Their Grandsons have also registered affidavit stating that they have neither collected the title papers nor paid the mortgage. It is on account of lapse of time.

Hello Sir! I have a question.. Our Society Land is a Private Land Owned By A Preumptive Owner As per mutation Entry In Property Card In Mumbai. This Land Was Inherited by the Family thru a Probated Will by Juficature of Bombay HC in Year 1892. In Search conducted it is seen that between 1867 to 1929 the property title was not registered. But in 1929 a Administrator having a Cessatte Probate Transfers Schedule properties left to Grandsons. In the schedules of 8 properties left behind 7 have details of indenture of Conveyance details, when purchased from whom it was purchased. On further Investigation it is seen that the SOCIETY SCHEFULED PROPERTY WAS MORTGAGED BY DEPOSITING TITLE, HENCE INDENTURE OF CONVEYANCE WAS NEITHER REGISTERED NOR THE MORTGAGED WAS REGISTERED WITH REGISTRATION AUTHORITIES. CONDIDERING THE WELL SETTKED RUKE THAT MUTATION ENTRY DOES NOT PROVE OR DUSPROVE OWNERSHIP .AND IT HAS BE PFOVEN THFU A VALID PURCHASE SALE AGREEMENT.. SO WHAT IS YOUR TAKE.. I WOULD BEVDEEPLY OBLIGED T9 GET YOUR KIND FEEDBACK.

Hello I have a doubt in Property law. Need your thoughts on this. In condition sale Mortgage, the sale becomes absolute when there's default of payment. But clog on redemption says any condition in the contract which makes sale absolute in case of default of payment is void. Are these two concepts contradicting each other? Kindly provide your opinion on this.

sir here u have mentioned that mortgagor can claim the rent profit and all ,,, plz clarify,,, actually mortgagee has the right to claim the rent and profit out of the property till the mortgagor repay the debt... i think.. plz clarify
