It's about interpretation you fool; pragmatics. The EU already failed at the semantics. Were does the treaty state the clear construction of a 'sea border' - it doesn't.

@@adarkimpurity of course it is not mentioned anything about a sea border. However custom checks between NI and GB are clearly mentioned. And this is what BJ signed ("oven ready deal" remember?) and this is what BJ complains about, now.

@@edojaalexander I am sorry, won't work. If no (or less) checks are in place, a company can buy any goods in England, transport them to N.Ireland, repack the goods and sell them to any EU country without paying taxes. EU can't accept that, sorry!

@@themightycat7238 This isn't an internal matter. The only reason the UK government signed up to the protocol is to protect peace by avoiding a hard border with Ireland. If the EU is unable to understand that and continues to be inflexible by creating a hard border with the UK it's there incompetence. Every one agrees that the EU is being overzealous. Just admit the EU is damaging the peace process

@@colonel.halberstern5893 The EU could have just put up a wall at Ireland/NI if they wanted to stir up trouble. The UK entered and "excellent" contract (Boris Johnson) and now wants to just not do their part. This was all foreseeable. The UK either didn't read the contract we spent hundreds of millions on negotiating or the UK is just extremely incompetent. FPTP is a joke. We need electoral reform.

Life would be sweeter for the Tories right now if May had lost to Corbyn. The Tories wanted to lose, but their voters proved mindlessly loyal (again). If Corbyn wins, either he hilariously carries on with Brexit, or, he calls Brexit off, meaning the 2016 referendum didn't count! So, it was to be a lose-lose situation for Labour. But no. Conservatives must clean up their own mess.

Johnson and Frost were so happy with the Withdrawal Agreement that it didn't even warrant detailed Parliamentary scrutiny. They just now need to get off their backsides and implement it properly instead of spouting all of this crap.

You can't sign a mortgage agreement and later say you don't want to pay the installment. UK government signed just 7 months ago the NI protocol and doesn't want to implement it.

We did see this coming, boris is just doing whatever short term solution he can. The short term problem was brexit going on too long, so he made a short term solution that's now causing problems with unionists. Being honest it is the government's fault for signing it but at the time the protocol was never going to work and all sides should have seen it. It's not been 20 years since the good Friday agreement that stopped the violence there and as I it looks like it's heading that way again. I'd prefer we broke the agreement then for goodfriday to be broken and people to die again.

I am asking myself if unicorns would be impossible to breed with modern DNA technology. After all there are animals with horns on their forehead. Certain genes must be responsible for that. If you could implement these genes in a horse you might become a unicorn ;-).

I completely agree and if they happen to be found violating human rights in the process of trying to solve the problem and America maybe is paying attention for once and the UK ends up with major Tarifs and Scotland and Wales end up leaving and they just end up with England and NI and then England sees a major population decline do to everyone, besides the awful Nationalist leaving and England ends up just as destroyed as Ireland, the Irish will finally get their due revenge for centuries of oppression and genocide, by an incompetent and insane upperclass that has been holding on to power for far to long. Let’s just hope that only the ones responsible suffer.

The majority voted for the Brexit and the "Northern Ireland problem" was discussed to become a big problem back then. At least from one side. The EU said from the very beginning, that the integrity of the single market is a red line. So they must either be border checks or you join the European Economic Area (EEA) - meaning you must enforce EU legislation that you can't influence anymore (that's what Norway is doing). So please don't blame the EU, who just demand that you keep the contract you (aka the Government you voted for) signed literally month ago. Also known as the "oven ready deal".

Or the UK refuses to do either and leaves it up to the EU to do its own border checks. In the long run the integrity of the single market is the EU's responsibility to solve.

