@@RattlePokemon yep :P my first thought was that they know nothing about IP / trademarks in the first place. So many LGS / card sellers infringe trademarks in their names or logos / merch. Even not considering the fact that they put their capacity to earn money at risk with all the TD infringements, they are setting their business (growth) to fail with no brand recognition potential. In a market in which everyone is selling the same stuff at about the same price, for the most part, the 2 differential factors are service/reputation and branding.

The North Carolina couple did not steal anything. Nintendo does not own the rights to "Catch Em." They own the rights to "Gotta Catch 'em AlL!" A company in Delaware owns the rights to "Catch Em." Even though they own the trademark to that phrase, it doesn't mean they can stop another company form using those two words in their title. They can stop a company from only using "Catch Em" as a title.

As a local it’s really fun watching all this unfold because the NC store owners are CONSTANT drama in the community. This is just the first time they have actually been called out for their BS. Joe snapped at me during a trade night because he offered someone in the store like $30 for their base set unlimited charizard. I paid them $100 for the card and he snapped at me saying I screwed him out of a deal and that I’m stupid and over paid. Then snapped at the other guy for not selling him the card since it was his trade event.

That's not the name. The name is "Catch Em Collectibles." They registered that business name with the state of North Carolina back in February 2021. It means, among other things, that only they are allowed to conduct business in North Carolina with that name. The couple from South Carolina are not.

If you don’t own the underlying IP or have a trademark on the source material, your common law trademark isn’t enforceable or applicable. They know nothing about trademarks.....and if they did actually talk to lawyers, I'm guessing they weren't IP lawyers....you cannot enforce a pending Federal Trademark..it has to be federally registered. A quick Google search will tell you that.😂 😂 They only have common law rights, and common law trademark rights are fairly limited...not to mention they are already trading off of the Pokemon Company's original IP, which is likely Federally registered. Pure entitlement...

@@michaellashock9769 It's not even an issue of trademark. That has to be decided at the federal level. The US Patent and Trademark Office has yet to give their final ruling. What is the issue is who can operate in North Carolina as Catch Em Collectibles. The North Carolina couple registered that Doing Business As (DBA) with the the state in Feb. 2021. One of the things it means is they are the only business that can use that DBA in North Carolina. The South Carolina couple can not.

Hilarious these people are worried about intellectual property, these people stole my ebay photos and used them as their own after I basically went from nothing to one of the top 5 pokemon sellers on ebay. They even messaged me a few months before stealing my photos asking me how I could be selling so many items but charging 20-30% more than the other sellers. I made the mistake of telling them it was probably because of my pictures. Them stealing my photos halfed my sales INSTANTLY and ebay would not do anything to protect me because the photos weren't the original photos I uploaded to the listing, I even offered to provide them with unedited copies of the photos proving they were mine and they still would do nothing telling me I had to add a watermark (which was then ruled as "not allowed" soon after). I can tell you that was one of the most frustrating times of my life. Horrible people make me mad, but not quite as mad as hypocrites.

The North Carolina couple have the trademark rights to "Catch Em Collectibles." They filled with the United States Patent and Trademark Office back in September 2023. It's still being processed. No other company can try to file copyright protection for "Catch Em Collectibles" until the North Carolina couple's case has been resolved. Nintendo doesn't own the rights to "Catch Em." It belongs to a company in Delaware that makes insect traps. Even though they own the rights to "Catch Em" it doesn't mean they can stop another company for using those two words in their title. There's a company that makes fishing lures that has a trademark for "Wreck 'em Bait Co. Don't Just Catch 'em, Wreck 'em!" They used Catch 'em in their title, but it doesn't infringe on the trademark owned by the Delaware company. Nintendo owns the trademark for "Gotta Catch 'em All!" It doesn't mean it owns the rights to each of the words in that title.

The NC shop went to that show on a war path to serve that couple. It’s obvious they went to cause drama. They won’t reveal their footage and NC’s story of the events are full of holes and/or they dismiss what they said or yelled. No one cares who sponsors card shows. I don’t think I could tell you the name of any card shop at a card show or Collect-A-Con yesterday or if they sponsored it.

They were told their business was registered with the state of North Carolina, and because of that, no other business could operate in the state with the same name. I still don't understand why they ignored this. The NC couple were most definitely not trying to create drama. Far from it. They reason they recorded a video of the SC couple was so they had proof they were presented with a cease and desist document. If the NC couple wanted to farm drama, they would release their video.

If they felt their companies interest were at risk, why not try to handle it like real people instead of TV style. Which they did and like in real people fashion, the problem escalated. People are unable to communicate properly for various reasons and end up going to the next step like the dumbasses they are. This happens when two inexperienced parties have a confrontation. Either this is a common enough phrase that no one can trademark it OR it belongs to Pokemon. There is no way someone could think that they have a trademark on anything related to "Gotta Catch Em All" over Pokemon. Even if someone was successful in having another store change their name, all the loser has to do is contact Pokemon directly. Once they get involved everybody is changing their name.
