Does the perpetrator have a history of similar incidents? Does he show any sign of remorse? Was this a typical action for him and was it premeditated? Or was it spurred on by an 'out of character' act of extreme behaviour? Obviously, the judge and the jury have to consider everything specific to the case and then the judge comes to a verdict on the length of the sentencing according to the law. There are minimum and maximum sentence lengths and the judge has to follow the laws on those.
