Articles I and II should be declared unconstitutional if we follow the ruling of the US in Obergefell v. Hodges (2015) for violating LGBT people right to marry and equal protection of the law (being a quasi-suspect class.) Besides, I find it weird when Family Code Commission included homosexuality and lesbianism as grounds for annulment (psychological incapacity and fraud) as well as legal separation (discovery after marriage). I mean we LGBT don't have the right to marry other a same-sex person yet if we marry an opposite-sex person, we are still vulnerable to legal attacks. Family Code implies that LGBT people have no right to have a family and protected relationship anymore! This is outright discriminatory and oppressive. At the same time, marital infidelity (concubinage and adultery) is not included as a ground for legal separation and annulment. What does this law really imply? That marital infidelity and disloyalty are way better than homosexuality? I mean, I don't have any control over my sexual orientation yet it is my fault to become that way? The law should prohibit/punish the overt acts, not the orientation intent, or motives. Does it mean a gay person doing nothing is more criminal-like than a husband or wife doing s3x with another person who is not his/her spouse? Consensual homosexual conduct (gay s3x and gay relationship) is not even criminalized in the Revised Penal Code or other penal laws. Yet, the other grounds for annulment and legal separation constitute or are related to criminal or prohibited acts including crimes involving moral turpitude. Yet, these crimes must afford court trials in able to overwhelm reasonable doubt of guilt. Yet, homosexuality and lesbianism, which is beyond your control, are enough reasons to attack your marriage. I, therefore, conclude that the Family Code, as far as its oppressive and discriminatory provisions against LGBT are concerned, is a complete bUllsh!t!

VAWC Law is specifically made for the benefit and the protection of Women and Children. It doesn't include men in it, aight? So does it mean that it is uncostitutional by nature of not providing the same effect and protection to men? No, of course not. Its intention is not to discriminate. In the same manner, Family Code of the Philippines is made for the establishment of family, where a man and a woman joined together having the possibility in nature, to produce offspring, protecting the contracting parties and their possible offspring and punishing those who neglect it. Don't compare your leftist idol country to the Philippines, they are western country, we are not. You can have a union to whoever you wanted to but don't call it marriage, you can build your own empire whatsoever but don't call it family. Simple as that. Family and marriage has long been defined before your twisted version of its definition. Oh, and by the way, who told you adultery and/or concubinage is not a ground? Hmm. Read your New Civil Code and Family Code, sire.

Atty.,ask ko lang po.my parents got married 1967(civil)and nov. 1967(church) with 3children(51-older,42-youngest) and they were separated before i was born(1979).he had another family,oldest is 44.but unfortunately father died 2002.and my grandparents have property and will be distributed to the family.but it’s sad that my parents have no records in psa.checked with the lcr but the records were all destroyed due to fire year 1903-1970(church wedding)the civil wedding lcr records were also not available on the date given. And to our dismay the second family has a marriage contract of their parents from psa.i want to ask, does my parents marriage valid even without psa m.contract record? Are we the illegitimate family since we cannot present any papers of their marriage?we only have their picture taken during the church wedding and a paper from lcr(church wedding)that says that during the year of wedding it was destroyed and a jint affidavit that states they personally know that my parents got married on the same date. What are our rights as the first family? Thank you po.

Hi Lence. It is imperative that you establish the fact of marriage. It can be established by evidence other than the record in the local civil registry or PSA. But you have to file a case for the registration of the marriage. Get yourself a lawyer to study your evidence and he will advise you what case to be filed. All the best!

Is the principle of lex loci be applicable in recognized same sex marriage performed in a foreign country between a filipino and a foreigner ? lex loci does not specifically say it's only applicable to heterosexual marriage especially when same sex marriage is conducted and recognized by the foreign country that recognizes it as being valid. That same sex marriage between a Filipino and a foreigner will not be recognized here even if it is valid in the country where it was celebrated because the national law of the Filipino does not allow marriage between persons of the same sex. The Filipino partner is not capacitated under Philippine law. In this situation, the applicable rule is not lex loci celebrationis but lex nationalii.

Your marriage should be declared void or annulled first. You can't just change your surname because you guys are no longer together. It'll be a disaster if you use your maiden name. Certificate of annulment is not retroactive and so if there will be legal matters in the future, you'll get loads of headache.

Sir hope you can answer my question. What if po a man and woman #1 is married back in 1989 and got separated 1990. Around 1992 man met woman#2 and they had a kid 1993. They are still together until today for almost 30 years. Man doesn't have any idea about woman#1, no idea where she is or of she is still alive. Can the man marry woman #2?

The man can check with the Philippine Statistics Office if there is a record of death. If none, he can file a petition to declare the the first wife presumptively dead, provided he exerted earnest effort to look for her and is convinced that she's probably dead. In either case, actual death or presumptive death, the man can thereafter remarry.

Sir, do you mean to say that if I am an impostor, say a janitor, and one of the parties believes that I am a minister of the church and solemnized the marriage, that marriage is still valid. Even I don't have the authority and the right to sign the marriage contract as solemnizing officer, and still valid. This is the flaw of the law.

Interesting question. The law (Art. 35[2] of the Family Code) provides that the parties believed in good faith that the solemnizing officer had the authority to solemnize the marriage. This means that the parties exercised due diligence. So, the parties should at least ask the solemnizing office what his job is, ask for his ID, his authority (in case of pastor, minister, etc). Only when these efforts were exerted that the spouses are deemed in good faith. If the janitor would have been discovered if the parties exercised due diligence, and they did not exercise said due diligence, they are not in good faith and the marriage will be declared void.