@@SurmaSampo This situation is solely because of the Good Friday Agreement between the Republic of Ireland and Northern Ireland, that makes a physical border between both of them impossible. This is not the EUs fault, there isn't even a signature of the EU on that treaty. By leaving the EU, the UK has to provide a solution for that problem, not the other way around. The EU didn't create this problem by any means, but the UK did create it by leaving the EU. So in order to leave the EU, the UK had to create a solution, which they did by writing down the Northern Ireland Protocol (after rejecting Theresa Mays "Backstop" solution earlier), which became part of the Withdrawl Agreement and which was signed by both sides. This current issue also isn't a question of survival or anything important like that. NI gets everything they want and if supply from GB can't make it across that barrier in time for some reason, these supplies can easily be sourced from the Republic of Ireland or the EU. It's solely a problem for unionists, because it collides with their ideology and for businesses in GB, that have slightly worse access to NI. Nobody gets hurt by this solution. I believe this is a good compromise after all.

Using article 16 it can be suspended, we built a clause in for incase the EU decided not to amend. This clause wouldn't break the britsh law as it was built into the law itself.

The truth is, the government signed the deal due to immense public pressure. Brexit was dragging on and results weren't being seen in negotiations. So we took the best the EU would give, hoping for later amendment should issues arise. It probably is the best deal we could've got, but it does have some flaws such as the situation now developing.

Firstly, it's a bit unfair/misleading to say the EU is "fighting" - it's more the case that the UK is trying to provoke a fight, and the EU isn't having it. As for what's going on, it's simple. The UK set itself stupid deadlines, mainly because of PM Boris Johnson - having been elected PM based on claims of oven-ready deals, and getting Brexit done, he didn't want to miss any more deadlines. Additionally, the UK side of negotiations appears to be quite incompetent. The EU got a reasonably good deal (for them) - not as good as keeping the UK as a member, but that was out of their hands. And this was concluded within the UK's deadlines. It was, of course, not very good for the UK. The "backstop" that Leavers hated had been replaced with Boris' new approach. However, despite this essentially being the reason why Boris was elected PM, the Tories were elected to power (with a landslide), and Lord Frost was able to get a deal before the end of last year, the UK now has decided the negatives (which they were warned of, especially by the Remain side) are now too unbearable. Of course, from the EU perspective, the matter is closed. The fact the UK doesn't like the deal the UK signed off on really isn't the EU's problem. And Brexit really isn't that big a deal to the EU - at least not on the scale it is for the UK. From their perspective, they managed to close Pandora's box, so there's no need to open it again. There may be a few minor issues to address along the way, but there's no reason to reopen - and basically restart - discussions (that took several years to conclude), simply because the UK was too incompetent and impatient when they had a change to negotiate.

Remember the UK government saying the EU would budge last minute in 2019? it starts to look more and more that the December breakthrough was actually the UK government realizing the EU was going to hold her foot down and have been planning on how to get out of aspects of the deal after ratification. Firstly moving deadlines unilaterally and now the threat of removing the Northern Ireland Protocol, forcing a game of hot potato with Northern Ireland in preserving the Good Friday Agreement. This is downright reckless and doesn't help the UK's image internationally. It honestly looks like the EU is the only party involved in trying to keep violence from erupting again and the UK is adamant on making it happen.

If no deal was agreed upon they would be forced by internal law to send Frontex to guard the border of Ireland, thereby nullifying the Good Friday Agreement and restarting the Troubles. Instantly making the EU the party that broke the Good Friday Agreement. I can guarantee that this topic is more important to the EU then the sausages, for the EU it probably is as important if not more as the level playing field.

The EU wanted to negotiate, GB agreed, the EU agreed and now they are back paddling because they don't like it? Don't you see how that is just stupid? The UKs problems are not the responsability of the EU. The EU has a single market which it has to protect. The UK doesn't want to be part of it so we need hard borders. The fact that this is hard for the UK to accomplish without upsetting anyone is not the EUs fault.

