I've noticed that since I've started carrying, nothing negative comes from my car or me. If someone cuts me off there is no flipping them off, if someone flips me off, there is no return gesture. I'm protecting myself but at the same time I'm protecting the other person.

I was in a similiar situation but not with one evil man but with five. I got away from the initial attack and drove like hell to get away. They followed me. I drove 80mph thru a small town with a 40 mph speed zone hoping to get the attention of the local Constable. It did not happen. I finally got home and circled my home three times honking each time I past my home. When I stopped. my Dad was waiting and the two of us were able to take on the five thugs. He was a WWII Combat Veteran and I was a Vietnam Combat Veteran. We stopped them without hurting them too much and held them until the LEOs arrived. Long story short, they served some time in Jail and never bothered me or my girlfriend again. I loved fighting a good fight with my Dad. This was in 1968.

Liberty Or Death I was thinking the same thing. I think the overall message is not to escalate things by staring him in the eyes. It probably would be a good idea though to stay aware of what he is doing with his hands so that if you are boxed in you can be ready to react if he breaks a window, gets a door open, or pulls a gun. Something else that is a good idea is to call the cops as soon as possible. Sometimes the person who assaulted you will try to call the cops and get you in trouble and being the first person to call can make a huge difference in how you are treated if you do end up pulling and or firing your weapon.

Agreed. Two weeks after getting my license at 15 some guy came up to my window asking for money for car troubles. I didn't have any money, but offered to help regardless. I noticed his bloodshot eyes, erratic behavior, and generally speaking, I had my wits about me. My avenues of driving out were blocked (without endangering others). Luckily, my brother had left his pistol in the Bronco I was driving. The guy suddenly went from 0 to 90 on the rage factor in a nanosecond. One of his arms went through the window to open the door and one went behind his back. I didn't wait to see what he produced. The pistol aimed at his forehead de-escalated the situation and he went from 90 back down to 0. Luckily, both of us walked way with our lives. I know that's not the same as road rage, but I would highly suggest keeping an eye on their hands at least.

This is by far the best video I've seen on how to handle this situation. As you point out you are safe inside the vehicle. I would add don't get out, If you need to get away do it with your car. Even an attacker with a tire iron is going to think twice about getting to close to a moving vehicle. There is no shame in falling back to gain a better position. Don't let your ego turn you into the aggressor.

I used to lead a team of bouncers at a bar with a lot of problem children. The amount of times me or any member of my team were told someone was going to kill us was quickly more than we could count. The amount of times we died was zero. The amount of times we took revenge or used it as an excuse to hurt people was also zero. We always stood our ground, (including when weapons were introduced,) but we never sought retribution or any form of retaliation. We just did our job. Any bouncer with more than a month experience could tell you similar stories. People acting badly never makes it a good choice for you to act badly. Besides, most of us got out our aggression in the ring or on the mat, so we had a healthy outlet. Couple that with being sober and good decisions were a lot easier to make. Guys who are actually tough don’t need to act like tough guys. Controlling your temper is a sign of strength.

Truth is, the cops are NOT going to side with a Non-cop who shoots someone, neither will prosecutors/district attorneys. If they have a dead man in the street, they want someone in jail for that. The only way it will be okay is if the aggressor had already fired shots at his intended victim or caused them great bodily injury. People seem to think that because they have a concealed weapon, they have the same rules of engagement as a cop, which they don't. The cops can shoot someone for simple assault and get away with it, a Non-badge citizen cannot.

I totally agree with keep driving if you can. The problem here is if he has other ideas and is trying to force you off the road. Any type of shenanigans at speed has a very high probability of serious injury or death. So it's decision time...do you try to keep driving or do you pull over and take your chances on the side of the road? Now let's say you're on the side of the road and he gets out of his car with a weapon of some sort like a tire iron. I gotta say that being stuck in the drivers seat while he's coming through your window with a tire iron is a horrible place to be. There's nowhere for you to move. So do you sit in the car and wait for this to likely happen, or do you exit your vehicle so you can maneuver as soon as you see him exit his with weapon in hand? There's nothing consistent about road rage situations.

