I guess Sega just assumed that they would never rerelease the game and didn't bother getting the rights for future distributions. But I remember this is kinda an issue for a lot of games. GTA IV recently got an update that removed copyrighted music from the radio. Also even if they couldn't get all the music, the tracks could always be replaced like they did for crazy taxi. (At least then fans would be able to mod it back in)
