Social Security does not make it easy to win disability benefits. Approval rates at hearings have dropped from around 60% just a few years ago to around 40% today. In some hearing offices, judges approve even lower percentages. Delays are increasing and many in Congress believe, incorrectly, that Social Security disability is riddled with fraud.
In this challenging environment, you need to understand exactly what it takes to win. In this video, I highlight eight factors that you should consider when applying, filling out SSA’s forms, or testifying at a hearing.
As I discussed in a previous video “What is the #1 Biggest Mistake You Can Make When Applying for Social Security Disability” ( • What is #1 Biggest Mis... ), you have to speak Social Security’s language and understand clearly what a Social Security judge or adjudicator must have in order to grant your application for benefits.
This video offers additional suggestions about crucial factors that can make the difference between and approval or a denial. #howtogetapprovedforsocialsecuritydisability #howtowinssdi #socialsecuritydisability

Had my appeal hearing done over the phone on 9/9, created an account on the my ssa website and found out I was approved on 10/3. It took over 2 years, 2 denials, over a year's worth of extended hospital stays due to declining health, incompetent case workers and an unbelievable amount of stress to qualify for a little over 1300 a month after 35+ years in the workforce and military. Thanks, Uncle Sam (sarcasm).

My SS Disability claim was approved a couple of years ago and all your points were on Target. It took me two years to get through the paper process, including the first appeal and being denied benefits until I reached the Hearing. The physical limitation discussion was the most time consuming part questioned by the Judge. Questions like how far can you walk? How long do you have a rest afterwards, and for how long? What is your average day like? The attorney preparation was very important as well. Good luck everyone. It's not a cake walk like many say it was in the past. Get a good attorney after you get denied by SS on Appeal. 👍🏽 Good video👏🏽👏🏽👏🏽

Sir-my doctor recommended I apply. As I’m going through the process, my anxiety (part of the diagnoses behind the reasoning) is no longer being treated as my psychiatrist dropped me as her patient. Further, the local legal aid/advocates have yet to respond to me. My function report is due in two days and still I have no assistance. Crippling symptoms combined with frantically trying to find a representative or solutions have completely discouraged me. I just found your channel and have to let you know, you’re a godsend. It’s one of the worst times of my life and you’ve helped me to be informed, prepared and feel supported when I’m otherwise on my own. A thousand times, thank you.

Please listen closely to him and follow his instructions; becasue most people, regardless of your condition, you will be disaproved. I get SSD and 100% VA Disabled. Both process are very difficult, because they are trying to weed out people who are not turly disabled; you have to prove it. My fight with the VA took over 6 years and a final decision from a Federal Judge, but I was approved for SSD in 90 days. The most import element, is your medical documentation; you have to build a record of always going to the doctor, even the emergency room, on a Saturday Night, when others are out having fun. There can't be gaps in your treatment, because they will assume your condition isn't as bad as you say.

This is my issue too. I can’t afford to go to a doctor. I can’t afford to take time off of work. I can’t afford medication. I’m can’t adhere to my treatments because I can’t afford to spend my day taking care of myself while working for 8-12 hours, 5-7 days/week. This is why I’m applying for disability- so I can actually take time to treat myself, and so I can actually afford my treatment. I feel so hopeless.

I was a near 30 year veteran with an operational life and death Federal Agency. I have Lyme Disease with residual chronic auto-immune issues. Here I was a scientist and my boss told me I was forgetting whole conversations, my co-workers could tell I was trying as hard as I could. Management wanted me to retire on disability. They said I could no longer do the job and could not reduce my performance expectancy due to my disability. So they forced me out. I grew terribly depressed. I was approved to get my Federal Disability Pension. There was a time I did not think I would be alive much longer. SSA denied my first request. I was very surprised. Along with my Lyme Disease I have narcolepsy type symptoms and have fallen asleep at the wheel before getting off the road and sleeping in my car 3 hours or so. I’m going for my second try now. I have to pay back my pension I get most of any SSA benefit I receive anyway. But I’m going through this just so I can get a little extra cash so I can try and get the proper treatment for this mystery illness. Thank God I have my wife who has taken care of me financially and been my caregiver. The pension I get is fair but when it comes to spending nearly $1000 per month on meds and doctor visits I wish I could contribute more. I was the bread-winner through our marriage. It’s hard for me to feel worthless. Plus have severe arthritis and some dementia. If I was a dog, my owner would have euthanized me by now. I saw my SSA appointed doctor today. He told me he’d never seen anything like me. I had a narcoleptic attack in his office with autonomic dysfunction where my blood pressure goes up and down drastically. My wife thinks I’ll get approved but reading how tough it is, I have my doubts. I haven’t worked since 2016. I’m bored to death. This is not how I expected to have to retire. I never got that retirement party either.