I have to make a few comments here as a cop: I understand why you don’t want to stare someone in the eyes, I get it, it’s supposed to de-escalate. However with the seriousness of people being shot and killed or hurt on road rage incidents, it’s a risk that we shouldn’t take. Keep your eyes on him and his hands... hands hurt! 1) if you can... drive off. If you can’t, call 911 immediately. Being unlawfully detained by someone is serious! 2) draw your gun and keep it down like Chapman says. Displaying your gun, and pointing it at someone, is a use of force. You can’t use force on a baby throwing a tantrum! 3) as long as your car is locked, windows up, and he/she can’t physically get to you, wait for the police. Keep your eye on them. 4) if the guy pulls out a weapon, like a gun or in the video, a crowbar, then it’s time to present your weapon! I don’t care if he breaks my glass or not, if he pulls out a weapon, you need to put a sight picture on him and start communicating your intentions to him! He is threatening death and great bodily harm now. Any reasonable person would want to defend himself from any attacks from this guy when he’s carrying a weapon. 5) finally, if he breaks into your car... your last bastion of safety. You may need to pull the trigger. If you can’t run, deescalate with words, or drive off... you have exhausted all options. You need to do the unthinkable and end the threat. Good luck to you all!

Appreciate your service and what I believe is sound advice. I grew up in NYC (Harlem and South Bronx) ignoring someone like this is likely to enrage them further. As you mention, you want to keep your eyes on them, not with a look of fear but not with intimidation. You want to know what's in their hands. Hands are dangerous. The presentation of a weapon by the peep greatly changes the scenario. In a second that weapon can go from damage to your car to damage to your person. The justification for use of deadly force includes the use of force by an attacker that can cause serious bodily injury. That would include taking your eye out with a piece of glass when he breaks the windshield. Some of this seems so obvious I'm think John said some of these thinks to test his audience.

@@KnowOneNoWhere-86 unfortunately, it’s not an issue of bruised egos… it’s an issue of mental health. There are too many videos of cops getting killed by not taking a more forceful initiative. We have way more mental health issues and way less mental hospitals that force police officers to have to deal with these people on the street.

Good video. Had a guy almost hit me when he was flooring it onto expressway, I motioned for him to not get so close, and not with any obscene gesture. It was reflex because he came that close to spinning me out. He forced my vehicle off the highway in a wedge scenario. And got out waving his arms, he was obviously having a bad day before he met me. I pointed at his license plate and backed up 50 ft on the shoulder and yes, I was ccw. He finally got back in his truck and drove off, I knew if I got out of that vehicle, that would be considered escalating the situation, and that would put me in a bad legal standing. We have a saying in Security, you may win your case, but you will loose all your money doing so. When he says do not look at the guy, he is saying do not escalate the situation, of course you will be observing hands for weapons. It is smart to avoid being judged by 12, as well as carried by 6.

As an active Martial Arts of 50 years old. It is an arms race, meaning de escalate when possible. If attacked with a knife you need a stick, etc. Walking away from even a shoving match is smart. Push a person down, they hit their head. You are going to jail. Just be nice!😂 Great video

My experience has been that it almost always "takes two to tango" with road rage. I drive a lot to travel these days, and I could have a road rage incident every trip if I wanted to. I don't. Someone cuts me off, I just slow down, give them room, and pretend it didn't happen. Some tailgates me, I just slow down and get of their way. Fast moving 4000 pound cars are not the right things to have pissing contests with. Also, when you do all of these things, if it gets where you have to defend yourself with deadly force, you don't have to worry about other witnesses or video saying you egged it on.

Speaking from an experienced situation which luckily did not escalate, a driver did pin me and my only thought was if I pull off to get away from this person, I am now risking others being involved if this guy gives chase. You can't just drive away sometimes. You risk speeding and putting others in danger if the guy gives chase and is relentless to let you go so easily. Does anyone else think or feel this way? It's really not that black and white easy as it sounds. You have to consider the environment and if you have plenty of traffic on your roadway, you simply cannot race off to dip around cars and lose this person.

Good forward thinking. But if i could get away and minimize my exposure, I would. It's not that my family sees he hurt someone or defending them violently, it about using all other methods of escape before I use deadly force. Thanks for the knowledge nuggets!!!

