PROTECTED STRIKES AT WORK
It is important as an employee, or a trade union, to ensure that when you are embarking on a strike it is protected. A protected strike is a lawful strike. If an employee participates in an unprotected strike, he or she can be disciplined by the employer. Such disciplinary action can even lead to termination of employment (dismissal).
In order for a strike to be protected, it must fall within the definition of the word "strike" as defined by section 213 of the Labour Relations Act, 66 of 1995, as amended (LRA). In addition to the latter, prior to embarking on a strike, the procedure which is highlighted in section 64 of the LRA must have been followed.
