सर, मैं महाराष्ट्र मे revenue circle ऑफिसर हूं... मेरे पास execute करणे के लिए एक conset decree आया है ..... उसमे प्रॉपर्टी का बटवरा हुआ है ... लेकीन suit में बहने मिसिंग है (जान बुझ के मेंशन किया नहीं याने की छुपाया है) बाप ने प्रॉपर्टी बेटे के नाम कर दिया है..... अब इसमे मैं क्या action लुं ... Execute करू या रिजेक्ट करू ..... रिजेक्ट करू तो .... क्या रिप्लाय दू ....प्लीज गाईड

If a suit is withdrawn on the basis of a compromise agreement but the compromise agreement not recorded in the court wheather a fresh suit may be filed against the same parties on the same subject matter by creating a fresh cause of action on the basis of unrecorded agreement created by the plaintiff before the withdrawal of earlier suit. Good afternoon sir Sir on one side explanation of rule 3 is saying that ....an void or voidable agreement shall not be lawful for the purpose of compromise the suit ... But rule 3B is saying that no suit shall lie to set aside a decree on the ground that compromise on which the decree is based was not lawful.... Sir both rules are looking as contradictory of each other Sir pls clarify This is humble request
