They aren't immune to the Founder Titan, Mikasa and Levi were in the Paths. They can't become titans because they're already partially titan, i think they were persecuted because, as they had no memories, they simply stopped to protect the King, and some past King knew of their strength and was paranoid they would kill some Reiss or nobles. Or, like Levi and Kenny, their strength made them stand out in crime, and they were associated with that.
