They were toys first and Rom's comic(Yep) was supposed to promote them. The rights of the character's and some words(like Dire Wraiths) eventually passed to Hasbro, but "his villains, setting(home planet), and supporting cast were all created and owned by Marvel", so IDW had to invent their own when they made their own Rom series and crossovers with other toy franchises.(and why Rom has a page on TFwiki from were I took it all from). Rom himself doesn't appear in Marvel anymore, but Space Knights(and Dire Wraiths) still exist in universe and get metionated ocasionally, and one got recruited in the Annihilators a team of "cosmic heavy hitters" by Quill in a miniseries.
