From a legal standpoint, the medical action or inaction of the police is irrelevant. The assailant is responsible for the ultimate result of the assault. On the other hand, this was a defense, not an assault.

Cops aren't EMT paramedics and generally don't render first aid to people. Because they have neither the equipment nor training to effectively save lives. But i believe they probably could have given CPR in this case if they had mouth shields

They could’ve still given him CPR is the thing that I don’t understand. I don’t know what they teach in First Aid training in the US, but where I live, they teach you that rescue breaths aren’t actually worth it anyway because if the heart starts, it’ll push the lungs to start back up etc. Plus the risk of getting something like HIV is decreased a lot etc. This man should not be dead, this hero should not be being charged for what I would say is negligent homicide on the cop’s end. It should be the responding officer’s on trial, not Penny…

Most recently, in NY, over the last 4 days: a man goes in a stabbing spree, unalives all of his victims. Yup, he was arrested & released many times. Second day: man shoots & unalives ppl. I live in Canada but this still applies. I’ve been attacked by a homeless man (who was drunk/high) before. I’m a petite woman and he was much larger than me. Despite lots of people around me just across the street- no one came to help. I was able to run away and he did not get my phone. It was traumatic to go through. Get these people off the street! I would’ve been so thankful for a man like this one to come help me that day. Let’s not as a society penalize good people. He did something clearly not many are brave enough to do.

Yep. Unfortunately, Daniel Penny is still very young and naive. In an effort to try to be helpful to police, he fell into the exact trap countless people have. He got too comfortable, let his guard down, and then they flipped the script. This isn't an accident, detectives are specifically TAUGHT to do this because it WORKS. What disturbs me the most is that I could seen any other marine, if put in Daniel Penny’s position, do the same thing. That submission hold is among some of the basics things we are taught, doesn’t matter if your MOS is combat related or not. To be honest I think he died from drugs and not having any real medical personnel nearby. If the police thought that he was breathing and had a pulse then why would they do anything like CPR? What else could they have done besides CPR? And it didn't sound like they were well versed in CPR. They would have needed something like Narcan. And the knowledge that they needed it. I guess I am saying that they should have tried to help more. But that I don't really think them not trying is what killed him. I think his own drug abuse is what killed him.

When I watch this story, all I can think of is the Seinfeld finale. Jerry, Elaine, George, and Kramer are put on trial for video taping a man who was being car jacked and not helping out. So many people were doing just this… taking videos of this disturbed individual as he threatened people on the subway, but took no action to stop him. Imagine if this man had not stepped up. Imagine if the deranged person had acted on his threats and killed people. Imagine the outrage we would have heard from the media as they ask, “why didn’t someone do something to stop this?” In this society, you’re damned if you do and damned if you don’t. My prayers are with this young Marine. May the jury have the sense to see this good man doesn’t deserve to go to jail for doing the right thing.

That medical examiner should lose her job! That is a sick biases and beyond unprofessional. How that testimony alone doesn’t get the case tossed is amazing. Not even counting the fact that clearly drugs were involved, in the interview he said he thought ppl were in danger, and life saving measures were not performed while the man had a pulse should be more than enough where this shouldn’t even be a case. Daniel Penny deserves a parade of thanks from New Yorkers and the key to the city with a big check from them for keeping their children, women and men safe that day. Then the medical examiner should be fired, then sued by Penny so that this "examiner" cannot give false and damaging witness in any other case in the future. Lastly, drugs found in Jordan Neely or the lack of CPR rendered to him or the combination of the two could have caused his death; made more pertinent as these conditions remained for last twelve minutes at the point of his death.

CPR is to pump blood for a heart that has stopped working. CPR stands for CardioPulmonary Resuscitation. If they have a pulse, CPR is not necessary or effective. If the person is not breathing, their heart won't be beating for long. If it stops, start CPR.

The defense called another Medical Examiner from out of state as a defense witness who testified that there is no way he died from the choke hold. Penny didn't even have him around the neck, rather over the collarbone and shoulder. This is a mockery.

Mouth to mouth resuscitation isn't even taught by the AHA any longer for CPR performed in the field by non medical people. All they had to do was reposition the person's head to maintain a patent airway until EMS arrived and could provide respirator support.

Video does not show the cause of death; autopsy does. She belied her own autopsy in order to facilitate conviction. She disregarded the fact that he was alive long after the chokehold ended. She downplaying the fact of the defunct was very high on drugs and the fact that he had no anatomical trauma to the respiratory tract. She made all these statements under oath. That's perjury, apart from being dishonest and unprofessional.

