Simply because of what has just happened over that last couple of weeks culminating in the unanimous, eleven - nil, Supreme Court ruling, that Boris Johnson broke the law after attempting to prorogue Parliament for five weeks. I say *_attempting_* because the Supreme Court declared Johnson's prorogation *_"null and void"._* *_"What we have"_* _*IS *_ very good, and has served us very well for hundreds of years but Johnson's antics, with his contemptuous disregard of Parliament is forcing this very issue. Judges should not get involved in politics
@m77ast
@m77ast 5 жыл бұрын
As an external observer. I cannot see how anyone can say the judges were correct. Parliament prorogation is something that has been done forever. Yes Parliament Remainers did not like the prorogation but was it against the law? NO. If parliament wanted to change it - they should have put the legislation in place - like the legislation that was used to change the circumstances of an election. There is something that I cannot put my finger on here. If they were close I would have said it’s probably some type of high level secret society at work. I for the life of me cannot understand how Beaureacrats in Brussels can be able to control our parliament and now our judges to the point where they are eager to sell our nation down the toilet.

You should read the summary judgement. www.supremecourt.uk/cases/docs/uksc-2019-0192-summary.pdf?fbclid=IwAR2BzhKtDaFYgg8fJ9KLlJogN0E7XkKdvaNV0TS__RpNGojlHpkbqFOScgk It's very clear why this particular prorogation is unlawful: if prorogation frustrates the power of parliament to pass laws without justification, then it is unlawful.
@EduardoEscarez
@EduardoEscarez 5 жыл бұрын
They were correct, because the question wasn't about Brexit but if the use of prorogation was stop Parliament to pass laws. And it was unlawful because it was that case, the PM use that option to stop Parliament to work. At the end, what the UKSC did was to regulate how the Executive and Legislative powers interact in this matter, so the PM can abuse its power.

Protagonist Parliament in a way as parliament can always legislate to overrule a Supreme Court ruling. Judges are accountable to an independent body of judicial conduct. So if they are found to be corrupt there is a process to remove them. So judges do have accountability as do the executive and legislative. The judiciary aren’t directly accountable to the people which is a good thing. It means they are truly independent of politics

xEradd I don’t know, but it doesn’t seem really possible. If things go well, who will want to rejoin..? Even if UK will want to rejoin in the future, Spain and France will hardly let the UK in... If brexit happens, the UK will have new trade agreements around the world as well as a new agreement with the EU and by that time the country will adjust to the post EU reality. The idea to rejoin won’t be popular, unless things go so wrong...but with British economy and ability to manage things, their position in the world, friends and allies...UK will do just fine.

5:24 "it goes to the heart of how our democracy can and should work" How democracy should work is, when 17.4m vote Leave and 16.1m vote Remain, Parliament acts out the will of the People. Parliament no longer represents the People. As to today's judgement, the wording of Article 9 is clear that proceedings IN the parliamentary sitting are NOT subject to oversight by the courts. Whether they are generated by the speech and actions of MPs and Lords is irrelevant. Article 9 simply does not make that distinction. On the contrary, it sets speech and debates and proceedings apart. The Supreme Court judges cannot add to or take away from legislation. They can only interpret it. Their novel restriction of proceedings in parliament to the speech and debate of MPs and Lords effectively rules that the process of parliament itself has no beginning and no end ... no opening and no prorogation or dissolution. Somehow these are not processes in parliament as per the actual wording of Article 9 but semi-detached events that can be displaced from Article 9 entirely. This cannot be a good judicial reading. If it is allowed to stand, then power now resides not with you and me but with those wealthy enough to exact change. That is why the statement expressed at 5:24 into this video is completely wrong.

What nobody asks is 'what affiliation do these judges have' has anyone asked if they are Remainers? What if these eleven judges have a hidden agenda. Who chose them? What affiliation do the choosers have? It's the age-old question 'who watches the watchers'. Is prorogation legal,,,,,,,, yes it is, so why all of a sudden is it not? Can someone explain. You can't place no waiting signs along-side a legally parked car and the give it a parking ticket. I think the time has come for the Queen to step up and RULE over her country, dismiss Parliament, dismiss Government,,, stop all this treasonous behaviour. There are so obviously Dark and Devious machinations going on by the so-called ruling classes,, why can't the public see this? The Queen would NEVER have agreed to prorogate if she even thought it was illegal, those judges should be disbarred, disrobed or whatever you do to a judge. By accusing Boris,,,,,,,,,,, they accuse the Queen. Let the wishes of the people prevail, October 31st,,,,,,,,,, we leave. Even the remainers must see it's not about leave or remain any longer it's about true democracy,,,, do we have it or not?

_Can someone explain_ Yes, it can be explained. What you need to do first is read the summary judgement www.supremecourt.uk/cases/docs/uksc-2019-0192-judgment.pdf?fbclid=IwAR0tAwtPSUDuDwZcqu_kvn2mwfhX2uyG0OsCrSlR3mJkAfm3fKMMOIc2Vt4 or the full judgement www.bailii.org/uk/cases/UKSC/2019/41.html They are both very clear and precise. _Even the remainers must see it's not about leave or remain any longer it's about true democracy_ Democracy is founded on the rule of law. Latest is that the Attorney General gave a written judgement that to prorogue parliament was not unlawful. His judgement allowed Boris Johnson to ask the Queen, the Ulimate Soverieign, to bring the parliament's life to an end, in order for Boris Johnson to have a Queens speech delivered to the PEOPLE with respect to his Governments plan for the future. If Parliament did not agree a vote of no confidence could have ensued. Then, a private citizen challenged both the Attorney general and the Prime Minister and come away with a judgement which goes against the Attorney General and the Government. The Supreme Court basically told the PEOPLE that the Prime Minister lied to the Queen on two counts. Count 1 that the Queens speeech was to be a fig leaf and Count 2 He was using the preroging to stop Parliaments work. THESE ARE DANGEROUS TIMES FOR DEMOCRACY when paid servants of the Crown make judements of what they THINK was in the mind of the LEADER of their Government. The Supreme Court, a body which has made a unaninmous 11 to 0 decision on a subject that the Attorney General gave the other way seems not impartial.

The British voters were misinformed, offered "pies in the sky" and lied to prior to the Brexit Referendum. Lack of information or an abundance of misinformation leads to BAD decision-making; 2. It is high time for the British people to draft and implement a Written Constitution; 3. An Independent Judiciary which rules without fear or favour is the keystone of a Living and Thriving Democracy! I rest my case.
