Can a school use old information on an IEP eligibility category against a student for a pending expulsion? The school was presented with new medical diagnosis. Although the medical diagnosis is new to them the former EDM failed to provide that information to the school. Expulsion to a behavior school is NOT the solution when a student has recently gone through a change of placement in the foster care system. All this should be a part of their diagnosis the school disagrees battery on another student was premeditated. We are concerned the school SEIF keeps using the old diagnosis on the IEP from 2016 to expel this child vs saying yes to the MDR and reevaluate, stay at the same school in a more self contained setting vs complete removal.

HELP!! What if your trying to get past IEP and they are not providing the accurate information how do I handle this? All the information does not make sense or add up and I know I did not have evolutions when they said I did on my son or associate time I'm so confused thank you so much

It's just not that easy as having due process complaint. It cost a lot of money that special needs parents all don't have.
