As an investigator for discrimination and also a real estate broker, this video was helpful to sum up the basis of Fair Housing. The part about smoking and pet ownership was interesting because it offers something what landlords can do lawfully. Every report of discrimination are investigated and most are settled with no probable cause or with cause, however it is a long drawn out process. Additionally, most cases with cause are settled through conciliation before an hearing examiner or court. Brokers or salespersons can be fined.

Paul, at the 3:57 time stamp, did you mean to say the 1866 Civil Rights Act? Just wanted to clarify, because you said 1968 but that didn't sound right. Please let me know. Am really enjoying these lessons. Very helpful!

Nope 1968 is correct however keep in mind that the civil rights act of 1968 is also known as the fair housing act... the civil rights act of 1866 created race as a protected class... thanks for the question.... best of luck

Hello Mr. Paul. Can you help me answer this question. Thanks for all of your videos. I have my test 12/10/20..... Can agent advertise listing as " water front home” if resident is 5 mins walking distance?

Well, it depends on how the question is SPECIFICALLY structured; however, the definition of a "waterfront" home" is - "land, or land with buildings, or a section of a town fronting or abutting on a body of water." Therefore, based on what information your question has identified, I would say NO... it would be misleading advertising. Now, maybe the home is a 5 minute walk BUT you can see the water from the home. It would be appropriate to advertisie "water view." Thank you for the question I really appreciate it! Hello. Thank you for your videos. I'm renewing my license in California. There is a question in my test. It says if someone has alot of certain faith and only wants to rent to faithful people. One of the answers says that they must talk to their minister so he can reach out to to HUD. What would a property owner have to do in this case.

Great channel! I'm a seller with a current MLS listing in Michigan. Is it illegal to deny any agent or broker from presenting a buyer to me? A person living in my neighborhood is an agent. I do not want them to benefit from the sale of my home. I assume this is not discriminatory to the buyer. The buyer would just need to find an agent/broker that is acceptable to me the Seller. right?

If you are discriminating based on the 9 protected classes then it might not be allowed. Otherwise you are allowed to decline offers.

a question on the exam that speak about a blind person with a seeing eye dog wants to move in and apartment. that say know dogs allowed. is this not allowed.

Since being blind is a disability under the fair housing amendment act of 1988 the blind person would be able to have a dog as it would be operating as a service dog and not as a pet!

Very helpful! Does it apply to private clubs? I got as question in my test about it and I was a little confused. It was if it was allowed for a private club to refuse to rent to African Americans who were members?

As long as the private club doesn’t discriminate based on those protected classes meaning they can turn away non-members due to membership not due to being African American. So that person who is African American can join if he/she is a member of the club. At least that’s what I think 🤔

Implicit bias is form of bias that occurs automatically and unintentionally, that nevertheless affects judgments, decisions, and behaviors. For example, using a real estate example, you subconsiously find yourself repeatedly hiring white realtors, assuming white realtors are more qualified than black and brown realtors. Both black and white people can have implicit bias, and not even know it. Fair housing laws must be extended! Real estate brokerages are accepting black and brown realtors into their offices, but many buyers and sellers avoid hiring them in favor of white realtors. Close to 80% of the nation's homeowners are white, and there are so few African Americans who can afford to purchase homes. So, many black realtors, in particular, leave the profession before they even get a chance to get started because America's mostly white buyers and sellers refuse to hire realtors of color. They are biased. I wasn't a realtor for very long before I soon observed so much bias. The real estate industry is very racially segregated. The vast majority of realtors in America are white females in their 50s. They are the only people who consistently get to work in real estate. Everyone else gets the clients they couldn't get to, which aren't very many. Something needs to be done about this ASAP, because I'm simply fed up with it.

I have a hard to believing that gender identity/expression was placed as a protection back in 1974. I don't remember even hearing words like that back then. Those types of gender dysphorias seem to be in much more recent times. Was that something added to it after the law was passed?

Sex was added as a protected class in 1974 but gender identity and expression are sub-category of Sex and were included recently. They are not sole standing protected classes.

My ex wife Heidi O'Day now Heidi termer and her boss was a manager and employee and had the previous head fired for a slip that sounded discriminatory and Sharon replaced that man! Sharron and Heidi termer in Washington states human rights commission shouldn't be trusted my ex wife said repeatedly that shraron was blatantly racist against Mexicans and would regularly force investigators to close cases no cause!
