I found you after a horrendous contract law lecturer and you are so good at this. I’m taking torts next block and immediately checked to see if you had one for torts. I finished your video and then went and did my readings and it was so clear. If you are struggling with sometimes overly wordy and unwieldy textbooks and lectures I strongly suggest listening to his lectures first and then doing your readings and coming back to the videos to solidify your understanding.

I got a 7 in my torts course (High distinction) last year and work in the area for an insurance company. I am watching this lecturer to provide me with some information on how to deliver a fairly succinct, short style presentation to my team on torts law and negligence and there are some really useful tools here! In fact, some of the torts that I am not frequently exposed to on a regular basis are included in this video and it is really entertaining. I should probably save this for later though... Gotta get back to studying Environmental Law and Equity/trusts!

25:05 The person is in a moving car and the door handle did not work so she was 'totally restrained'. What if the door handle is operational, but you have to open it while the car is moving. Then think about the different speeds. It's possible to open while stopped in traffic. Another thing to open while it is moving . "Oh but you had the option of opening and jumping out of a moving car"

All very true. I would think that anyone who is in a moving car would be considered totally restrained - but remember that cases are only precedents for the law, not for the facts.

I should have come across your presentation before 2020. I had to read many tort law books, contact law books, IP law books, banking regulations when I was working on civil suits relating to those areas from 2016- 2020, self represented. Your video presentation are excellent but one must master the text books, reference books, case law, and perform legal research to fully understand the topics.... I have to agree your videos are excellent source of learning in addition to book materials that ate available. I am neither a lawyer nor a law student.

I wouldn't imagine so. The police officer would, at the very least, have to know the report was false. This would be a matter in criminal law rather than one in tort.

I am a law grad from the Solomon Islands. I'm in Aus currently working on a berry farm in Tasmania. In Solomons the legal system is the same as in Australia because the British establish the courts in Solomon Islands. I want to further my studies here but don't know how to.

Well, nuisance is all about the protection of proprietary rights in property. A drone hovering in your back yard would, however, quite likely constitute a trespass, if it was at a sufficiently low altitude that it interfered with your enjoyment of your yard. Hope that helps!

Did you record this in the dunny with an iPhone as a microphone? :P I wish stuff like this was about when I did my LL.B tbh. It's far more interesting and to the punch. The greatest suffering is having information trickle fed at the rate for the lowest common denominator in that class. My uni did a lot of 'diversity' student appointment too so there were inadequately unintelligent people in the class so everything dragged so slowly because they couldn't get it.

Trespass to land .. if they enter illegally (no legal authority and big no entry and private signs.. and a locked gate which they broke into) and they didn’t leave when told to 15 times… it’s two tortious acts, right?

Looks to me like the trespass is one continuous tort, but then there's also the potential criminal side: breaking into a locked gate can be breaking and entering.

Hi Phoebe, in the video I do cover the potential liability of rescuers. It really varies a lot from jurisdiction to jurisdiction. Generally speaking, though, sudden emergency is a defence to an accusation of battery. It's similar to a situation where, say, a person pushes a child out of the way of an oncoming car. It technically meets the definition of battery, but the argument would be that due to the emergency there was lawful justification. But each case really does turn on its own facts.

Words can certainly be assault, but only if those words are threatening physical violence which the person has the ability to immediately deliver. Words themselves are not assault or "violence" and it is a pity that modern feminist thought has conflated the two. It leads to a lot of confusion.

The general principles will be the same in the UK, absolutely. However much of the Australian caselaw will probably be less useful than the equivalent UK cases. So yes, definitely useful - so long as you remember this is pitched for Australian students. Good luck with your exams!

Victims compensation claims are a fucking joke. If you claim someone called you sir instead of ma'am you'll make a mint, but if your home is invaded, smashed up, and tens of thousands of dollars of shit taken expect zero compensation.

It's certainly true that victims compensation (which is auxiliary to the criminal law) and tort law give wildly different levels of compensation. However issues of gender discimination in Australia are dealt with under the Human Rights Act. It would take something very significant for there to be a large financial order under that legislation, certainly something more than an unfortunate choice of pronouns.

The sound thing is interesting - some people have no problem with it, and for others it is terrible - hopefully I have improved my techniques in the last two years since this one went up though. Glad the content was helpful!

Hi could you please be mindful with the way you speak, you "eat" your own words towards the end of each sentence. I can not hear the full sentence. It is extremely frustrating.

I'm aware that for some of my overseas listeners, my Australian accent can be a problem, and one aspect of an Australian accent is a tendency to emphasise the beginning of a sentence, while fading the end of the sentence. Having said that, about a third of viewers seem to have had issues with the audio of this video, which was recorded in 2018 when I knew much less than I now do regarding the process of making and postproducing videos. Hopefully my more recent material is easier to follow. The accent, however, I'm pretty much stuck with.

Would you like a full refund on the $0.00 it cost you to watch this? :) I've learned a lot about making these videos since I made that one. Only some people on some devices seem to have an audio issue though. Sorry it didn't work for you.
