अगर constitutional morality की बात की जाए तो यह इस आधार पर है कि जब तक देश की एकता और अखंडता तथा प्रतिष्ठा की बात हो तो इसे sideline किया जाना चाहिए। क्यू की जिस तरह 370 लाया गया था वहा भी इसकी situation केवल पाकिस्तान के आक्रमण के कारण और इंडियन राजनीतिक निर्णय के कारण लाया गया था... इसको भी संविधान ध्यान में रखे तो अभी जो निर्णय है वोह futuristic और कश्मीर की पॉलिटिकल instability को ध्यान में रखा जाए तो यह निर्णय शायद एक बेहतरीन निर्णय है। माना की सरकार संविधान से बड़ी नही हो सकती की संविधान को ऐसा निर्णय देने को मजबूर करे कि 370 को हटाया और इंटरनेशनली भारत की छवि का प्रश्न और राजनीतिक अस्थायित्व का प्रश्न खड़ा किया। पर ऐतिहासिक रूप से भारत की आदर्शवादी सोच को UN में मान्यता नहीं दी गई थी और इसे dispute करार दिया था... मात्र इस वजह से हमारे देश को कश्मीर जैसे मुद्दे पर independently काम नही कर पाए और एक प्रक्रिया को फॉलो नहीं कर पाए जिसमें कश्मीर के लोगों का मैंडेट भी शामिल था।

First of all it is not Kashmir, it is Jammu & Kashmir. The instrument of accession signed by Hari Singh was no different than that signed by other princely states. We could have taken Skardu and whole of Poonch jagir easily if we had not gone to UN. Sheikh Abdullah only had sway in Kashmir valley not in Ladakh and Jammu areas (including what is now POK, which should be POJ actually). He was given too much importance as he had personal relationships with Nehru and as is natural with such arrogant people, he stabbed Nehru. The approval of Legislature of State is not compulsory to alter the boundary of any state and reorganise it. Morality does not come as far as law is concerned. I think Telangana too was created without the approval of AP legislature.