But I have people tell me That I should be working . I have medical records going back 35 years, much of it is very pertinent to today also. Since the age of 21 I've had osteoarthritis but originally was diagnosed with psoriatic arthritis, and most recently osteoporosis, at the end of my twenties I had a severe back injury, in my thirties I reinjured it, which led to the loss of a job and then one suicide attempt as I have a lot of depression and anxiety with this. My gallbladder has gone almost gangrenous and I have had melanoma cancer and upper respiratory problems, the most recent lasting 11 months in 2014. I've always worked very hard out working many youngerpeople despite all my conditions and I've even worked up to three jobs 7 days a week before. my new lawyer and even the Social Security office seem to discourage me from having any more than the last 12 months of medical records which I didn't understand because many of my older records are very pertinent to today. As it shows how long I've been dealing with this and how driven I am to pull my own weight. The determination office agreed that any records pertinent would be beneficial so I sent them a thick package of a copy of my medical records. I'm not sure what to do about the lawyer yet as I'm doing most of the work so far.... And my mom used to say if you ever get a lawyer get an ass hole, because they'll get things done for you. The straw that broke the camel's back was my fourth compression in my lower back which floored me to my hands and knees. Now I'm exhausted, constant pain in my hands shoulders elbows and back, etc. I may not have one specific condition but the ones that I do have I've had for a long time. the most disturbing thing is that it can take so long to get approved for disability what do you do in the meantime?I can't file unemployment because that will be at the assumption that I'm able and available to go to work. I can't really work more than five or so hours a week without being disqualified for the same reason again..... So do you have to basically be living on the street and desolate to be taken seriously?

I don't know that I would go that far but your medical records do need to document a very severe impairment and your doctors need to discuss work activity limitations. I would also respectfully disagree with your mother's advice - SSD is not an adversarial system and lawyers who are overly aggressive usually don't fare too well.

All my doctor's did all of that , I had my neck fused and the judge still stated I could still do my job . That was as a CNA. I could not go back and do that job. The last judge just did not like me at all. The next judge sided with me because of their job person stated that if I call in more than 3 times a week I would in deed be fired

The abosolute diagnosis bothers me. I was misdiagnosed so often with gerd and vertigo that my symptoms were ignored by the judge. 4 years after I won ssi based on my hand disorder I was diagnosed with Chiari One Malformation which caused vomiting and in my mri report before the hearing but I didn't know it (that was misdiagnosed as gerd) and 7 years after winning diagnosed with seizures that was badly misdiagnosed as vertigo. Those two symptoms weren't taken into account at the hearing. Only thing that mattered to the judge was if I had fusion of my wrist or was scheduled which the surgeon didn't want to do at the time plus I wanted a different surgery (I had 2 common surgeries already that wasn't fusion)

Shoulders are pinned, knee replacement, other knee is shot, wrists are shot, prostate cancer survivor with leakage, degenerative bone disease, and I kept working as an underground miner. I am now dealing with a head injury and I cannot stay standing after 1:30pm everyday, I sleep for an hour or two and I get up like I am hungover and slowly come to life. I was rear-ended nearly two years ago and did not close the case. I now have to see a neuro-physiologist for evaluation. I get confused, unbalanced and slur my words. My head hurts, sun up to sun down. I tried for a year to John Wayne my way through it but it only got worse. I cannot hardly concentrate on anything for more than twenty minutes. I have not worked a job for over a year. Our savings is exhausted and my wife's income only covers medical insurance. I filed a couple of months ago and have not heard a word from the attorney. I am age 57 and wondering how long it would take to win a case like this?

You may have 2 problems. Getting medical care/coverage, then qualifying for disability. Research online first on what qualifies you for Medicaid and Disability before doing anything. Read your State govt websites for Medicaid and Disability qualifications and requirements. It's a waste of time to apply for either if you don't qualify. Get Medicaid or get medical coverage. That's your first step. Go down to your local Medicaid office, or go online to apply (if you qualify). Going down in person gets you faster response. If you make more than a certain monthly gross amount(You don't qualify for Medicaid), then see if you can afford obamacare (most can't or no options depending your State where you live). If you cant, you have to shop around for insurance you can qualify for and afford. That's a whole other can of worms. Don't be discouraged though. Read on. If you do qualify for Medicaid or you can afford medical coverage, then start seeing a doctor immediately to get diagnosed and treatment. This is your second step. If you're trying to qualify for disability, then you better meet certain medical conditions based on diagnosis and treatment (time and medicines). This is your third step. Certain things qualify for disability and certain things don't. Read up on your diagnosis and how long you've been treated and if that qualifies for disability. Go to the govt disability site to read all of information. I hope this helps. I've done all this and passing along my experience. I'm now waiting for a disability determination on my second application.

