Misdemeanors are just illegal for poor people. So they rake in the cash and pay a small fine.

Not always. Usually just means a year max in jail. And if not fines it would mean a lot of petty offenses equal jail time.

@@henrylam92 you still got to go to court to rule a fine must be paid in the first place. And I have the feeling if told to pay a fine instead of jail, even those who complain about fines will take the offer.

@@kstarr3555 I’m not ignorant to the fact that a fine for a person making minimum wage is vastly different than a person who’s a corporate manager. But what you propose as an alternative? Jail everybody even for minor traffic infractions? Heck half the them it’s not the fines themselves but how they are collected. John Oliver did a segment on municipal fines which showed a lot of small towns outsourced fine collections to third party companies who jack up the total amounts with fees and interests. There were times the offenders did have the money to pay off the fine but found it all went to the fees and interests and never to the actual fine half the time.

a man from long island back in 2011 was arrested for selling tickets for a raffle for a house ! This guy held a raffle, offering 30,000 tickets at $50 apiece, with a drawing scheduled . the winner would own the property lien free, without mentioning the foreclosure proceedings and the $1 million lien on the property. charged with Scheme to Defraud in the first degree and 21 misdemeanor counts of Petit Larceny.

Easiest way to collect a bag while thinking you're doing something good. Influencers have MILLIONS of followers. Put a car up for 50k an you get 200,000 people putting 10$ in. You collect 1.95m the 50k goes towards the car to pay it off an u give it away .

There are a lot of giveaways I see like this and I’m always like its super illegal, I believe it’s even illegal to make someone sign up for something to do giveaways.

I've never seen any of these automotive KZbinrs that do regular car giveaways select a non-paying participant. They all offer a way to enter for free, but often have a website selling shirts, Keychains, etc. And when you make a purchase you get "X" amount of entries per $10 spent or something similar to that. And every single time they select a winner, it's only ever won by a paying/purchasing participant, it's never one of the "equally" qualified free participants. They don't want to openly push and promote the ability to enter and win for free, so of course it feels like these guys may not even be counting the free entries. It's all very screwy. It's not just a legal dilemma but a moral one as well

I completely agree, and the thing is, they know this too. They do it all behind closed doors and in a way that if they ever had to show up to court, they could prove their case and probably win. Like if they use a randomizer to pick a participant, they could just keep randomizing until they landed on someone that paid. If that was ever brought up in court, they could just say it was a coincidence and it’s basically your word against theirs. They do just enough things legally to avoid being prosecuted but just enough behind closed doors and bad morals to make a quick buck off their scheme. Unfortunately, unless there is a crack down on these types of giveaways and more strict rules are put in place, they’ll continue.

There has been more then a few instances of free entries being returned to sender as none delivered.. The majority of them are scams. There's no over sight in the majority of them. I actually won a smaller prize off an online drawing and never received it lol.

In Brazil, that's totally legal, all you have to do is submit your giveaway with proper gov org. The actual lotery in Brazil is done by a government owned bank. (I have no opinion, good or bad about it, just a fact).

first brave advertisement ive ever seen. i don't have the VPN, however I've used the browser for nearly 2 years now. hands down best browser ever. don't get youtube ads, super quick. I've never had it crash or slow down. plus I've got $40 in bat just from using the free browser

Does anybody actually have proof from any of these giveaways, that the prize mentioned is ever received by a winner? Seems frequently, a friend of theirs down the road coincidentally was the winner when there was fifty thousand entries, has anyone ever actually met a winner of these prizes??? I would be more concerned of the scam that they are raffling away a $60,000 car for $10 an entrance and there's actually no car or winner at the end.

Yea unfortunately there’s nothing anyone can do to fix that either until there are more strict laws put in place. If anyone were to sue, it’s basically your word against theirs in court. All they gotta do is say it was a coincidence and as long as there is no hard evidence and proof of them lying then they’ll get away with it. Now, if they do many giveaways and the winners always happen to be connected to the one running the giveaway, maybe then you could make the case that they are not randomly choosing winners. I think the best thing people can do is just actively comment on these giveaway posts letting others know that there is a free option available and if the word can get around, then it’ll become common knowledge. Maybe then they won’t get enough paid entries for it to be worth their time and they will stop doing these schemes entirely.

These car scams are very easy to do. All you need is a buddy who already owns the nice car and select him to win from the beginning. Share some percentage to your buddy. Rinse and repeat. Infinite money glitch.

It absolutely amazes me that these kids continue to raffle these vehicles, as raffles themselves (if not for approved charitable purposes) are absolutely illegal. And these kids keep participating in them, and getting burned when no verifiable winner is ever shown. Organik did the exact same with a Lamborghini raffle. Would love for the law to catch up with all these guys in due time.

