she's arrested and car is towed...

Her correct answer was, "Okay," and do it. Any person, with average intelligence, would know so the officer can see if anyone else is in the car. Also, having too dark tint always is a red flag to me. Normally, those cars reek of weed and are horrible driver. What are you trying to hide. I have the legal tint level to keep heat out in summer on black car with black interior.

"I know my rights" no, you don't. "You can't do that" yes, he can. So many people make it so much harder than it needs to be. Now her car is impounded and can't be released until her husband gets out of jail, whenever that may be, since he is the registered owner. Just follow the officer's commands, and you may possibly even be let off with a warning! I've always been polite, made good conversation, and try to joke with any officer that has pulled me over. That has gotten me out of so many tickets! Just being friendly and nice goes a long way.

Cops used to stand up for something, hold their own and take the high road every time. In my experience, they just haphazardly pick a law, write a ticket or book em and then go about their day. They don’t bother showing for court, they aren’t apart of the community, and some are just plain sadists. Obviously this isn’t all cops but i think there just isn’t a lot of respect to go around anymore.

It's an alternative to Jail. It's definitely a consequence. Judges give them rules to follow if they don't they end up back in court. It cost money to help urself out of trouble. Some people don't learn and end up in jail.

Also, I bet that was the sentence because the other parent is already in jail and the children don’t deserve to be punished for their parents poor decisions. She got probation for 6 months (which is a long time, longer than she probably would have been in jail for misdemeanours) so her children don’t have to go into the foster care system.

Search incident to arrest (SILA) is a warrantless exception. Police officers can search the car with or without the suspect's consent.

They have to have probable cause. They can inventory the car if they are having it towed.

Inventory search is another warrantless search, which doesn't apply here. They have to probable cause to believe the vehicle contains an illegal item or contraband if the illegal item is not in plain view. Look it up!

Anything they find will be thrown out. Bad search. Unless the vehicle was directly related in the crime i.e. plain view of drugs or open container. Inventory search is just for valuables In the vehicle when towed. It's why u can't search the glove box if it is locked. That's how I understand it and that's just for MA idk about other states

There is no more search incident to arrest of the vehicle. That's Gant v. Arizona. They can inventory the vehicle before they impound it, which is much the same thing.