International trade requires a customs border between different economical areas. So there has to be one ! The UK chosed to leave the EU, so it is mandatory that between the UK and the EU has to be a customs border. The logical location would be between NI and the Republic of Ireland, but because of the Belfast agreement it is (nearly) impossible. So the UK and the EU negotiated on the dilemma CAUSED BY BREXIT, found a solution BOTH SIDES AGREED TO and that's it. It is the UK that undermined the agreement (NIP) from day 1 by not implementing the necessary customs checks they agreed to while fanning protest in the unionist communities in NI. The UK created the dilemma ! The UK signed the protocol ! The UK did not implement the checks they agreed to ! The UK fanned protests in NI instead of calming them down ! Why the hell should the EU give up it's sovereignty and put the value of their single market at risk for the sake of an absurd political adventure by the UK ??

As far as I know NI is still part of the UK and not the EU, so the violence would be more problem of the UK. @@Temo990 that's exactly what I'm saying. If we just implement the agreement as signed there will be violence in Northern Ireland eventually. It is inflexible to just implement it, that was a stupid comment as it just described inflexibility. That being said we shouldn't have signed it. But the EU wouldn't have it any other way in the Brexit negotiations and essentially tried to use NI as a bargaining chip saying you either stay or NI will be affected. You are also right this is the UKs problem as violence will be in the UK. So don't be surprised when they act unilaterally to keep peace. To keep peace in NI either the UK acts unilaterally or the EU are more flexible. We would prefer to act with the bilateral agreement, but will do so without the EU if needs be.

Well, that sounds reasonable if both sides don’t accept the deal. The whole point of negotiating a deal is to reach an agreement that both sides accept. If one side decides not to accept the deal, then it has clearly not got the support of both sides anymore, and should be renegotiated. Deals should have to work for the entities that sign them, not the other way around. With phone provider contracts, you can just cancel them whenever you want to, anyway, which is not the case with the Northern Ireland Protocol, so that analogy isn’t a good one. Anyway, the contract is often made clear beforehand, with little ambiguity, and you can just switch phone providers if you want service. With the Northern Ireland Protocol, there was no easy alternative for getting a deal signed, and, because there was also a time limit, there was even more pressure to get any deal signed. One side should not have to suffer for the decisions they made under different circumstances, if they eventually come to regret it. Your argument’s logic could be used to justify never allowing another Scottish referendum, and could be used to justify never reconsidering the Good Friday Agreement with the Republic of Ireland, despite it being signed under different circumstances.

technically you are right here but the NI - GB border HAD to be placed somewhere. And the good friday agreement specifically says that there can never be a border on the island of Ireland. Meaning no hard border on the land it self, this is why they chose to get around this by putting the border in the sea. But this doesn't mean that checks don't need to be done, as they do. And the fact that their are checks between NI and IRE means there is a hard border on the land it self and not in the sea. This is why the Irish are so angry, and the fact that other countries like the USA are totally against making a trade deal with the UK as they have conflicted with the good friday agreement. But yes Boris did say there is no border, but he HAS to say that. Because if he agrees there is a border weather it be on land or in the sea it still means there needs to be checks within the country it self. Meaning it totally pisses on the GFA.

@@Fezzy976 The sea border does not violate the GFA(Good Friday Agreement). In fact, its the only place you can put the border that doesn't violate it. The EU is a customs union (also referred to as the 'single market'), meaning that goods, people, and capital can flow freely from one member state to the other. To achieve this, the EU has a uniform set of rules and regulations on goods/services to ensure quality across the entire customs union. Additionally, to promote trade amongst the member nations, they promote domestic European industry at the expense of foreign industry (subsidies for domestic industries, tariffs for foreign industries). So, the UK votes to leave this customs union, mainly due to fearmongering about the free flow of people into their country. This means that the UK now controls its own regulations, but it loses access to the single market and the trade deals that the EU signed. Problem is, the Republic of Ireland is apart of the EU and it shares a land border between Northern Ireland. According to the GFA, Ireland nor the UK can impede the free flow of goods and people between the Republic of Ireland and Northern Ireland. This effectively makes it so that if you want to sneak goods into the single market without passing EU customs checks and conforming to their regulations, you can just ship them through NI into the ROI and to the rest of the EU. Consequently, if you want to get into the UK, you can get in without any passport/visa through ROI to NI (something which negates the whole point of brexit). I am aware that you probably know all of this, I am just clarifying for the whole situation for anyone else reading who is confused. To summarize, there are now two markets that are right next each other, so a border needs to be put somewhere. It can't be put between NI and ROI because that violates a previous agreement, so what do you do? The only other option is a sea border and leaving NI in the EU single market, no other way.

