What was acquired in the marriage is split 50-50, unless the couple amicably decides otherwise. A recent case is where the high court ruled in favor of a Kenya housewife where at divorce, the husband refused to give her anything, arguing that it’s him who bought all the property. The court ruled that she was entitled to 50% of it all, because it was her efforts in taking care of the children, and effectively running the home, that created the right environment for the husband to be able to go out and acquire the wealth. So though she did not financially contribute towards the assets, she still did contribute to their acquisition in many other ways.

I compromised and sacrificed a lot! We got married but he wanted to be "free" meaning changing jobs from city to city, traveling, advancing his career with no interference from me and the kids, bachelor's lifestyle. We were in Europe, which meant I had to parent alone, with no family, and no help...didn't join uni.. and it took a toll on my mental health. I tried school but I just couldn't with 2 young children because he also had some ideals like homeschooling, not taking kids to kindergarten but taking care of them myself, etc, all at my expense. I also felt the need to overcompensate for his absence as a parent and eventually placed guilt on myself which wasn't even mine to bear. I was super young as well, so I put him on a pedestal and believed in his ideals . Groomed me from 19 years old in simpler terms. He then decided that the kids and I needed to move back to Africa because I was about to have our 3rd and he just needed to put the "responsibility" as far from him as possible, so he would send money and check in like Santa Klaus on birthdays and christmases. Financial abuse and mental abuse heightened. He had such a grip on me, my mind that even when far, the abuse was massive. At this point, you have probably realized that this relationship was deeply abusive and narcissistic because even with all these outrageousnesses, am only scratching the surface. I left and I am now piecing my life together with 3 kids and all those "sacrifices" I thought I was making were useless. I was digging my own pit. Now am struggling to get back up for myself and my kids. I have taken responsibility and am working on recovering and rebuilding myself.

I know stones are going to be thrown my way but I stand with "girls should not play wife to men who haven't wifed them" how many men are you going to treat like a husband because I believe not all relationships automatically lead to marriage. When we say that Africans should embrace our skin and natural hair, wigs lines are part of the culture. They are not "wiglines" per se but just natural hair lines. We know that Africans do not have silky hair, so when a woman takes off the wig, she either has short hair, natural hairlines or just her hair ,thats the expectation.

Hey guys totally love the episode 😁😁; on the ownership question property acquired during the subsistence of a marriage is considered matrimonial property. However, in law companies are legal persons so if WILD is incorporated as an LLC then it has legal personality separate from its owners to limit liability, if it is a sole proprietorship then it, assets and liabilities, belongs fully to Murugi. Most of the complications during divorce or even during administration of a deceased's estate happen if there is joint ownership of property, business and goods or where parties claim monetary contribution towards acquisition or ownership or profit/cost sharing and they have evidence like m-pesa and bank statements.

Similar to what was said in the episode, Amazon was founded in the 90's and had a tumultuous conception as most start ups do it could well be that Jeff's wife supported him whilst he was building his biz and had financial stake. Or they could have been part owners if she had a part to play in the business side of the company.

Murugi you are correct depending on the marriage contract whether it's "in community of property" or "out of community of property". I don't know about Kenya but here in Zimbabwe all marriages are "out of community of property" therefore what's his is his while what's hers is hers except for things that you co-own or if you have a really good lawyer who can help you argue that you contributed in the purchase of whatever he/she is claiming to be hers. I wish this conversation could be had a lot more because MANY PEOPLE believe "what's yours is mine what's mine is yours" even here in Zim where it doesn't apply at all... and people get the shock of their lives when going through a divorce & they see that they are walking away empty handed. I see many women sacrificing their careers to "build" a man's career/business because "what's his is mine" meanwhile they are helping with the marketing, bookkeeping or whatever... and their names are not included as co-owners of that company or anything. With a good lawyer you may walk away with a backdated payment of being a bookkeeper or marketer but most times you walk away with nothing because do you have a contract that states that you were doing bookkeeping or marketing job as an employee or with a clear agreement that you will get paid... NO! So yeah people need to understand the marriage acts of their countries and in those countries that offer both you need to understand which one you are signing & what the small print means. Every contract has terms & conditions. A marriage contract is no different. Find out the terms & conditions first before just assuming things or signing a marriage certificate/contract.

By the way if you choose "in community of property" where "what his/hers is yours and what's yours is his/hers" it is not only limited to the positive things like accumulated assets or money BUT DEBTS TOO. So if your spouse gets into debts, YOUR assets can be used to pay off those debts because "what's his/hers is yours and what's yours is his/hers"

Lydia is correct. Any property acquired while in a marriage is considered matrimonial property. The degree to which the spouse is eligible to demand a share of that property upon divorce depends on a myriad of circumstances. However, the property is definitely on the table once a divorce has been filed. For Murugi’s business (Wild), it is matrimonial property as per the law.

I took a pause to type this before I forget. My Church Mavuno Downtown just finished a series called MONEY WALKS last Sunday. I have learnt a lot through the series and my number one take home was look around at what you are good at and try make another income out of it and when Lydia said she's good at giving people therapy and good at looking at people's well being I immediately thought how she can thrive in that business.
