In DK, there actually is a visual indication for when the hammer will wear off-it starts to flash yellow for a brief period before it goes away completely.

@@Demeech In all honesty, I wish Nintendo focused more on shutting down fangames that are purposefully crap (like Crazy Kong and other bootlegs), or fangames that are purposefully taking people's money (Super Mario RPG 2 Kickstarter); rather than fangames that are just made for fun (like moderately good sprite swap romhacks) or fangames that are non-profit and put effort into it (like Mario Forever). Besides, without Mario Forever (and Mario Worker), we wouldn't have Mario Maker.

Imagine if Nintendo did something similar as to what happened with Sonic Mania. Their community is so creative and talented when it comes to rom hacks and fan games and its a shame how they always go against it because they only see it as pirating their ip.

Donkey Kong surprisingly has so many lawsuits. First this Universal VS. Nintendo claiming that they infringed on King Kong, which they never owned in the first place. Then there was the Crazy Kong lawsuit. Finally, there was the lawsuit with Ikegami Tsushinki after Nintendo broke the agreement and reverse DK to make DK Jr.

You cannot forget the lawsuit that Universal Studios filed against NOA for copyright infringement. When the lawsuit was filed, the production of the cabinets was stopped, the Saturday morning cartoon by Ruby-Spears was taken off the air, and all merchandise had to cease production. It was a big deal. Universal Studios claimed that the story of DK infringed upon the story of King Kong. You know, a big gorilla snatching a girl and carrying her to the top of a building. At the time Nintendo was a relatively small company here in the States, and Universal knew this and thought that they had this lawsuit in the bag. Their overconfidence did them in. NOA's lawyer, John Kirby, discovered that Universal Studios had let their copyright of King Kong expire in the mid-70s. This cost Universal Studios big. Every company that produced DK merchandise had to be compensated, and CBS had to be compensated for the loss of ad revenue (the cartoon was on their network) But it was Nintendo that Universal Studios owed big time for complete loss of revenue because of the lawsuit. On a different note, Nintendo paid homage to their lawyer, John Kirby by naming that little pink puff-ball that likes to inhale things after him. Mr. Kirby was even presented with the very first copy of Kirby's Adventure for the NES. From what I remember, as soon as the copy was shrinkwrapped, it went straight to him. Just think, if Mr. Kirby had not discovered what he did regarding the expiration of Universal's copyright, one of Nintendo's beloved characters who has been in a multitude of games would have never of existed.

Turns out the origin story of why Nintendo hates fangames is basically like Adam and Eve. Falcon had one rule to follow and chose not to do so and affected Nintendo fan projects as a whole. Sega is basically Jesus since you can make fangames and fan remakes as long as no profit is involved. Basically this just gave "Christian Sonic" a reason to exist.