Worked 39yrs at the same place. Had many jobs there from warehouse to truck driver to outside sales. Now have stenosis and bulging disc in my neck and lumbar. Had C5-C6 fused in 2013 and many many epidurals over the years. Had kidney cancer last year and still under active surveillance for that. Hip pain runs down my right leg to the foot and neck issues still. I also have carpal tunnel in both wrist which wakes me every morning from the pain and numbness. I am 57yrs old and just can’t keep going like this. Would I have a shot at disability? My Dr said to just tell him when I had enough and he would help me as much as he can. Just worried about the time without income and insurance.

Thank you. Was denied ssdi at the hearing so attorney told me to reapply. Judge said there was not enough proof in my psych notes about my problems concentrating, focusing, and absenteeism. Secondary to my depression I thought. Which limits my functioning and commitments. Although I lost 2 jobs in 1 year it was not enough. Dr. Said they were not allowed to complete function report. So reapplying and changing drs. My mom insists I continue to try to work because she continues to support me during the 2 year ssdi process prior to denial. Concerned trying to work part time will hurt my case. Seems the ssdi assessment is based more on physical than mental..anyway., thank you

I have spinal stenosis, degenerative disc disease, osteoporosis and osteoarthritis throughout my spine. I have 6 disc removed with a cervical fusion (4 disc removed from my neck and 2 from my lumbar,) I have high blood pressure, high cholesterol, hypothyroidism, hiatal hernia, NASH, GURD, I had a pituitary Adenoma removed but it has affected my memory, I have permanent nerve damage in my right shoulder, right arm, right hand nerve neuropathy. I have had my right shoulder completely rebuilt rotator cuff with muscle tears and bone spur removed. I have 40% hearing loss. I can’t lift more then 1 pound over my head and in fact struggle to raise my hands over my head, I sleep about 3 hours a night. And my nerve damage in my right arm is always on my mind and it is constantly causing me pain along with my neck which sometimes has my head feel like it is floating. I struggle to walk very far for very long and have to alternate sitting and standing and struggle to bend down or squat or reach over my head. All of this has been documented by 2 neurologist, 2 orthopedic surgeons, endocrinologist, my family physician and my chiropractor. I have a lawyer who is suppose to be one of the best in st.Louis and yet I got denied after 45 years of working and paying into social security. I am currently in the reconsideration stage and it’s been over 16 weeks since I filed for my first appeal. Oh I also just turned 62 years old in august. My original filing date was October 1, 2022. I am shocked that I wasn’t approved the first time with all my ailments that have been documented by x-rays, c-scans, MRI’s

I wish you were in my area. For the last 6 years of going for disability for my son, not once did he show up at a hearing. They did it without him. Based it on one brain tumor. He has had two more since then and his cancer has never gone away. First lost use of his right hand and is now bedridden. Still no disability. They asked me to fill it out now and they will file again. Not so sure I want them to do it.

I applied for SSD myself. I did not have an attorney, I completed all paperwork and got all medical records. I was injured at work in 2012. I did have severe serious injuries. I did return to work but had difficulties. The doctors pulled me back off work had more surgery. I had functional capacity test and occupational tests. I had an IME, the IME doctors opinion was in my favor, and he even allowed that I would need future surgeries for my problems. My employer let me go in 2015 cause I could no longer to my job. I went online and applied for SSD. I gave them all paper work they requested met with them at local SS office. I took about 5 months I met with them and my case was approved, they said it was open and shut. I was prepared for the hard fight because of the stories you here about it. I told this to my case worker and she said that cases like mine are pretty easy, had all med records, other opinions, tried to return to work and several doctors exams and opinions. Maybe it was easier because it was work comp, I don’t know. My point is if you are legitimately disabled and can’t work don’t sweat it you will be approved.

Question anyone: Does the attorney send any type of information to the judge before the hearing? I had my hearing and it just seems that I wasn't able to convey to the judge what I wanted to and the questions from judge were ones where my answers had to be a yes or a no, kind of short, blunt answers. The judge seemed satisfied with these types of answers and pushed for a little more info when he/she wanted It. I have waited such a long time, I think I'm grasping at any thing that will tell me ITS OKAY..STOP WORRYING..YOULL GET IT 😔