"who's in the right" isn't even a difficult question, and can only really be a question if you're too ideologically pro union and anti EU to see reality. Of course the EU is within the right. There is a super simple question: Given two different trade areas, where does the border go. Ireland (EU) is one area, the UK is another. Normally there would be a border between the two entities, but because of other political and geographical circumstances there could instead go a border between the islands of Ireland and Great Britain. But the border has to go somewhere. So either you make it so that there aren't two trade areas by unifying them somehow (Like some sort of union of European countries) or you decide where the border goes. The UK has said that they don't want to be part of the trade area, but that they also don't want there to be a border. It's like a child being mad that the candy they ate is gone.

It is interesting to hear the way you describe this issue and it makes me wonder if all English people see things this way. It would really help you to get perspective if you paid a bit of attention to the way this story is being covered in other countries. If you want insight into the complex politics of NI, Susan McKay is a journalist who has been reporting on contentious issues since the Troubles and she is a great source of information. Firstly, nobody is having a "bit of a tiff". The negotiations are over, the deal has been signed and is now international law and UK law. There is no need for a tiff. The EU stands, as always, ready to be accommodating and pragmatic within the confines of what has been agreed. Secondly, nobody other than the UK government and the DUP is saying that the problem is caused by the Protocol. The current problems are as a result of Brexit and the problems are more acute because of the particularly hard type of Brexit the UK government and the DUP pushed for, so it is difficult for anyone to genuinely feel sorry for them. Thirdly, there is nothing unsustainable about the NI Protocol. The vast majority of the people of NI want the Protocol to work. NI voted to stay in the EU and most people are just getting on with making the best of a bad Brexit. The tiny number of people who are really objecting to the Protocol are rapidly becoming irrelevant in NI politics as they are overtaken by the modern world. Fourthly, if the UK really wants to solve the problem it will agree to the necessary SPS agreement. The reason that NI is undergoing so many checks is because of the type of Brexit the UK chose. GB is experiencing exactly the same problems. It's not because of the Protocol. It's because of Brexit. Fifthly (sorry, I'm getting a bit carried way), this nonsense about Article 16 is a bluff and everyone knows it except the readers of red tops in England. There are no legal grounds to invoke the article, as nothing that is happening was unforeseen and that is easy to prove given the volume of material that was written on the subject. If they decide to go down that route they will only be further breaking international and UK law and leaving themselves open to legal repercussions at home and internationally. They have backed themselves into a corner and the only way out is for them to calm down and start behaving like adults. Brexit is over and they got the deal they wanted. Enough of the unicorns now.

Brexiteers need to grow a backbone and take responsibility for the outcomes of their decisions. Stop blaming everyone else for the mess you've made and own it. If this is the price we pay for "freedom" then say so. Say you were willing to sacrifice the politics and economy of Northern Ireland for the sake of English sovereignty. You say this as though sovereignty is a negative thing... the issue is not with the agreement, it's with the EU's determination to deny any renegotiation or amend in the light of issues surrounding the protocol. If anything this offer of negotiation is a precursor to the activation of article 16. If the EU will not negotiate the clause will suspend the protocol to safeguard the trade between the nations of the UK.

Morally? Not really. The EU is deliberately creating issues through lack of mobility to cut out a very limited risk to its single market. Not very moral, it's preventing a negligent risk to its economy while possibly creating the conditions for a 2nd troubles. I fail to see the mortality in this exchange.

