There are many myths out there that imply "becoming a Landlord is a nightmare". Especially knowing that the by-laws are so much in favour of the Tenants in Ontario.
This is why we had Elaine Page from Page Paralegal come give us a surprising presentation on "Things you can and cannot do when you are a Landlord and/or Tenant". Elaine specializes in Landlord and Tenant matters for over 20 years and in this episode she tells us:

Whenever the landlord or landlady tells me that lights are off by a certain time or that we cannot cook (or must stop cooking by a certain time), I am not renting from that property, because eating is a basic human right and need, and plus, we might need to study or work past the normal hours of 9-11pm in the event of a deadline.

My landlord only turns on the heat when her husband is downstairs working in his body shop it's an old fire station there are 14 apartments upstairs.she very stingy with turning on boiler at night.any suggestions?

There should be a minimum temperature that must be on so please ensure you look into this law where ever you are.

I was renting a room, as soon as I found green dusty mold and black mold I notified the owner that i will be moving out and the reason why and she gave me my 300 dollars deposit back .

can you imagine if oneday your son or daughter - especially your daughter, gets threatened and taken advantage of by a landlord then you would be all for tenant rights! Right?

Lemon020202 my old land lord would threaten to evict me every time i asked him to fix the hole in the bathroom floor that started growing mushrooms after a week. But yes, its always the horrid tenants fault. Rn in my new apartment (moved in april 7th and its now end of july) i havr been fighting mold, bugs, and wet carpets since i got here. Now they are telling me i need to fork over money to go to a hotel... they are supposed to pay for that.

Our landlord 3 weeks ago decided to sell. But, didnt tell us. I came home to see a real estate agent in the drive 3 days after it had already been listed. No 90 day notice of intent to sell. Since then they show the property with no notice and on a 2 hr noticed on 1 instant I declined but they still came - asking to see in the inside of the dwelling asap because these are potential buyers. Today they brought buyers at 10am on this Holiday weekend (Saturday) unanounced and the landlord just showed up shouting my name. Then again at 7:08pm... Also requested to show our place on Mothers day at 11am with a request at 8pm the day before. And every day a new viewings without notice. Now we just lock the doors and close the windows. No notice - no entry... But he still shows up walking around talking very loudly in despiration to sell to anyone.

landlords think they can get away with things because they always have and towns don't stand up to them, they let them violate tenants, landlords are mini-terrorists,sad how many tenants were kept in poverty because of landlords taking advantage, and now tenants have had enough

Lets stop building homes with secondary suites. Buildings with fewer than 6 suites minimum should not exist. Sure rent will sky rocket for a bit but it will make buying homes more affordable when people realize they dont get mortgage helpers with their 1.5 million dollar house.

If I wanted to sell my property I 'm not going to ask anybody. A lot of landlords are wanting out of this business. Sometimes having rentals is not worth it. People don't take care of nothing. Some do but some don't.

Tenants play a game. They pay one month's rent when they move in. After the first month, they promise they'll pay in a week or two. After one free month, they are typically given an eviction notice by the landlord. Wait thirty more days for a court day, so the tenant now has two free months. It costs $125 to file the eviction with the court. After the court hearing the court will give them up to ANOTHER month to move out. That's three months free rent. Ten more days and the sheriff will set them out on the street. Then they steal the appliances and knock holes in the walls before they leave. Landlords are then responsible for the unpaid utilities. And you think "landlords have all the power".

@blueToronto As a LL, I'd agree painting a wall isn't physical damage. However, there is also such a thing as monetary damage. Generally speaking, a tenant is supposed to return a place like he got it. If a LL has to re-paint- and maybe more than one coat to cover a tenant's paint job, that can rightly often be charged to the tenant. There are some other factors, like how long did tenant live there? Was color preapproved by LL? But I had a Cleveland Browns fan paint a bedroom their official colors. Yes, tenant got charged for that.

Linda Harper yeah, I just rescently counted 237 notice to enter unit and have lived in this unit for six years.! harassment, retaliatory whatever ! And I am going to have to go on the offensive again. over a change of my lease that I did not agree too. and it's new management. so wish me luck. I hope you found better circumstances.

@@nashf5925 my landlords (which are a couple) keep coming at any time. I'm constantly confronted by situations like that. One day, the landlady came here and I was taking a shower, she kept calling me and when I would say, I can't I'm only wearing a towel, she would say, that's okay, we're both women WTF!! I never felt so assaulted in a long time 😡😡😡

@@JessyingAround totally unacceptable. It's like our rent money is good enough, but not everything else that comes with it. Next time, take your phone and start recording asap your conversations with them. I emailed a summary of the incident to my landlord to have a record and he actually was smart enough to reply back starting that I have no privacy rights, lol.

