I guess what Saul was trying to say is you couldn't recognize the guy standing here wasn't the defendant, (of course that depends on if the judge had seen the defendant prior to this hearing), then that's enough doubt that the shop dude / plaintiff could most likely not identify the defendant, as proved by the fact he did not, causing reasonable doubt, in which if what Saul had done was legal, would likely have gotten the guy off no charges. Saul was pointing out to the judge that she herself did not notice he swapped out the defendant for a similar looking guy, proving that a mere glimpse isn't enough to prove it was his client

Agreed. Nobody looks at Saul seriously, because he’s flamboyant and doesn’t conform to typical procedure, but man is he a legal powerhouse. Manipulating entire class action lawsuits to his will, besting Multimillion dollar law firm founders. Saul/Jimmy was probably the best lawyer in the series.

They seem to have left out some steps. To get to this point, the bad guy would have been arrested and arraigned. He would have been photographed, printed and (unless he was caught in the act) identified by the victim using a line-up. On the day of trial it is required that the defendant present themselves and officially make a plea on the record. That happens in the courtroom from the defense table, not with the robber sitting in the back of the room. So, in the real world, using a doppelgänger like was shown would get this lawyer and the bartender both charged with contempt and a mistrial would be declared. 😐

This could violate procedural rules for the court, but I have no problem with it. If you know what the suspect looks like, your first thought when he's not the one sitting next to the defense attorney should be "there's been a clerical error, I'm in the wrong courtroom"

I don't think you could pull this off in this way in a real court room. However, I wonder if you couldn't do the same thing by just having him sit behind the defendant. It would take more skill and time so wouldn't have made for as good of TV however. In other words, it may not be real due to being a tv script. It is still a valid method to establish doubt. And as shown in this segment, extremely powerful tool as well.

because it doesnt prove anything other than the fact that yes, if you show me a person that is intentionally and maliciously made to look exactly like a criminal, placed him in the place where only the criminal is allowed to stand, and then also swore in front of an actual judge that he is actually the same criminal with no strings attached, i will tell you that he is the actual criminal, not because im evil, but because the impostor was intentionally made to dress and look like the person i know is a criminal, not the other way around.

This is actually kind of legal but he’s supposed to tell the judge first and then they would create a lineup of people. It’s all legalese nonsense and rules that maintain fairness but if Saul did this in real life like he did the show he’s probably going to be held in contempt of court

So this wouldn’t go on in real life due to ethics but there could be ways around it. Ask the judge to test the witnesses memory and basically do a lineup in court of very similar looking people and see if he can correctly verify.

This wouldn’t fly in court, but it is illustrative of how eyewitnesses are not reliable at all in any way. Human memory is so fallible it’s kind of crazy in some cases that’s the only thing between sending someone to jail for decades, and freedom.

That's not a good lawyer. Exact same thing was tried on me when I testified for a robbery. The guy I saw had a beard so the lawyer had the perp shave and had his twin brother grow out a beard to try to confuse me. I stuck to my first call. The judge was really pissed, chewed the lawyers ass and threw the book at the guy. Dumb tactic. TV and real life are slightly different.

Eyewitness testimony is generally rather unreliable. Human memory generally just isn't that good when it comes to images, especially in the details. And the more times you re-remember, the more you fill in new blanks with random stuff, decreasing accuracy over time.
