You say there are two possibilities: he applied and was rejected or he was too "relaxed" and didn't realise the importance of regularising his status. Actually, there is a third possibility. He knew he would not be granted leave to remain so he CHOSE to live here as an illegal immigrant. He seems to have had quite a good life here as an illegal immigrant so I don't think he's got much to complain about.
