Where I live in Nassau County, NY, that technique may work for a plea bargain. My cousin in a NYS attorney. I got a ticket for “following too close” after a multi-car accident. A person rear ended me causing a chain reaction of 5 cars. The cop who showed up to the scene did not witness the accident. He wrote everyone tickets for following too close except the driver of the first car. On the ticket, it says plea guilty or not guilty. My cousin said “Plea not guilty and ask for a deposition. Criminal Law Procedure in NYS requires the officer to witness the violation. Make a copy and mail in the original.” He said the cop has to write what he witnessed. Since he didn’t witness anything, there’s nothing to write. I fought the ticket and the ADA asked if I wanted it reduced to a broken headlight no points. The County just wants money. After several trips to the courthouse, it was fully dismissed. Regardless, if I ever get a ticket in Nassau, I’m always pleading not guilty and asking for a deposition.

I have had police not show up twice after changing the date and another time the cop was pissing me off making fun of my name, calling me sunflower 😡. I laugh now because he didn't show up in court.
