If it was not for your documentation and coverage of this, I would not have known the scope of the damage done. It is a shame that the devastation of those communities has not attracted more attention from media and authorities. Thank you for your non-biased factual reporting of these events. It's amazing how they are so eager to place all of the blame on the parts of the dam that didn't fail, with their 8x10 glossy photos of how bad the parts that are still standing were before it burst... smh "A three-paragraph Michigan inspection report of the dam in 2018 found “moderate deterioration” in the dam’s spillways but noted they “appeared to be stable and functioning normally.” It demanded no repairs." The person writing the article either didn't look at the before and after pictures, or doesn't want anyone else to...

You asked how they own the lake bed. They own the lake bed because before the dam was ever built, the land was bought from titled property owners as was listed on the deeds of each tract of land acquired to build the lake and rip the dam. The land was either bought freely from the former land owners or through eminent domain. So yes as the property owners of the land under the lake which was public, they can keep people off the dry land. The water belongs to the state and therefore is public, but the dry lake bed is private owned land and is recorded in the register of deeds. So if the dam is never rebuilt, they can sell the land for development , unless the land is acquired by the land owner for a park or public lands. This is the law in all 50 states. If a lake is built by the Army Corps of Engineers, then the land is owned by the Army Corp of Engineers and the federal government, if the lake is dry. Look up lake Optima in Oklahoma, it is a lake that was built, and when the dam was closed, the lake never filled up, so a few years the Army Corp deeded the property of the lake to the state of Oklahoma after they abandoned the property. Lake Optima is a 50 million dollar project that was abandoned in 1995, by the army Corp.

If They owned it earlier and as fully documented failed to maintain it so as to prevent/avoid this kind of damage, then They should be legally responsible. This is a tough one, because it basically comes down to ownership, money, and regulation. The dam clearly needed a ton of work (and this was known for a long time), but the owners were unwilling or unable to fund that work (probably more the latter given that the cost to the owners would have probably been well beyond their ability to pay for). But then we have the other side of the coin which was the obvious risk to down-stream infrastructure and residents were the dam to break (which it did, finally break). So did the state and/or city have a regulatory duty to essentially take the dam away from the owners, drain, and remove it, to remove the risk to downstream residents ? Probably yes, but at the same time I doubt the state or city would have been able to actually push through regulatory reform to that degree without losing their jobs in the next election. If the above suppositions are even remotely accurate, does this then mean that the ultimate responsibility was actually with the voters ? -- There are some parallels with other disasters. In particular, Paradise California (which was destroyed in the recent fires) was not laid out in a manner that made fire protection possible. And even when they had the chance to build-in some protections such as significantly widening the main street they chose not to. Orville dam (an 'almost' disaster that took billions of dollars to fix), power line maintenance (PG&E and the CA fires), Paradise, Santa Rosa (fire breaks not built into the city plan, a city built right in the path of historical diablo fire paths). Etc. Also mine tailings pond failures (some of which have destroyed towns and killed people in the past), coal ash pond failures, poisoned ground, contaminated ground water from O&G infrastructure, salt water inundation in Florida, and so on. This dam failure is just one of a continuous string of accidents or accidents-waiting-to-happen. I don't think we can just place blame for these easily foreseeable events after-the-fact. If people don't want these events to happen, or be as severe in the future, then people have to vote for the types of regulation that can prevent it. Otherwise individual owners of such infrastructure can continue to put thousands of other people at risk when said infrastructure fails. Its a bit of a conundrum, because in many states it is not possible to vote for such reforms and still remain in office due to the 'trampling' of individual property rights (regardless of the risk to other people). That's the real crux of the issue. -Matt

It's a class of problem that is hard you action in a democracy. Any time you need to take a *costly precaution* then all you can do is spend the money and open yourself to criticism by people who assert it wasn't yet critical risk, or don't spend and get away with it, until you don't.

Would say the local and state government failed all of the people 🤔 Sad, just follow the money :-(
@elerdocraiel20054 жыл бұрын
One thing to keep in mind when wanting to "blame" people there's plenty to go around. Federal government has nothing to do with the upkeep of state roads, dams, etc. States are given the money specifically to address these issues, however it doesn't mean the money may have gone somewhere else as proven in other states during disasters. The infrastructures here in the USA were built to last 50 yrs and we are well past that TF. Some states have taken the initiative to fix this problems while other states have not. The government there received the money--the question should be "where did it get used?" or "who's pocket did it go in to?". It will come out in the end, so why worry about it now? Another question to ask is why can't you walk on the lake bed? This makes me wonder what they are trying to hide--just food for thought. I know this doesn't help those without insurance for this type of disaster, but it's all things that came to light even after Harvey and Katrina. Even talking with people in Louisiana after being relocated there temporarily, we found out from them if you choose to live in a dam area you are pretty much screwed in terms of insurance flooding terms. The system needs changing definitely, but keep in mind they always have a reason for those clauses as we found. Many blessings to the residents there and may the community receive the help it needs!

When the Federal Government revoked the dams licence back in 2018 they removed themselves from all obligations to this. It is actually nice to see the river flowing again the way nature intended. Those dams lasted 95 years, which is amazing for an earthen dam. I hope they let the river run wild and let the former lake bed be public lands. It would give the water someplace to go during floods. And make an amazing wildlife corridor. And some hiking trails for the humans would be great.
@rjgoniea4 жыл бұрын
People are asking how private entities can own the lake bottom. Its very simple. Frank Wixom bought the land before his company built the 4 dams. Most of that bottomland has remained the property of the companies that have owned the dam since then. Some parcels under Sanford Lake reverted back to the county when the company decided they wouldn't pay property tax on them anymore. This has all been covered in stories published in the Midland Daily News. Technically, FLTF can't decree anything about not walking on the lake bed as the purchase from Boyce Hydro has not been completed the last time I checked. But if Boyce Hydro is letting them say it then that's their prerogative. Great vid as always, and I am glad to hear you will be featuring the western portion of Wixom Lake in the next video. If someone hadn't asked about it already I would have.

