True. Were it not for Marbury v Madison, pretty much all supreme court cases would be null. The Supreme Court's power of judicial review is really the only power it has since it does not have the army backing it (as the president does) or the power of the purse backing it (as Congress does).

Marbury verses Madison is by far the most important supreme court case of all time... Without it the supreme court could not have had judicial review, which means all the others would have never happened.

+Jah N The OJ case didn't change American jurisprudence. However, it did make people more interested in trials which lead to the rise of Court TV and high profile trials being televised. Also, it gave rise to the drama court tv (aka Judge Judy) where the arbitrator (yes, Judge Judy is not a judge, she is an arbitrator) decides an actual case for people.

Gibbons v. Ogden. It set the precedent that Congress would control interstate trade but not intrastate trade. It was a huge case, and it even revoked the NRA during FDR's New Deal for getting out of the Great Depression. Quite an important case. Also, Marbury v. Madison set the precedent of judicial review in court cases, so that makes it even more important.

I received my law degree from Duck Branch University where I learned the finer points of constitutional law such as : The second ammendment says all men have the right to keep and arm bears ; Landmark decisions like Row verses Wade that decided proper fishing procedures. I've never lost a case.

Marbury v. Madison has to be #1. The impact of that case is insane. I study it in India for UPSC. It created the concept of Judicial Review.

Marbury v. Madison should have been #1 because all the other cases couldn't have happened without it. Also, Plessy v. Ferguson (1896) should have been a spot, Brown v. Board wouldn't have happened if Plessy v. Ferguson didn't happen. Also, Loving v. Virginia (1967) should have been on this list. It made interracial marriage legal in ALL 50 states, at the time there was 16 states that banned interracial marriage (they were ALL Southern states).

+Delaney Costa and? A fetus isn't capable of many things let alone get to decide if it lives or not, in some cases if the mother gives birth there's a chance that both will die. I'd like for you to tell them, every lady that their reason is wrong and cannot be validated solely because you said so. That and rape is wrong so if a woman want's an abortion let them and don't say adoption because not enough people are adopting, that and the cells can be used to advance medical research to cure diseases. Sort of a win win if you ask me.

Another person's life being dependent on my body makes no difference, I should be able to choose what happens to it. If a a person needs a kidney and I am compatible should I have to give them one? I remember learning about half of the trials mentioned. Back then, they were doing what they believed was right at the time. I don't wish to condone or condemn what they did in the past. I wish to learn from the past and make a better future. That's the thing about history. History was never meant to be looked down upon or ignored; it is meant to teach us something. This way we can better understand not only our heritage, but also our legacy. What would life be with out history? I'd rather not answer that question.

Of course not even an honorable mention for Mendez V Westminster, the court case that ended segregation in public schools almost a full decade before the brown vs Topeka case. Mexican Americans were the first to challenge the public school system in court and paved the way for the civil rights movement to prevail, but we never get the credit where credit is due. 👎

Mendez was actually a Ninth Circuit case, so it does not qualify. However, it is certainly very significant in paving the way for desegregation in the “Lower North” (free states bordering slave states) Brown, yet is even less known, I think than Smith v. Allwright. Smith v. Allwright should have been here given its affects on black political participation in the old Confederacy (at least in the Rim South, Atlanta and Acadiana). Historians have recently recognised the importance of Smith v. Allwright, as in Robert Mickey’s ‘Paths out of Dixie’, but Mendez v. Westminster has not been assessed in that manner.

Whatever morals you feel about abortion are irrelevant. What is relevant is holding executive power over someone's bodily functions. To ban a woman's right to terminate her pregnancy would allow the government to dictate what a woman did with her very own body. Her very own being (yes the fetus is all hers since the fetus cannot survive outside of her, she has to feed it and deal with everything that comes with it) would be controlled by federal law in a way that federal law does not control the bodies of men, which means that law would be discriminatory based solely on gender... thus, it is unconstitutional, and will be until men can get pregnant.

You can remove the child at 8 months and it may survive. A child in those first three months will not survive, so you cant offer that child anything better than what the mother is willing to offer

Jarron Williams A child at 24 weeks is fully formed but just needs to gain weight and there are plenty of cases of them surviving outside of a womb, yet it's legal to terminate them. It shouldn't take you 24 weeks to decide to kill something inside you.

Great story about Miranda. He was retried without the confession and was found guilty (he confessed to his wife and she dimed him out). Miranda was later stabbed and killed in a bar fight. No one talked to the police and his killer was never found.

One of the most influential laws passed was when the Supreme Court gave Corporations personhood under the Bill of Rights, back in the 1880's. That has been the chief architecture under which the U.S. economy has developed since then.

Roe v. Wade is not nearly as important in the history of the struggle for rights (don't get me wrong it is very important). Such issues would seem trivial if you don't even have basic rights of a citizen or even as a human being.

I think Linus V Palmer should be on this list. The Called "Murderer Heir", this case showed that the Supreme Court can overrule not only other laws, but also contracts made by people, if said contract hurts the dignity of one of its parts (like no one can benefit from its own turpitude).

Also, the Dred Scott case stated slaves were bound by the state they were bought in, not where they lived, and technically allowed slavery anywhere within the United States by the Supreme Court's definition, even in free states

The left-leaning Florida supreme court was calling for a re-recount because Bush won both counts. It was a complete joke! Munn vs. Illinois (1877) should have been mentioned. This case stated that businesses were not above the law and subject to federal, state and local regulations to serve the public interest. The firm of Munn and Scott sued the state of Illinois over a regulation of what they could charge for the storage of agricultural products, arguing that this was deprivation of property without due process. The Supreme court disagreed, saying that all levels of government have the ability to regulate businesses to protect the public interest.

I'd say putting Roe v. Wade as #1 was a mistake. It's certainly a famous and important case, but Marbury v. Madison was more important. Roe v. Wade would have never happened without it.

The simple fact that Marbury v. Madison only made #8 in this countdown means that whoever compiled this list has no idea what the hell they are doing. In terms of "court cases that changed America", Marbury v. Madison is the court case that gave the U.S Supreme Court the power of judicial review. It could be argued that it's all opinion, and I would agree with that on nearly all the others, but Marbury v. Madison literally made every other court case on this list possible. And Roe v. Wade is #1? Give me a break. This list is for top court cases that changed America, not the most controversial. I'm not saying it doesn't belong, but you could swap #1 and #8 and it would be a much better list.

Marbury v. Madison sounds like the most important one. None of the others carry any weight without that decision. Kind of an inevitable ruling too when you think about it. No body of power would decide against increasing their power. And that's why people suck.

I love Obergefell V Hodges the most personally, it was one of the happiest days of my life hearing that gay marriage was legal everywhere. I remember riding my bike with my mom and she told me about it. 'Even Texas?!?' I asked. 'Even Texas.'