@@nashf5925 thank you so much for the tips!! I actually don't quite know how to deal with such situation. I'm looking for another apartment eventhough I just moved. I'm still embarrassed, after all she didn't leave and she pressured me until I left the bathroom just wearing a towel to answer her😡 And then she had the audacity to comment with my housemates that I'm too shy and closed and that's not ok Now I can't face her normally

As a landlord you do not have to accept the month to month agreement when the year is over. You stop accepting their rent and file for eviction as the tenant is now a holdover.

Zoch Buppet *quite serious. Every flat/apartment i've been in has some shitty old PVC plugs that look to be decades old. (Mind you i've had the misfortune to rent some very old places.)

i paid first, last, and deposit ? and now theyre trying to evict me over a bank error. and they filed two days before i was even told that there was a problem. I had paid may rent already.

I was renting a place with someone else. Utilities are not included. I put power in my name. We both split the bill as it was not included with the rent. I later moved and gave him 30 day notice to get the power in his one name. He he's telling me that in not allowed to do that. They makes more money thann me, why do I have to supply my power to that person? I'm not a landlord I was a tenant. Help

In West Palm Beach, FL on my move-in day I gave my landlord cash payment for security deposit. First and last months rent was already paid including $100 application process fee. On my security deposit receipt she wrote non refundable. I was also told that the security deposit will not be place in an escrow account. And they did not do a walk-through with me. I did however get a form to fill out on my own and they picked it up while dropping off a copy of my signed lease.. Is this Legal? 🤔

@@cherimerchant6279 I thought so. I'm still living in the same apartment after 2 years. Landlord and I had worked very well together during the pandemic. My only concern is that security deposit receipt that states non refundable 🤔 and of course after 2 years it proves that the landlord did not put the deposit in an escrow account because I have not received any interest that has accumulated which I find also deceitful 🤷‍♂️

@@AnitaBonita46 I'm old and remember the way things were and I also with a person formed a tennents association ,that helped tennants know their rights and when they were being exploited, a lot has been sneaked in by landlords in past decades that younger tenants don"t know what's being done to the benefit of the landlords agenda and lifestyle, tenants should contact tenant associations if still out there or form some new one's ,get information from people that know the laws, capitalism has been taken advantage of by a lot of businesses,

@@cherimerchant6279 Thank you for that tip 🙋‍♀️ I am aware of what the landlord is doing here. I never do things verbally everything is written by letters or email. I have a file from the first day before moving in. I was a paralegal for 30 years in Massachusetts. Landlord and tenant dispute cases and immigration was my specialty. Yet, here in Florida the laws are different and absolutely I never told the landlord that I know the law as far as she's concerned I'm just a 59 yrs old woman alone retiring in Florida 😆

here are the new illegal rules is: no service pets allowed (against ADA laws to do this) we have to use grills in parking lot by the cars (fire code violation according to the fire department) destruction of private propery, she ordered all the grills left out side to be destroyed. made the maintence man, bash up and totally destroy 4 grills. They refused to let us form a Tenant association. Which is a Violation of tenant's rights. using foul language. Hippa law violations. Manager comes over to the tables, and tries to listen in to our convosations with our cash managers/vna nurses, therapist, etc. ( each time she is told, come over here again, and we will file a law suit for Hippa violations) leave the garbage bins where they are (in front of wheelchair access) (again against ADA to block the only working wheelchair access) All packages from post office, UPS, Fed Ex must go to her office, not the tenants they are for. so that she can put up our names on a list, and come down witn ID, prove its our packages, & only pick them up M- F between the hours of 2 pm til 3:30 PM (Side not some times she is late and does not get back from lunch until 3 pm, so it only gives the disabled people in wheelchairs no time to get down there, and get their packages back to their apt and hope they can carry it. No over night guests they must leave by 10 pm (it is in the lease you can have over night guests for not more than 5 days) if when we move out, they said we MUST surender our laundry cards even if there is a balance left on the cards. (washing machine owners claim BS its our cards and we deserve the money balance on said cards)

What about this landlord scam : There will be these actual apartments for rent and I did get to take a look at the unit. There was about 24 units in the building. So I turned my application into their office and gave them half my security deposit. All this was done in their office. Their office is right in the same building as the units. Well turns out they deliberately sat on the paper work and never bothered to rent out the new unit to me. They let this go for about 3 weeks. I called them and asked for my sec dep back as they were not serious in renting to me. Well then they fired back saying I forfeiting my sec dep because of this unbelievable reason " well we were holding the unit for you" WTF. So im trying to get them on check fraud charges because they took a check from me for that deposit without intention of providing goods/services (that also falls under non-performance). Is there any other legal recourse for this new type of security deposit fraud?