So it's back to a River...like it should have always been. Honestly that wasn't a very good place to begin with for a dam. The deepest part of the lake was only 40ft the majority much more shallow. Dams are usually built in ravines not in such low/flat areas such as where this dam was. The dam itself was a disaster in the making with too few spillways and an earthen emergency spillway. I feel sorry for the thousands of lives that have been affected by this man made disaster, most (if not all) have only known this area as it was before the dam failure. Very sad indeed. The owner(s0 of the dam should be held liable but they'll probably file for bankruptcy. The home owners along the lake are truly left high and dry, the people below that got flooded out many of them have truly lost everything.

Litoral and riparian rights have to do with land owners and the property they own up to the shore line. Who owns the lake bottom when the lake evaporates or drains off is likely a legal issue. A quick look see at the county tax office will show who's been paying the tax in the past month. It may even be subject to foreclosure laws even though there's no law requiring any one to pay property tax. Owners should have a fence built around it as they may be responsibe for injuries if someone were to hurt themselves while on the lake bottom. Next legal issue, "What's the highest and best use of the land?" ...could it be seized via eminent domain?

I know it is not your intent, but it an interesting legal precedent, who owns but lake bed now that the water is gone? It isn't like this happens every day. If the dams are not to be repaired then someone we'll have to take ownership of the properties beyond the shoreline that were once water. A legal debate for sure and many challenges to overcome. In the short-term the lake bed is a treasure trove for metal detecting.
@mikethewoodworker61944 жыл бұрын
They would not own the lake bed, they would have to hold the deed and that would not be possible so quickly everyone in the county would be aware of what’s going on, the easiest way for you to fact find this is to visit the county office and ask who the land is registered to.

The Power company had to purchase all the land that was flooded when they built the dam. Therefore they own the land that is now exposed. No controversy except for the people that are uninformed. On a natural lake if you own property on the lake you own to the center of the lake, or you share ownership with all the other land owners with riparian rights. On the Great Lakes you own to the median high water mark. The state owns the property under the Great Lakes.

I was wondering about that issue. There goes my idea for planting potatoes. Wait! Govt. is now encouraging gardening. win/win/

You are incorrect. With all four lakes the lakebed is owned by Boyce Hydro (north two lakes) and FLTF (South two lakes) which were purchased in a tax sale. Homeowners own to the edge of the lakes "at normal level". The lands under the lake at normal level are plotted and have tax ID#s and the owners pay taxes on them. Power company does not own any land. They have a contract to purchase the electricity from Boyce Hydro until 2024.

Nice job on the updates. I noticed that you focused on the destruction of wixom lake near the southern end by the dam. What is the upper area look like? Is it as bad? Do you or are you able to show footage from that area? examples, wixom lake by Estey rd., Pleasant beach resorts and cabins, Strykers marina, and other points in that section? Is it even accesible?

Ill get some video of strykers in my next video but I did film some of strykers in my first video.

4 Lakes task force should also b e counted in those that could be blamed. They point fingers at everyone but not at themselves. Restore the river

After cleaning clock on the Dow Chem. lecheate ponds, all this crap (along with Agent Orange residue) makes a left hand turn at Saginaw, flows into Lake Huron, and an INTERNATIONAL boundary. And yet USA AND CANADA NATIONALS NEWS has NOT ONE story on this; but film at eleven of the arrest of a guy smoking pot in Polk Co.??

@@dwightstjohn6927 I'm not surprised. A lot is hidden. Lots of noise hiding the truth. While those that lost a waterfront complain, far more serious chain of events affected those below, all the way to Lake Huron. This is supposed to be a river, not a river with 3 consecutive dams hoarding water...boom boom boom...they all fall down and take a lot with them. Those that are probably the most at fault are the one's pointing fingers at everyone else. More needs to be said about what happened on the way to Lake Huron.

Hi Jordan, the river has two legs that come from Wixom lake. Do you have any footage of the leg closest to Neiner Road? Just wondering if anything happened on that side.

Lake bed looks to me to be a land grab under the pretence of safety. I think locals should get a say as to what happens to it.

If anyone is at fault here, it must be those who built and manage this reservoir. In my opinion, land dams are not solid, fortified or water resistant what so ever, and should never be utilized for retaining mass amounts of water in any permanent facility or structure. I'd expect some serious changes in dam construction in the future. Dredging out resevoirs below the water line instead of trapping water above the waterline would make a big difference as well. If this is managed by the State, then the responsibility would lie with those who manage it. If the Governor or legislature has hindered upgrades or needed repairs, ect, then they would be responsible. Otherwise, I feel the responsibility lies with those who built, inspect and manage the resevoirs.

Excellent work, Jordan. Have you seen or heard anything about the houses in between the M-30 bridges? I think there are 4 or 5 in a little subdivision. They will continue to be inaccessible until one of the bridges is repaired. You should interview one of those people if you can.

Fritz Foster except there is money to be made. I heard Jordan mention some group claiming ownership of the lake bed. I already hear the wheels of development turning

There is plans to acquire the dams and rebuild them by the FLTF.

Jordan Mowbray I guess they want there waterfront value back. It is so bueatiful the way it is now, but money talks. Maybe a cover up? Oooooo! They are all at fault, it was all about the money. Sad.

I would think that if they do not rebuild the dam, people with lake front property just got their property extended some. The land would become theirs? If not, it would not have any access to it otherwise. If they do decide to rebuild dam, now would be the time to clean out the bottom, after people rebuild of course.