It may not be the STRONGEST criticism, since it is directed at his character rather than his actions or policies, but it is NOT an ad hominem fallacy. If you had said "BoJo cannot possibly be a decent prime minister, since he's had three marriages and that makes him a bad, unreliable man," then THAT would have been fallacious ad hominem -- basing the ground of the argument [BoJo is a bad PM] on the claim [BoJo has an unstable marital history]... BUT if you claim "BoJo has a history of failing to understand commitments and honor his own word" and then use his three marriages as evidence that he, on a personal level, has historically failed to honor his own marital arrangements, then that is an appropriate use of objective evidence [BoJo has had 3 marriages] to support a subjective claim [BoJo as a person appears to be unreliable and willing to go back on his word/agreements], and then from there make a statement on his performance in the role of governmental leader [since BoJo as a person appears to be unreliable, it stands to reason that he will lead his government in the same way]. The Conservative Party don't care about unionists having trouble in NI, they want their political golden goose of BREXIT to keep winning them elections for as long as possible. We will continue to see more and more friction between the British government and the EU, because it is politically expedient for the government. International politics is always governed first and foremost by the domestic interests of the negotiating parties.

You have to put in context why 20% of checks (estimated by NI executive) are in NI. There's a logical answer and it is important ot provide it, instead of assuming its implication that "it's too many checks". The type of flows through NI explain why there's the need for so many checks. Please, add it, and don't take political spin for facts. Reducing checks is not supported by facts at the moment. Risks to Single Market (which means, possibly an EU baby dying because of under quality products sold through NI/GB) is not insignificant.

But there is one way out of this: Irish reunification. Then you have a hard border between Ireland and the UK, the latter of which can be left to squabble on its own. The Unionists in NI can leave or stay, it makes no matter. There never must be a hard border between NI and the ROI.

Basically the north of Ireland has the best of both worlds in this situation. But the DUP insists they have it much, much worse.

Well its very likely that Northern Ireland will join the Republic or Ireland in the long term if the have a border between the UK and NI and the older voters die off. Edit: And who wants to blame them? Thats the easiest solution everybody can stay there, they have no border, they have freedom of religion so thats not really an issue. I guess the sentimental old people just don't want to give the idea about being brittish up

No it doesn't. We have to abide by EU rules despite not being in the EU nor having any say in the said rules. We're a semi-colony.

@@lukas081559 You mention that Ireland has freedom of religion as if religion is the main problem when it's not. Further, it's not simply out of sentiment that many people here feel they are British. We *are* British, and still make up the majority. We're proud of our heritage and history of serving the country in its wars, for instance. We are loyal to the monarchy. It's not even just about identity though. Ireland doesn't even have a proper NHS-like system. It doesn't have Personal Tax Allowance either. I doubt it would be able to pay for our large public sector. Furthermore, too many people resent us there anyway. It's not ready economically or socially to take on Northern Ireland, even if we did want it.

As a NI citizen i definitely agree more with the EU. Another border in the island of ireland would be a fucking stupid decision. Especially when i live close to the border. It would cause more problems than it would solve. Anyway i dont even see why border checks in the irish sea is such a bad thing. NI would still be in the UK so why are they getting so mad about it. It makes such little sense.

From what I understand, certain Unionist parties say that NI shouldn't be treated any different to any other part of the UK. So they won't agree to an Irish Sea border 🙄

I’m American, I watched a 10 minute video about the options were for the metaphorical wall for people and goods before the 2019 election, and it was apparent that there was no option that would just “Get Brexit Done.” The endgame is the Good Friday agreement is untenable. USA, as guarantors of the GFA, is going to have to pick a side on who broke what. Such a mess

Quite right. And Joe Biden has already indicated his sympathies to Ireland and upholding the GFA. He is not pleased with Johnson's childish conduct so far.