This trial is very similar to the Derek Chauvin / George Floyd matter. Floyd had over 3 times the lethal amount of fentanyl in his system which would cause his same problems. Decades ago I was at a military base where the son of a very famous person suffocated on his vomit. Officer Chauvin was using his training to prevent that by putting a knee on his back. The ME was forced to change the cause of death to fit the narrative of the press and politicians. The DA's office recommended no charges but the state AG pursued them. He is now serving 23 ears i prison and each officer at the scene was prosecuted. Some of the witnesses including the police chief lied under oath as was shown in the film "the Fall Of Minneapolis."

If anything, some blame should be on those officers who refused CPR. Completely understandable that they didn’t want to do rescue breathing portion of CPR, but they still could have done chest compressions if nothing else. Something is better than nothing. Unless they’ve changed that portion of First Aid since I was an EMT in 2018.

100%. Mouth to mouth is not required by law in my country, specifically because the person can have a variety of diseases that can be transferred that way. But chest compressions require no contact of bodily fluids. Failure to give first aid, even in the form of chest compressions especially for trained force like the police, is a felony here and should be like so everywhere.

It hasn’t changed. I just renewed my BLS and ACLS this year and it has been common practice for compressions only CPR for a long time now. Even in the hospital we only do compressions until we have a ambu bag available. The police had no excuse if his heart had stopped.

Fun fact from a HEALTHCARE PROFESSIONAL: if someone needs CPR, and you don’t want to give mouth to mouth, that’s actually OKAY. It’s more important to continue circulating the blood than it is to give someone breaths. So please never be a bystander because you’re worried about infections. Just give chest compressions and wait for EMS or wait until a mouth guard can be provided to you.

So, Ive been a paramedic for about 20 years. The current, and for several years now, the teaching of CPR has been taught and is recommended to be "hands only," unless you're a healthcare professional, with more advanced airway equipment. Which means, chest compressions only, for lay persons, including PD, and even professional rescuers who do not have airway equipment readily available. No rescue breathing, just chest compressions.

You can do CPR without mouth-to-mouth until EMS arrives with the Ambu bag. That is how we are teaching civilians, these days. I was a firefighter and then a RN for 25 years. Just circulating the patient's blood while waiting for EMS increases that person's chances of survival greatly.

They released a photo of the "victim" on the floor in the "choke hold". You can plainly see there is no pressure on the throat, it's all upwards outwards, locking his jaw and head. Penny did not kill him. However, I'll be very surprised if he isn't thrown in prison. At least for a couple of months. I suspect if he is tossed in prison, he'll get one of the fastest pardons ever seen.

This is happening everywhere in the modern world. Raise a finger at a criminal, and you're in a world of trouble. Courts will go overboard to pin assault or murder charges on you, no matter what. I've seen a million such cases, and I was involved in one.

It’s a similar situation to the incident in 2013 where a mass murder was subdued by a subway passenger and was stabbed 7 times while the cops watched and when the hero took them to court he lost because Judge Margaret Chan said that the police had "no special duty" to protect anyone on board the train.

Or if you do step in to help you run the risk of being stabbed 7 times and almost dying while two police officers stand by and do nothing because they had no duty to protect the passengers. That happened in 2013 on the NY subway. So if you step in you run the risk of getting killed and if you don’t get killed you run the risk of being arrested

I mean dude I get it, one should not get hate for saving and all but that doesn’t mean you should stop being kind and good, that's the difference between good and evil, hero and villain. Batman gets hates all the time from his people and his family for saving them but that never stopped him from caring and saving people. Even in real life there are many influential people that have git beaten and spit on, etc. The most common trait between them is that they Didn't complain or blamed the people who did it. They told they did out of misunderstanding, they don't blame them but the system that led them to believe it which is human error, forgiveness is divine. Nowhere does it say I refuse to be a good person, it says I refuse to step in to help others in situations such as the topic of this video. I am perfectly capable of doing good but your conflating that mentality with the idea I should step into a situation KNOWING the chances of me then getting into trouble for doing said good is above 99%. Because let me tell you there is many many more stories like this one out there. Men accused of the worst things possible after saving some dirtbags life but they're story wasn't as popular for some reason. If it happens once or twice, that's a coincidence, but as often as I've seen in the past 4 years alone is a pattern of behavior in both society and the legal system.
