There is a good reason the US has never participated in it. The whole idea of universal jurisdiction is a farce, designed to circumvent the entire point of a fair trial. The same goes for trial in abstentia. In fact, since you are so misled, I feel the need to remind you that this EXACT scenario was brought up in Bill Clinton's December, 2000 Camp David statement about his fundamental concerns about this court, and reasoning for his recommendation that the US not ratify it. It seems he was quite prescient, and yes, this WAS talked about. I suppose before you were born, but that doesn't change the fact that the ICC is a cruel joke on the world.

The ICC is not a national court? What is the executive power it answers to? Countries that represent at least half of the world's population are not members of the court. The three most militarily powerful countries are not members. Countries that are not members also represent at least half the world's economic output. Any court only has jurisdiction over countries that are represented. Thus, France's considering not carrying out the arrest warrant since Israel is not a participant in the court. On top of that, one member of the court, Mongolia, has already refused to arrest Putin when he went there. This is a bogus court.

Courts and judges should not consider military power, economic power or population numbers. Otherwise judges would always rule in favor of the strongest - the opposite of justice. The ICC is certainly far from perfect. It's real power only derives from the governments and legislatures of the member states. And those may put other interests ahead. (Example; Putin in Mongolia - look at the map - Mongolia is sandwiched between Russia & China; nobody could come to it's aid if the Russian army came in.) But it is so far the best try at having a justice superior to individual nations. Or maybe you have a better idea about how international crimes/crimes against humanity should be handled.