This is great advice. The only thing I would add as a police officer is take the opportunity to call 911. Give the dispatcher as much information as possible, ie description of vehicle, license plate number, your location, description of subject, weapons involved etc. This will get the police to you faster, give them an idea of what they're coming into, and when they get there, let the police handle it.

Laws vary state to state and here in Indiana once that dude breeches the glass with a tire iron and I’m pinned in, he gets lit up with a few rounds. He should never have a chance to grab you through the glass. Several months ago an off duty reserve officer in my town got road rage and confronted a guy in a parking lot and ended up getting shot and killed. The guy that shot the reserve was not charged, being that the reserve was the aggressor.

NOT LOOKING AT A ATTACKER IS LIKE TURNING OUR BACK TO A RAGING BULL
@pmh1nic

I'm wondering if John said some of the things he mentioned to test his audience. Not looking at the person attacking your vehicle, which in a split second could be an attack on you, the presentation of a weapon and breaking the windshield which alone could cause serious bodily injury to you or a passenger, breaching the windshield or passenger window using a weapon in my mind are justifications for using deadly force. The idea that you wait until the very last second puts you and the other innocent individuals in the vehicle at a great disadvantage.

I would've presented my weapon as he grabbed the tire iron. That, to me, is deadly force, as one hit to the head with that metal is basically a kill. At least it is my interpretation of our laws (i'm a lawyer in Brazil).

ok question, watched, agree with everything that was said, BUT i noticed one thing .. when the guy tried to enter the vehicle Mr. McPhee grabbed him by the shirt and started pulling him in would this not constitute assault ? thereby causing you ( the victim ) to be accused of escalation? The video ended before seeing how Mr. McPhee would have ended the confrontation so I am not sure If I missed anything there or not. any insight is appreciated =)

I think this is all good advice, but I also agree that you need to keep an eye on them if possible (perhaps without looking them in the eye). Years ago: Two young guys (one black, one white) walking as it's getting dark--as I pull to a stop sign, they're walking by, but the black male yells, "Yo!" which I mistake for possibly being my name (Joe). I can't see him well because it's dark, but I think it might be my friend Ty (a black guy whom I play chess with). He starts to come around to the driver's side, and I check the doors are locked. I then put the SUV in first gear, ready to take off. I roll the window down like 2 inches to hear him as he says something like, "Hey man," but just then, I hear the other guy trying to open my passenger door. As I take off, I look to my right and see he's pulling the door handle. The next day, I hear about a car-jacking 3/4ths of a mile north of that spot. They shot and killed the male driver of the SUV, and threw the girlfriend out. She identified the men as a young black male and white male. I called the police and gave as best a description as I could (height, weight, hair), and described how they approached me. I don't know if it was the same guys, but I think it was. If my doors hadn't been locked, the white guy would have entered the vehicle, and I'm sure the black guy would have been right behind him.

In New Mexico, grabbing the driver after breaking the window or by opening the door is the same as entering someone's house. Happened on I40 in Albuquerque a year or so back. Driver shot and killed the bad guy and the cops let him go at the scene.

I keep mace in my center console, but that's last resort before a firearm meaning that he'd have to have broken a window or forced open a door. And even the mace (pepper gel spray in my case) you'd need a clear shot so as not to have it bounce back and get you. For me just be ready to back up and and then drive around and away.

Looking away from him/her can easily escalate the adrenalin and cortisol levels in the road-rager, causing him/her to go farther than they originally planned to. One of the most effective methods to de-escalate a situation is to show the palms of your hands, moving your hands in a short motion toward them and back toward you, if you can do so safely, while mouthing, "I'm Sorry." If that rager continues and you cannot drive away, have a previously prepared plan. Do you immediately call 911, being aware of your exact location, suspect and vehicle descriptions, to include your vehicle? Can you index your hand(s) onto your weapon? You certainly can, ensuring that it's not exposed to that attacker until two things happen; 1). The suspect's actions are creating or are about to create an imminent threat of death or serious bodily injury (FL laws), 2). That threat is legally a forcible felony (FL laws)and is absolutely imminent or happening now. 3). And the level of force you potentially use is appropriate to the level of threat. Nothing says that you cannot have your hand on your weapon, ready to go if needed immediately. But be well-practiced. Remember, short of being in a Miata with the top down, most locked vehicles that have the windows rolled-up are fairly safe, unless the attacker has a weapon capable of penetrating that vehicle. If that's the case, maybe accelerating, but maintaining control, is the key, even if you hit something, but hopefully not an innocent 3rd party. It's better for insurance to have to pay for property damage than for you to get seriously hurt or killed. Call 911 as soon as you can and breathe, don't hyperventilate. You have too many people who need you and love you, so come up with multiple response plans and think them through several times. That's called forethought training techniques. Think scenarios through smartly. That creates myelinated neural pathways, wrongly called muscle memory by most. You may be having the best day ever, and the unintentionally cut-off the A-Hole who is having his worst day ever, and you can quickly become their outlet for their rage or psychopathy. Stay vigilant, stay sharp, and remember that sometimes the best way to win a fight is to avoid a fight. Don't be a victim; be smart, be prepared, and react appropriately. May God Bless You and Our Vets.