I would think probably not since subscribing to a twitch stream likely doesn’t constitute “significant expenditure of time and effort”. Now if the streamer said “only subscribers who have watched 250 hours of our streams can win” that may be a different story.

Only reason they do the “giveaways” is because they make probably very good profits from it. Plus it looks good for their reputation. I guarantee that of the winners none were the ones that entered without buying anything. Them giveaways have the same shitty smell as influencer nft’s. I’ve never looked into this but does anyone even win those giveaways ? I’d bet there’s more than a few that was never won.

This is literally how car KZbinrs stay afloat. They run giveaways while trying to be as legal as possible. Then produce some ass content, with ads for said giveaway through out.

I can’t stand these stupid giveaways. They are so scammy. I actively comment on them when they pop up on my feed letting people know that they don’t need to pay to enter. I guess they might not be fully illegal in some cases but they are definitely being as manipulative as they possibly can without totally breaking the law. Doesn’t change the fact that they are trying to trick people and I can’t stand tricksters.

Hodgetwins SWEEPSTAKE is just fine. Pretty sure it's ran by the same people who run the 80eighty sweepstakes, and they've been doing it for like 10+ years now. Cleetus McFarlands is also perfectly legal. However, the first guy in the video, his definitely does NOT look good.

This reminds me of the old coke and Pepsi bottle code contests. You enter the code under the little cap, and your code could win a prize all the way to millions of dollars. The best part they never showed who the winners were or if the prizes ever reached the winners if there even was any. But they advertised in tv and more people's bought their products because of it.

@@tgo007 I have won stuff too on the radio and other things but I remember these giveaways in Asia with beer and Pepsi caps. Pepsi misprinted some and essentially started a riot when multiple winners showed up and denied their price. Now Coca Cola is number one seller in Philippines I believe

@@TzUuup By taking this approach he is able to reach and speak to an audience of people who may be more susceptible to falling for these kind of grifters or cults of personality. Another benefit is he reserving making snap judgments of a situation and not sensastionalizing the topic bit still peppers in his biting criticisms. This is a more pragmatic approach and it also protects him from litigation and drama by not making statements of fact without all the facts or resorting to insults.

This is a big problem here in the Philippines right now. A lot of similar "raffles" are happening on Facebook. Even our local ebay type websites are flooded with "raffles". You think you're buying something, but actually you're just buying a ticket to potentially "win" that item. If you "lose", they'll send you a crappy item instead of what you thought you were ordering. Of course everything is behind closed doors, so you have no idea if you're simply being scammed.

I hope this gets 1 million views. Our own local Vegas resident KZbinr cjsocool tried this for a year and then stopped I assumed it was because of the Nevada State Attorney General Office because people were complaining. KZbinrs like cjon32s and coreyssg and so many others successfully make 100's of thousands of dollars off this and I wondered how they got away with it and they do these every single month. I always thought the law was State specific pertaining to whats a lottery, giveaway, sweepstakes or raffle this video was eye-opening. It's always a max $60K in value car and I have never seen them put up a Supercar like a Lambo (they wont). Now they are getting to a point where some are making up false winners or claiming the winner took a cash payout and not the car. Great video Spence

I once the read the terms of a free entry option and it was so incredibly specific that you can rest assured that over half of the entries if not more would be disqualified. It had stipulations like writing had to be in ink, it had to be blue ink, it had to be legible, it had to have 7 lines of information, any missing information would render entry invalid, etc etc etc. There are always ways people get around things

Task & Purpose created with a "give away" for night vision goggles, with every entry only requiring that you buy an overpriced mug. i commented under the video asking "doesn't this make it a raffle" ? and i got almost instantly permanently shadow banned. still cant reply to those videos. io hope it was sume green Admin and not Cappy him self.

They are regulated and watched very closely. The problem with allowing everyone to do it is that there’s no way to monitor if it’s being done fairly and people will just abuse it.

Lawyers run these same type of giveaways under the banner of a bar association which is non profit…but law firms also do it constantly. So the simple alternative is that these influencers create a non profit 501c3 based on what the lawyer said - therefore they are personally removed from it. You never see who actually wins most of these influencer prizes. Most of them I would bet are straight fraud.

informative video. I didnt know about the required free tier. I watch a ton of automotive channels who do vehicle giveaways and They give points away in exchange for merch purchased. I am 99% sure the big channels like cleetus mcfarland make like 30x more than the value of the car because he does massive merch sales and they string the giveaways out for months. Its a very smart tactic and I think it could be a really great revenue stream for up and comers in the music industry.

Im still waiting on $1000 from a twiiter poster. Wasnt a pay to play, but still saying $1000 to winning poster, and not doing, should be illegal. There are several influencers that do this just for clicks and not following thru, is false advertising even for clout.