Just stop renting out. They cant call you greedy as you dont get money, and then their options deminish and existing renters jack up their prices. I wouldn't want a deadbeat living in my house. I stopped renting 4 years ago after a deadbeat took advantage of my good nature. He messaged 2 months after moving wanting to come back. Told him, i was selling the place and happy trails Robert.

My "landlord" has not been in my apartment in over 5 years, He LOL at the idea that he is a slumlord. No really!!! The same landlord also posted a notice telling the tenants he would go through our trash if he opened a taped shut trash chute door [closed for maintenance]

If you fail to pay rent in any lease agreement, you get 10 calendar days notice before your things end up on the curb. But most renter and landlord relationships are better than this. Landlords who want to kick you out pray that you skip rent so that 10 days after their notice taped on your door and picture of it on their iPhone camera they can evict. How long they take to give notice is based on that renter landlord relationship.

@@thestrappingentrepreneur2822 I use to think that too! Well I have my hearing today with the new Owners and there attorneys. I am 61 Seperated and became disabled after working 45 years. All my bills still had to be paid. While I am waiting for SS Emergency rental assistance sent my Landlord a check for 4 months. They sold this property and gave everyone here notice of selling on Friday and Monday the New Owners were here. I asked them if they have worked that rent out. They had no idea what I was talking about so I showed them the letter and also an email that previous landlord had cashed the check. They evicted me and suing for $1400 plus attorneys fees plus court cost. I appealed because that money has been paid 4 months in advance . one of the two companies has that rent. I have the proof that it was paid.

landlord said somethingin the lease says if I call the cops I can get evicted.I'm in Nevada and I think they have thatbon my lease.is it illegal? Because my landlord has told me and the ccd mediator that she I trying to make me break the lease. 2 days after my car tag expired they had it towed. I did not receive the paperwork from the dmv because she put a stop on my mail without telling me..so when I seen the tow truck I went down and asked what he was doing he wouldn't tell me so I called the police and they came.well because I called the police she gave me a red card and said if the cops come1 more time then I have broken the lease and will be evicted. if I need help does that mean I can't call 911 without getting evicted? she has drilled my deadbolt off came in the apartment and proceeded to walk through the rooms .she said it was because they thought I had a leak in a pipe.but the is only water in the kitchen and bathroom. there was no need to walk into the rooms.she has shut the water and hot water and electricity off on me.also called my family in California and told them I broke the windows and that was false.she has asked me 47 times since I lived ther why my girlfriend was there and we should go to her house..does this seem like harassment? and the red card is that legal?

Yes, as long as they give you 24 hours notice prior to entering the premises.

Changing the air filter is regular maintenance. And yes it's legal. But it has to be done on either a regular schedule. Such as the first Tuesday of the month. Or a date given each month

What about if the landlord doesn't upkeep the carpeting in the home and you just bought your kids new clothes they are 3 and 9 months and their clothes are trashed from how much frh is on them. Landlord stated he'd fix it 8n the fall its now winter. Also we need heaters he has never provided heat and in the summer we suffered heavily too...

Can someone help me ..my landlord got caught by law enforcement..her place was not registered..and the place was not up to code..after landlord fixed up what things...she inquired me to pay a higher rent..i TOLD her I could not afford what she asked for..so now she is evicting me in court...she said she needs the lower level because she can not up the stairs..she is taking out her revenge on me for not giving extra monies I know about about the by laws..can anyone tell if she can win a case saying she kneeds it know for her purpose.??

After renting a house and sign contract ..landlord tells tenants give them a card and say now you's ring these people and they give you's a card you's got discounts in some shops ...the card says it got nothing to do with your renting contract? It says as well if you pay the rent and computers are down or is weekend you's will be charged a fee...tenants refuse to use the card they want to pay rent into bank account...it should be like that or pay agent..they say ju ou pay rent at post office Tenants say they charge

not legal to use deposit to pay back rent, it's only used for damage to app, any back rent ,the landlord is supposed to take you to small claims court

Totally not true, security deposit can be, and always is, used to pay for damages, unpaid utility bills, and rent owed.

@@jimmyday9536 lately (last decade or so)the landlords starting taking it for back rent, but if you look up the original laws ,it was only for damages, landlords have gotten away with sneaking false laws in to their benefit because tenants don't always know their rights, the country needs tenant associations groups to have meetings that make sure tenants know their rights,this is why so many tenants are angry now, because they are realizing what landlords got away with for so long ,

In most cases, renters have a right to entertain guests in their apartment. They exceptions would be if there's a trespass or restraining order against your guest(s). Does your rental agreement state that guests are not allowed?