I almost had a bad incident at a gas station a few weeks ago. As I was about to leave someone kept backing their car towards mine and I thought they were going to hit my car so I honked at them to watch out. They stopped for a moment then started backing up again so I stepped out of my car to watch the situation more closely or, if need be, ask the driver what they are doing or tell them to pay attention. The driver of that car immediately stopped his car and stepped out and took a few steps toward me and stopped about 15 yards away. He didn't say anything and we were both heated about the situation. I said "I'm just trying to get out of here, man" and he replied "I'm trying to get to that spot". I realized then that he was backing up to get to one of the gas spots so I said "you know what, don't worry about it I'll just back up my car" to which he said "someone already took it it's too late". We both went back to our cars and I said "sorry, man" over my shoulder. I wasn't armed at the time but if he had come closer and invaded my personal space one of us was going to win and one was going to lose this physical fight. And for a moment I thought 'but what if I had a gun? Then I wouldn't have to fight if he had come closer' but then I realized you don't use a gun unless it's a last resort. But they grey area is: A fistfight can be lethal for different reasons. So by resigning myself to a potential physical confrontation I'm taking a risk of not seeing my loved ones again. But it's a risk I'd rather take than brandishing a weapon or firing one over a small incident like this. It took me a few hours to shake my pride because my pride kept telling me I should have just walked up closer to him and have that conversation up close like a real man would. But that could have escalated the situation further. So I think I ultimately did the right thing and conceded and found a way to reduce the hostilities.

If you haven’t already, watch Masaad Ayoob’s Use Of Force video. It’s getting a little long in the tooth, but the core mindset you need to have is there. “Imminent fear of death or great bodily harm” is the operative phrase. If you had even the slightest opportunity to hide in your car with doors locked, back up and drive away, or even leave your car there and run, but you shot someone anyway and they die, chances are, you’re going to the slammer (blue state definitely, red state depends on how good your lawyer is). I was always taught, if it comes out of the holster you’re using it to save your life or the life of a family member. The number of things that can or will go wrong go up exponentially the minute you draw it and don’t shoot it. Now you’re pointing a gun at him. If he’s not pointing one at you, now you’re the aggressor and you’re on all the security cameras. If you start threatening him-don’t move or I’ll shoot!-and he moves and you don’t shoot-if he’s street smart, he now knows you’re probably afraid to shoot him and it might be worth the risk to try and disarm you. Long story short, it is a living nightmare legally, financially, emotionally to use a gun for self defense in today’s climate. At a minimum you are almost certainly going to lose your gun whether you were right or wrong. You will be put in jail until the DA and cops try to determine what your deal is and if your demographics might be conducive to making an example of you. My brother went through a watered down version of this, so I’ve had a front row seat of the wheels falling off the cart. Not to be overly dramatic, but if you haven’t worked out in your mind what you would do if X happens, you should. The meekest, mildest, well-meaningest person can seriously f@ck the rest of their life up with a few seconds of poor judgment. I tell my son all the time, the two most important skills for someone who chooses to carry a gun are Awareness and Avoidance. Master the art of seeing problems before they start and avoid putting yourself on an “x” when you don’t have to. Odds are you are far more likely to put those two skills to work to save your life than you will being able to hit the paper in the right place. Sorry for the rant, but if I can save one person from going through the hell my brother did it will be worth it. Keep on keepin’ on!
