Volenti is a defence based upon the claimant consenting to the risk of injury suffered. It is raised by the defendant. Hope this helps.

@@thelawteacher5724 there is a difference of risk/damage that emanated from plaintiff's own mistakes and risk arising independent from the defendants. Could volenti shield the defendants if the damage arose from defendants' negligence❓
